I included Wells Fargo with ASC because they are together. I found that out through a lot of research on the internet. The info that I found is a year old and it specifically states that Wells Fargo's servicing company is ASC. So wells Fargo has had plenty of time to fix the illegal and deceptive ways of ASC.

Long story short. We lost 2 houses this week to a foreclosure sale that should not have happened. We sent in a double payment in April and promised the rest at the end of May. We had called them on the phone before mailing the payments and told them that we would overnight the payments. We told them that we did not want to have problems or loose our investments. They said that it would be fine to send the payments and that would help bring things even.

We figured that everything was in good order and we were working hard to get our situation fixed. Near the end of May I went to the PO Box and low and behold there were 6 letters from their attorneys (Wilson and Associates-who by the way would not return any calls) and our checks that we had mailed that they said they would accept.

We made calls and made calls. Finally, we found an investor and he said that he would be happy to do a short sale on both properties. So we called ASc and told them we had a buyer and would they please talk to the gentleman and what did we need to do to authorize the calls that needed to be made. They said to type a letter of authorization sign it and fax it over.

We typed up the letter that gave him permission and faxed it. They wouldnt talk to him. They decided we had to call. So we called and gave a verbal. They talked to him 3 times in one day but would not tell him what they needed or wanted. On the 4th call they said they needed authorization to talk to him! They had already talked to him 3 times!

At this point we have eaten up 3 valuable days and given 2 verbals and sent 2 faxes giving the buyer permission to buy these houses.

Then we call again because this poor guy keeps getting hung up on. ASC would put him on hold from 20 to 30 minutes and then hang up on him. they would never come back to the phone. This happened every day for 4 days and at least 5 times a day.

Finally, we talked to a girl there and she said to fax several different things immediately and that they would proceed to get it immediately to the negotiations department. We hurried and got everything they discussed including a sales contract and proof of funds from the buyer. We got eveything together in 2 hours and faxed it. We called the next day and gues what?! ASC would not talk to our buyer-they hung up on him. He tried two more times with the same results.

The next day we called again-we got the same results. They said that they had not received a fax from us. we called and let them know that they had and they still would not speak to the buyer.

They next day they finally tell the buyer that a negotiator will be contacting him. they gave him the number told him to call and leave a message. He did and he tried again on Saturday as well. (several times)

ASC never answered the call and neither did their attorney's. They tried to sell both houses at auction June 11 2007. Noone bid on the houses and they are now REO. We had from May 20-June 11 to get something done and we did. ASC would not work with anyone-not even us. Not to mention that we did not even get the foreclosure letter until May 17th!

This company is a bunch of scam artists and they need to be stopped. They force placed insurance on us after raising our payments. We sent them proof of insurance but it didnt matter. We talked until we were blue. I did not know that they could agree to payments over the phone and then return our checks and immediately foreclose. We had talked to them and stayed in touch several times when we saw that we were having difficulties and they still treated us like dirt and they ruined our credit and our good name. They had the foreclosure put on our credit report before the sale that never should have happened. They lied to us about accepting payments, they lied to us telling us that they would send us paper work for a forbearance. We never received it.

This week on Wednesday June 13, 2007 ASC had 5 letters in my PO box. 2 letters dated June 6 stated that we had broken the forbearance agreement! We never received anything!! So how could we break an agreement that we never got and more to the point never signed nor did we ever agree to it. There are 2 other letters dated June 8 one says that they received our inquiry about liquidating the loan and would we please send the following information.

The info that they requested had been sent to them a week prior to their letter. A letter that we did not receive until after they had tried to sell the property at a foreclosure auction. The other letter dated June 8, 2007 state that it is not in there best interest to let us liquidate the property! The loan numbers are the same and the letters were generated the same day. Also, the 5th letter dated June 7 stated that they would speak to the buyers that we faxed authorization on. The letter was dated June 7, 2007-all that week clear through Saturday the buyer tried to reach these people and did not get any response! They did not work with him even after their letter acknowledged the authorization.

For anyone who has to deal with these theaves and liars good luck. Unless there is an attorney out there somewhere that can fight this you will loose. I am going to try one more time to contact the Wells-Fargo complaint line and lodge a complaint and see if I can get some remedy to this situation. Chances are I wont get anywhere.

I will update my complaint upon talking to these clowns. I will get good info and I will post it to this web-site for those of you who are getting hosed by the same company.

Good luck to everyone and maybe some day there will be laws and political leaders that will care enough to handle people like this and to make them pay for their deceptive practices.

POSTED: Tuesday, September 18, 2007

Americas Servicing Company (ASC) Wells Fargo

If you have been force insured by ASC, even though you provided them proof of active and paid private owned insurance, please notify us at velacorp1@gmail.com We are in the process of collecting the names and case information of potential jpiner parties to a major class action law suit against the ilegal forced insurance operations of America's Servicing Compamy/ Division of Wells Fargo Financial Services.
Please Contact N Velardo with a quick overview of why you think that you were force insured, if your claims have legal sufficiency we will then ask for particulars to be forwarded to attorneys.

ASC, could have AVOIDED ALL THIS ACTION IF THEY WOULD HAVE JUST EXPRESSED MAILED TO US THE PROCEEDS OF OUR INSURANCE CLAIM FOR DAMAGES. Instead they chose to steal our just claim money. Now, we will not stop until we have a major class action to stop this crooked company.
We hve obtained the assistance of the NACA the National Association of Consumer Advocates and various Senators and Congressional representatives. And we are negotiating with a major law firm that has already delivered a multimillion dollar blow to these thieves. Lets stop these animals NOW!

Wells Fargo is the worst

AUTHOR: Marie - (U.S.A.)

POSTED: Friday, June 15, 2007

I hate Wells Fargo they are stupid and don't seem to be able to get the job done in the correct manner.

We purchased a house in Sept. 2004 with Wells Fargo as the mortgage holder. Hadn't received a payment book. We knew the payment was coming due so we went into a Wells Fargo bank, had them look up the loan and made the payment on time not late. Few weeks later received phone call that payment hadn't been made. Husband talked to someone at bank and said they do see where the payment was made (our checking account was with Wells Fargo also). Instead of this person taking care of this issue he sent us a copy of the cancelled check in the mail.

Again few weeks later received another phone call stating payment hadn't been made. I drove 4 miles into town to fax the payment check and info to the bank. Thought issue was resolved. Not so, received another phone call few days later. So I drove 45 miles to the nearest Wells Fargo bank and gave them the same paper work again. The lady at the bank spoke with someone in the loan department who said they would take care of this and they do see where we made the payment on time. 2 days later the lady in the loan department called me and asked me if I could fax over the paperwork again at that time I told her I would.

When I hung up I got to thinking I had already faxed it, driven 45 miles to take the info to the bank and done everything in my power to get this issue resolved. So when the bank called the next day to say she hadn't received the latest fax I told her I wasn't going to fax or do anything anymore, that she would be hearing from our Attorney on Monday. Strange, several hours later she called and said the issue had been resolved. She gave me her direct phone number incase I ever had another problem again.

The issue did get resolved, but for it to take several weeks and my time was unacceptable.

We have since closed our bank account and sold that house and no longer have to deal with Wells Fargo.
