I am writing this eventohugh this happened years ago but I am still faced with the results today, bank of america allowed a check to be deposited into my account via atm, it was then held and cleared by the bank. i never realized it myself because my pay checks were deposited into the same account and i know i didnt make any deposits via atm, i knew my job owed me some back pay so when i saw the money in my account i assumed thats what it was, so i took the majority of the money in my account and purchased everything my daughter needed and had asked for as i had planned on doing anyway,

about a week later bank of america hits my account with a charge saying a check or money order i dont remeber which one was deposited to my account and has turnned out to be a fake, i asked ok if this was the cse why and how did you clear this and second why was i not informed something had been deposited like that anyway. i thought the bank monitors strange activity, so of course they would not take the charges off, the filed a law suite against me got the fees and crap up to over 3,000. dollars and tried to garnish my wages, sadly this mess is still showing as a judgment and on my credit , I was not living in the area when they filed suite a year later so i didnt receive court papers and of course judgment was granted, straight rip off and out for blood. when it was nations military banking at one time, they managed to lose my direct deposit military pay which had been going in my account every 1st and 15th as the military does they ended up depositing it into someone else account and took months to give me my money back go figer

I closed an account with BOA years ago because of their crazy fees. They charged me $35.00 because a purchase went over the current balance by two cents. I was not from the area where I made the purchase and did not realize I would be taxed for food items. I tried to make an immediate deposit but there was not an ATM that would accept deposits in the area - only withdrawals. When I called to report this I was told I would have to drive over a hundred miles into a neighboring state to make a deposit. I thought their refusal to reverse the charge was unreasonable and decided to close the account. I wanted to do it immediately but would have had to make the drive to do that as well. BOA is notorious for excessive fees and hardball banking so I wouldn't deal with them again anyway.

At the time this happened I held an account with them for over twenty years. I was with them since they were called BayBank, then Bank of Boston, and then it was something else I think. I can't remember. I just know that I was a good customer who never had any overdrafts or any other problems with my account. I guess they just weren't making enough money off of me so they decided that I wasn't that important afterall. I'll never do business with them again.

I understand what you are saying. I just recently left a job because they weren't paying me on time and made excuses every pay period that went by. My last paycheck was deposited on Monday 9/16 and it's showing that all of it is available. I just got a text message from their accountant saying that another deposit was made to correct a "bank error". I immediately called the bank and was told that I would have to pay a returned item fee if any of the checks deposited were not honored. I think that is outrageous. Why should I be held responsible for someone else's fraudulent activity? As soon as it is all straightened out I will close that account. There is obviously something shady going on with the company I worked for and I don't trust them with my information. I'll have to fight it out with them if I am charged any fees on their bogus checks - and believe me, I will. I'm tired of being ripped off.

No one really knows what happened in your situation except you. The only advice I can offer is to track down the depositor and sue them for any fees and negative reports against your account. That's exactly what I plan to do.

Just not very well.  Let's compare your posts shall we.

I don't know about anyone else but that sure makes it sound like you withdrew it.

So you are going to come here and state that the amount deposited was exactly the same amount of money that the job was going to deposit?  That's a pretty good coincidence or a pretty good lie on your part wouldn't you say?

funny how every other bank i have had and have now anytime i do have to purchase a more expensive product i get a phone call to verify i am actually doing so as i do not normally make large withdrawls or purchases.
- This was a DEPOSIT, no bank is going to call you when you have a deposit.  Especially when it was done by an ATM where you must have the card and PIN.  Without you reporting any lost/stolen card there is no reason to suspect fraud.  And even if they did call you about the withdraws..those were valid withdraws because you admitted you made them to pay for things for your daughter.

It sure sounds like you said your job deposited by the ATM.

Other things that are not in your favor..if someone did a fraudulent deposit to your ATM..how come you didn't report any other fraudulent activity?

By the way..the "you must be an employee" is Standard Operating Procedure when someone posts who does not agree with you.  So sorry to tell you that I do not, nor have I ever worked for any bank.

So this is what I get - you spent money that was not yours so now you blame the bank for wanting that money back.  I agree with Robert - how did this "fraudster" get your ATM card and pin??? Makes not a bit of sense.  Do you not keep a check register of your debits/credits?

Because you spell like a second grader I have a hard believing your report.

A few points I left out, I never said I withdrew anything a few days later nor did I say my job made an atm deposit, and so you have your facts I was aware of how much money my job was going to deposit, as for the exact date of it no i did not know but again as stated i had no idea it was supposedly and atm deposit as I said I never deposit anything via atm never out of all the years i have had bank accounts so yes it should have been seen as strange, funny how every other bank i have had and have now anytime i do have to purchase a more expensive product i get a phone call to verify i am actually doing so as i do not normally make large withdrawls or purchases. never have if i need a large sum of money i go to the bank in person and get the money for whatever it is for always have done so. i also said that by the time they finished adding fees it was over 3000.00, but when was that a huge sum of cash anyway ? it was not that amount in the first place just so you know it was less than that. again know your facts before making assumptions and take this report for what it is, a report of an experience of a person.

First of all I did not know it was deposited by atm until after they put fees into my account to make that clear, as I said I assumed the money in my account was from my job at the time, second I had never deposited any checks via atm and to this date still never do as I very rarely get a check anyway the majority of the time any money i get is deposited into my account via direct deposit. y=you seem to be an supporter of this bank or possibly an employee, I am letting people know about the pratices of this bank and what i personally went threw, including when i was in the military, by all means if you enjoy banking with them continue , but dont assume you know facts of what i went threw , i have no reason to lie about anything but i will speak out when i am done wrongly by a bank, business, or a person. so before making your sarcastic remarks when someone voices what happens to them know the facts or stay out of it of course again unless your an employee of the bank then of course you will try to defend or justify the actions, i have many letters in my records of disputing this from the start , but im sorry if i dont have the time or felt like spending even more money than i was already out to get into a long drawn out legal battle with them, i have something more important to be concerned about my family. my report is to make aware of the practices this bank has done to me personally and my experience alone . thank you for your comments but no thank you for your assuming you know anything about the situation.

So let's see here.  You never deposit checks by ATM.  Yet you somehow "assumed" that it must have been your job who deposited the check into an ATM for your back pay.  Well if that was the case..can you please explain how they got your ATM card and PIN to do that without you knowing?

- Well first they made the funds available per the Expedited Funds Availability Act which is the regulations they MUST follow.   It does not mean that the check could still not come back as bad.   And second..what do you mean you weren't informed?  You not only saw the deposit on the account...you withdrew the money.

Also, didn't you find it strange that your job didn't notify you that they were depositing a huge sum of money?

- Umm...sorry to tell you but an ATM deposit is NOT strange activity..especially when within a few days of it being deposited YOU withdraw the money.

- This may be your only reprieve..but a temporary one at best.  If you can prove that you were not properly served you can file a motion to have the judgment vacated.  If that happens the Garnishments go away.  But it is often only a temporary situation, as they then can re-sue you and start the process all over again..the only difference is that you would then know to go to court and try to explain to the judge your assumption that it was back pay and how your work got hold of your ATM and PIN to deposit this back pay.
