Bank Of America, N.A. Bank Of America Stole My daughter IRS Check For $4785.00. They say that they could not give it back even tho her name was on the check but the last two numbers was not her number. therefore, they kept Phoenix, Arizona

Bank Of America, Stole My daughter IRS Check in the sum of $4785,00.
The IRS say that they, Bank Of America recived the check and cashed it.
Bank Of America admit they recived it, and my daughter name was on the check but the account number was off by two numbers, so they kept the check for themselves, because the ACH do not go by name but account numbers and they cannot refund it to her.
They say they was sorry, case close

Since the account number sent by IRS was not your daughter's number, the direct deposit should have been rejected from the account it tried to go into (since your daughter's name isn't on it) and the next business day the reject would be returned through channels to IRS' bank. IRS would then process a reissue which I understand is only done with paper check not a second attempt at a direct deposit. I would suggest contacting BOA customer service to see if they cah confirm the direct deosit info reahed them and was rejected. If so, what date was it rejected. Then recontact IRS for a reissue of her refund. Hope this helps & I hope she gets her money soon.

You need to get a lawyer to resolve these problem. Also have the lawyer get the copy of IRS check with your handwriting on back of check along how the check is deposit.
Hope this help. Bank is too strong and over power on you. That why you need lawyer.

How long is that in your state? I am sure a lot longer then 30 days.
I understand the IRS may have made a mistake with the account number..hey, it happens..but who was the check made out to?
If the check was made out to the just bank that is one thing. But if your daughters name was on the check and the bank decided to cash it and keep it without her authorization...I would think in all reasoning they stole her money, and illegally cashed an IRS check.
If there was a mistake on the check account number, why didn't the bank return it to the IRS? Just saying. A check is a legal document. You can't just cash checks and keep money that isn't yours because of an error of the account number. That is theft, and it is illegal in every state.
You might try asking the bank for a form E which is a Federal Dispute form. Regardless of how long the law says a bank has to investigate...if it was the banks fault that this was not investigated in that time and the funds returned to you in that time, they still must investigate and make good.
If that was my check they stole, I wouldn't be so quick to throw in the towel. Case is NOT closed. It hasn't been opened yet. Unless there is more to this and something was left out of the report.

When a bank makes an error on your account, you have a 30 day window to correct the problem. I suspect the 30 day window has come and gone.
when a account holder makes an error, there is no time limit that the bank will have in order to correct your mistake, (or their mistake).
I would not be surprised if the bank goes in and removes the tax refund from that person's account, and just keeps the money. Because they will not credit that money to your account because the 30 day window has expired.
suing will do no good, because legally the bank is following the law. It sucks, I know

For that kind of money you better see a lawyer or take the case to small claims court in a hurry. Of course the check was deposited into whatever account your daughter gave, that is how it works. But if it is a legitimate error you will get your money back. The person's whose account the check was deposited is immaterial, it is not their money. But do this fast.
