I would like to formally retract my statement of September 24th 2015 where I said this was false:-

My contentions with Power Places Tours are in fact true. Power Places Tours do in fact frame people for extortion

For the avoidance of doubt, our client is not responsible for any subsequent republication of the emails in the ICANN proceedings to which you refer, or in correspondence from 5RB (with whom our client has had no communication). There is nothing in the emails which supports the allegations apparently made against you in the letter from 5RB, and in the ICANN proceedings. The seriousness of those allegations — that you "victimized, harassed and extorted businesses"  and "that you were a seasoned blackmailer' [5RB's words] contrasts starkly with the mild content of the emails. The emails lend no support to the ICANN/5RB allegations.

The comment(s) made about Power Places Tours Inc set out above (as per the comment above in italics) are withdrawn in their entirety and no reliance should be placed on them. I have since discovered that the facts on which I based the comment above cannot be proven to be true. I was the complainant. I have settled my differences with Power Places Tours.  I am unable to remove reference to Power Places Tours from this particular Rip Off report, but if there were any way to do so then I would.  

This statement should NOT be taken to mean that the comments made about Marc Gruninger are false, as the evidence is clear and points to the contrary and instead this statement solely refers to Power Places Tours.

Mr Gruningers abusive postings are well documented in this report. Marc Gruninger never formally apologized for his abusive conduct,

However, I - Free Spirit can state that earlier in the year that Marc Gruninger and I came to a temporary private arrangement about the matter with him (not involving Power Places Tours).  

The differences with Marc Gruninger and myself are in the process of being settled more permanently and formally (including marking Rip Off Reports as satisfactoraily resolved)  - pending ongoing good behaviour on his part (namely that he continues to refrain from abuse, stalking and underhand monitoring activities) and a willingness to make amends for his poor conduct.

I am the husband of the person who submitted this Rip Off Report and can testify Marc Gruninger has behaved recklessly with regard to the truth as well as having stalked us and made attacks on our business reputations without good cause.

As a result, today he and his hotel (The Balance Hotel in Badenweiler) have been served with a formal claim letter for defamation, under the provisions of the Pre Action Protocol for Defamation Claims in the UK.

Re: Formal Claim Letter for Slander and Defamation as per the Pre-Action Protocol for Defamation Claims in the UK.

You should treat this letter as written to you under the pre-Action Protocol for Defamation claims under civil procedure system of this jurisdiction.

As I represent myself, I am legally obligated to set out my claims against you and give you 14 days to issue a formal response in which you can either make the amends suggested in order to resolve the dispute, or deny the claim – in which case it would be my intention to file claims for damages in the High Court for slander and defamation whilst requesting aggravated/exemplary damages from the Court due to the seriousness of the conduct shown by the Gruninger family in this matter and outlined in this letter of claim.

You should not do nothing. You are being sued.

You should seek specialist legal advice from a lawyer.

For the record - Marc Gruninger published these blogs with a malicious intent to damage my business after he did not like us writing reviews causing an estimated ball park figure loss of at least GBP 10,000 to date which can be documented to the court.

It should be noted that the public have the right to write reviews without intimidation by business owners, but in this case Marc Gruninger resorted to defamation, stalking, spying, associating with unethical companies and insulting my wife in his efforts to portray his pain and misery onto myself.

His other actions (for the record) include:-

-Making a You Tube video calling myself sick and twisted whilst hurling insults at my wife. There is proof of this as well as a sound recording of the words spoken by Mr Gruninger, should he deny the allegations in Court, this file would be presented to the Court for review.

-This video was then posted onto the Balance Hotel Facebook Business Page whilst Mr Gruninger wrote insulting and defamatory content in front of their public following.

-In my opinion, Marc Gruninger has an alcohol problem as well as issues with abusive behaviour and I would ask any Court to order a full mental health evaluation as well as access to medical reports from his doctor.

-It is also noted that there is much additional evidence of defamation, insults, lies and malicious behaviour in the form of email logs as well as testimony that Marc Gruninger has made to a third party – namely Theresa Weiss.

-Some of these claims label me as delusional, mindless, malicious, ‘a small time crook and fraudster’, a charlatan, a fraud and worse. There are many screenshots of these statements which show that Marc Gruninger has shown a reckless disregard for the truth. Marc Gruninger also admitted being emotional and not objective in some of his statements and are documented as ‘rants’ containing insulting, sarcastic and rude statements.

-Marc Gruninger also published a blog on a site run by Gregory Evans, which labelled me as a cybercriminal. He also posted videos insulting my wife across numerous Austrian run websites.

