This is my first time doing a report like this so please bear with me. I wanted to get some feedback on an old debt that Asset Acceptance LLC and/or Allied Interstate is writing/calling me about.

First off, let me give ya'll some feedback on my situation. I made some credit mistakes when I was young ( really, but I do regret them ). These bad debts were from the early 90's and the result gave me bad credit until 5 years ago. Since then I have strived to be honest and timely when paying debts. My credit score is well into the 700's now, which is the reason I am writing this report.

I recently received 2 letters in the mail from Asset Acceptance LLC saying that they have purchased my debt from a collection agency and that I owe them money. My initial response to them was in writing letting them know one of the debts could be correct but I had serious doubt that the debt was within my state's statute of limitations (Georgia which is 7 years).

I sent responses via mail but did not certify the letter. After reading several reports on this site I have decided to resend the response desiring validation of the debt via certified letter so they cannot say that I have not responded within 30 days.

This very evening I received an automated call from Allied Interstate wanting me to call. I did not call the number, but instead looked up the company on the internet and found this site. Boy, Im glad I did.

By sending a "now certified" letter for both debt collections requesting validation and pointing out that any debt I may have is well beyond the SOL, will this stop Asset Acceptance from trying to collect from me? Will I now start receiving harrassing calls from Allied Interstate?

I do feel bad about part of the debt, because I did not pay it. The other was a bogus debt that a health club says I owe them even after I sent them a cancellation letter since my duty station wasnt close to any local branch (US Navy). I feel certain if I pay anything that I will only be hurting my credit once again. This I cannot afford and it just doesnt seem fair that my credit could be adversly affected twice for the same debt at 7 years a POP!

I would welcome any response, advice, or rebuke. Thank you for your time :)

I sent Allied Interstate a Certified, Return receipt requested also and have yet to hear from these people. By phone or by mail. It is still on the credit report though so. Send them a letter certified that you dispute the validation, and have it return receipt requested and while this is in dispute you want to cease and desist any communication except by mail. I haven't heard from these people in at least 35 days. It does work because either they will send you the information or they won't.

Danny,

Asset Acceptance and Allied Interstate are two totally separate companies. Which one is ACTUALLY taking action against you?

FYI..The SOL for open ended debt such as CC debt in GA is 4 years, and all other debt is 6 years, not 7 years as you stated.

NEVER speak with them on the phone, and NEVER put anything in writing that could validate the debt!

These debts are obviously uncollectable due to SOL.

Send the "Cease Communication" letter as per your rights under the FDCPA and you will most likely never hear from them again.

These liars and thieves, DO NOT PAY THEM. Send a Cease and Desist letter and report them to the FTC. If all else fails get an attorney.

I am also a victim of Asset Acceptance Corp and they are about to be sued by my attorney for credit slander.

I was first contacted by Shekinah Inc who was threatening to extract money from me. I was being inundated with phone calls from their so - called "legal department." stating they were taking me to court. They never did, cause they can't! First off I don't owe it, second even if I did, it's beyond the 5 yrs statute of limitations" according to the records they have in their system, so they haven't got a leg to stand on either way. My attorney sent a cease and desist letter, called the abusive collector personally and spoke to him for me and requested in writing that the documentation be sent directly to him showing that I owe the debt and that they are the sole owner of the debt - giving them authorization to collect it. Phone calls stopped immediately, but they continued to report it to my credit. It took about 60 days until my attorney threatened to sue them for credit slander and it was then removed from my credit.

I then was contacted by Asset Acceptance Corp, which apparently sold the debt to Shekinah and then bought it back. My attorney did the same thing in November with Asset Acceptance Corp, requesting proof of ownership of the debt and documentation that I owed the debt. My attorney received a reply stating that they "ordered the documentation in November". It is now February 2006 and they still haven't come up with anything. They again hit my credit in February of 2006. My attorney just sent them out a notice to either remove it from my credit or face a lawsuit for credit slander.
