I've just had yet another ripoff situation with another bank. This time it was Bank of America. When I was in a predicament last time when I knew there would be fees because something hit my account before I thought it would, I was specifically told that the items are posted to the account IN THE ORDER THEY ARE RECEIVED. However, the most recent situation did not follow those guidelines. This time, I had enough money to cover three items that were already on the account as "pending", so I wasn't worried. The next day, I checked my account online as I do every day, and I was over $300 overdrawn! A large check had come through along with the three pending items (totaling just over $40), and they posted the check FIRST. When I called, they said their policy was to post the largest amount before the others. This means they CHANGE their policy to each situation, assuring that they will collect the largest amount of fees possible. I've decided NOT to correct this account, and couldn't afford to if I wanted to. I AM SICK OF THIS. And I will gladly join any Class Action suit regarding this problem.

What ever is writen in the account terms and conditions are what governs your account. Those are your guidelines.

There is probably a sectioin in there that basically states BofA can process debits and credits in any way they chose.

It is rare to find a bank that doesn't post largest to smallest.

You made a wrong assumption. Did you speak to the bank to try to get any of the fees refunded? You may not get them all back but you may get some.

If you don't intend to pay what you owe, you had better open an account with another bank now. Leaving this unattended can cause problems when you try to open future accounts with other banks.