-Marc Gruninger also attempted to extort Eur 400 from us via his lawyer, in which we were threatened with court penalty of Eur 5,100 if we did not pay.

To avoid further claims for defamation Marc Gruninger and the Balance Hotel Badenweiler – within 14 days - are required to:-

1 -Remove all offending content from the internet as documented in this letter.

2 -Make a sensible offer of damages to Free Spirit for loss of income. It should be noted that money is being claimed specifically in relation to lost income due to Mr Gruninger’s behaviour and not to remove any content or review

This payment would be made as a donation to Keys to Immortality to the Paypal account (redacted for privacy) as a gesture of apology for the damage caused by the reckless making of insultative statements.

A suggested amount is GBP 5,000, which is a generous offer given that the documented damages are greater and shows that I am willing to offer compromise – something that I am legally required to do before filing formal claims with the Court.

Marc Gruninger and the Hotel Management may want to consider that exemplary damages can be for a much greater amount – along with the cost of legal fees, which I would ask the Court to order Mr Gruninger to pay.

3 - Unreservedly and sincerely apologize for the conduct mentioned in this letter. This apology will be accepted as a statement beneath any posting that cannot be removed, such as a Rip Off Report.

4 – Upon the completion of 1-3 (to Free Spirit’s satisfaction) as a separate, voluntary and additional act of goodwill – Free Spirit will remove his disclosures about Marc Gruninger from the internet and mark his complaints against the Hotel simply as ‘resolved privately’. If there are any reviews, they would be removed in the spirit of goodwill.

Free Spirit will then formally release Maria and Marc Gruninger, along with the family business Balance Hotel from any further legal liabilities in any respect. Naturally, Marc Gruninger would then agree to discontinue stalking, tracking and other questionable activities which he has been discovered doing.

There would then be a proper closure and full forgiveness on both sides.

Should the Balance Hotel and the Gruninger family find this proposal not acceptable, they are instead required to file a formal legal response, in English, and within 14 days.

Naturally you should seek specialist legal advice, but this represents a good and constructive Offer and incentive to resolve disputes out of court. The level of wrongdoing will otherwise justify a significant award of damages to compensate Free Spirit and Keys to Immortality.Com for the egregious, insulting, defamatory and malicious conduct displayed by Marc Gruninger and his mother Maria Gruninger - who is ultimately fully responsible for all claims and liabilities with regard to her hotel – regardless of her secondary role in the defamation campaign embarked on by Marc Gruninger.

For the legal record, Maria Gruninger was made aware of the concerns, given that she is the owner of the hotel and instead was noted to have responded with insults. She was also informed of her son Marc’s egegrious conduct and chose not to take action, except to threaten ‘prosecutors’ and other similar things. For the record and for the Court – it should be noted that several attempts to resolve the matter with the Gruningers informally simply resulted in further malicious defamation on behalf of Marc Gruninger, the entiriety of which is detailed above.

If you do not exhibit a constructive approach to this claim, the consequences are stark. Claims for darnages, including aggravated and exemplary damages and injunctions for libel and harassment will be brought against you in England and Wales, and enforced and registered internationally as appropriate. These claims may be filed toward the Hotel or any or all of the individuals named.

You should be under no illusions that modern English civil procedure allows for service internationally by electronic means and orders to internationally trace and freeze relevant assets including monies held in bank accounts, property and business assets owned by the Gruninger family to prevent it being dispersed prior to a damages order.

You may also be summoned to appear in the High Court in London to answer for your conduct and should you lose, significant damages (and costs) would be awarded against you for malicious defamation. The Court should also note that the Hotel is an asset owned by the Gruninger family and an asset that could be subjected to an international Court Order.

Aggravated, special and exemplary damages would also be requested given the damage inflicted upon the business of Free Spirit by the offending party Mr Marc Gruninger, and it would be shown to the Court beyond doubt that Marc’s motivation and conduct in this matter was dishonourable, respect-less, egegrious, motivated by pure malice and distaste for the work of Free Spirit. It would also be noted that Marc Gruningers conduct inflicted considerable emotional distress to the wife of Free Spirit after she was insulted and harassed by Marc Gruninger on several documented occasions.

It would also be shown that these behaviours were condoned and encouraged by the owner of the hotel - Maria Gruninger – even though she was informed by email on several occasions about the gravity of the situation she did nothing to stop the behaviour.

It should be noted that other businesses that behaved similarly, ultimately settled on very unfavourable terms – albeit privately -  in lieu of an expensive court process.
