September 7, 2010

Reference # XXXX- 232 Bank Of America

Ruth: Supervisor

I am writing in reference to our phone conversation on September 7, 2010. Per our conversation, you indicated that you were going to fax over a copy of the denial letter that was mail to the above mention addresses by Jason W. While the supervisor checks her records this is the common statement (system is running slow). It was also mention that she had 12 other cases that needed attention too. Well, if they took the time to take care of mine I wouldnt be on the telephone again trying to resolved this matter (third time).

September 8, 2010, never received the fax copies or a return call in reference to conversation the day before. I have now called the Housing Authority and I am requested to bring the same documents that we have fax and mail to BAC. The case worker indicated just brings everything with you at the appointment. Now, I have to take another day off for something that could have been taken care of long time ago.

This loan was original with Wilshire Credit which we hired a lawyers firm to renegotiate a modification plan which was accepted by Wilshire. We were to make the 3 payments on time as agreed, we did that their was only 1 more payment to be made under the new monthly amount given the next 2 days the loan was transfer to Bank of America February, 2010 which the modification was no longer valid. In order to begin process again we would have to hire another lawyer again we do not have monies to just give away. The above mortgage company Bank of America, instructed us to submit certain documents needed to receive assistance since the loan was sold to a different company and as of September 7, 2010 still no help has been extended to parties. The only answer received is denial.

Mr. Frazier and I made several attempts to obtain information concerning our loan and the process every week; it was a different story (we are still working on it.). We spoke with a loan processor name Jason who needed more information again we fax what was needed no return calls or mail corresponds from him. Keep in mind never received an email, phone call or letter from no one. At that time the website was changed so we were no longer able to access the account it would go to a default site why?

We tried again, in the month of May which I left work at lunch time to gather the needed documents needed again this time it was Lynn -no one gives out their last name. We stay on the phone until she was able to retrieved all needed information as usual the computer is running slow again. She asked if it would be okay to have someone return our call I said okay. I return back to work and my husband stayed around running late for his job so we would not missed the person calling. Okay, by that time the monthly payments have change from $1123.00 to $1388.71, still no documents to sign never received as promise regular or certified mail. Now we are sending the new payment amount due still no one know whats going on now. Our second payment was mail out way in advanced never credit the account. I keep asking my husband did they get the check he said they probably did just a little slow. Well, we finally call the bank this was the answer we received- (oh we do have your check it gotten torn and we need the ABA# to process.) When was anyone going to call us? If we hadnt made that call I wonder how long and what would have happen.

When the check was received by the bank there was no tear on the check. Why would she say that we wondered?

I could understand if we werent planning to stay in our home I just dont get it we have been trying to do what is needed to stay in our home. They always say contact your mortgage company first and they will work a plan or help you. What a joke! That is not true.

We received a letter on September 7, 2010 in reference to intent to accelerate. What happen did they not get the payments we had been sending? Did someone call and didnt get a live person? I spoke with Alma first, she said that the modification is going well and it look like good news then she said can you hold comes back and says that we denied assistance I told her that didnt make sense and I was not leaving the phone until I speak with a supervisor or the president of the company. Ruth, the supervisor came on and said the same thing ask for me to resubmit the same information okay how many times are we going to do this. Ruth, you mention that the letter was mail out on May 11, 2010, then my question was why wasnt we inform when we call on the 16th of May, your response we will say that. So, I said that you guys lied to us at the time. You answer yes we do that we want the customer to received the letter first.

Everyone has a bad day or year but when you have hard working people wanting to save their home(s) and the only thing you can say to them is you are not qualify that is a joke.

I know that I am not the only family going through this whether this helps my family or not, I want the world to know it might help someone else.

So I am taking it to the top T.V channels, President of the United States

(If it wasnt for him a lot of the banks would be out of business which the taxpayers saved.).

I will be contacting every community / congressman committees. I feel this is outrageous and the American people need to be heard. Its a shame that people work hard for the things that they have and have to just give them up because the system does not want to help.

I look forward to hearing from you.

Best regards,
