I had a Nutrisystem auto shipping plan which costs about $340.00 per installment. I had it set up for next delivery on November 30,2009 and by some mistake they charged my card on November 1st and shipped on the 3rd.


I called on the second to have them cancel the shipment to no avail but that is another story for another post.

The point is that my account got over drafted, but at the same time not really. As I understand it, for me to overdraft the bank would have actually had to extend a "credit" line to cover the balance that was not available.

The point here is that the $340.00 charge hit my account by the ETF system of Nutrisystem but money was never transferred since I cancelled my Nutrisystem account as soon as I saw the problem.

Ergo, the overdraft which would have otherwise originated a myriad of other overdrafts for stuff as simple as a $2.00 cup of coffee never happened.

Even so, due to the creative accounting that is allowed to banks by law makers and our government, Bank of America paid itself 10 times overdraft fees. This is $350.00 and of course my bank account is now negative -$125.00

So, not only did the predatory creative accounting of BOA did what we are all to familiar with and our congress refuses to fix (but it is quick to hand over 700 billion of our money to them) but also BOA is stealing from me since like I said before, the overdraft actually never happened.

Do I think this will get resolved? 

Probably not until we Americans decided to stop this nonsense and send a clear message to the Banking institutions and our government.

How? 

1) Forget banks... use cash Pay your bills through the mail, use a credit union for your deposits. You want a real way to stimulate the economy? There you have it... real and hard cold time honored cash is the first step.

2) Demand, loud and clear to our governors and policy makers to make a change today or elect someone else.

$350.00 dollars is a nurse salary for an entire day of work.
It is a month's supply of food for a family of 3.
It is a little less than a semester gas budget for a small vehicle.
The cost of all the text books for a class (another rip off)
8 community college credit hours
More than a week of labor for a minimal wage worker.
A round trip plane ticket to almost anywhere in continental USA.

Bank of America among several other banks are facing pending lawsuits and pressure from congress due to all the complaints. Too little too late perhaps..but it is a start...here are the changes BofA has already deciding to do in their own...

 Bank of America will eliminate fees for customers if overdrafts are less than $10 within one day. BOA will also collect no more than four items of overdraft per day (previously it was 10 items per day). Bank of America, JPMorgan Chase, U.S. Bank and Wells Fargo said they would no longer automatically enroll customers for overdraft protection.

If you were opted out of courtesy overdraft protection..once the bank knew about the $340.00 Nutrisystem payment..the 35 dollar coffees would not have been possible..since the transaction would have been declined at point of sale..giving you the fair chance to determine why the account is drained..and eliminating the possibilities for all those fees to occur. Something to consider to prevent this from happening in the future..I think it is a fair policy change, I have opted out and I feel my account is actually better "protected" now.

My question for you is.. did Nutrisystem refund the charge? Because if so...this could be considered an admission that they were not authorized to charge you in the first place. The bank of course could care less..they just want their fees..not happy customers. But in a case like this they HAVE to assist their customer..since THEY were the ones who used your funds to pay an unauthorized transaction..

Now if Nutrisystem did not refund the payment..you still may have grounds to get the fees returned..but it may be more difficult or impossible if nutrisystem has proof the transaction was pre authorized..but do what you have to do, worth a shot. It seems by your post the transaction was authorized..but was billed and shipped out at a much earlier date then it was supposed to be. You write it was a "mistake" on their part..so why should YOU pay the fees? You did nothing wrong. Let the bank go collect the fees from Nutrisystem if they need them so badly. Sure it may not be the banks fault that Nutrisystem made a mistake..but why should they punish you for it? That is not the way I would expect a bank..a supposedly "safe" place to keep our money..to behave.

Here is some advice on what you can do by the founder or this website. If it applies to your in this case I would by all means take the appropriate actions...

HERE IS WHAT RIP-OFF REPORT SUGGESTS YOU DO: Go to your bank within 60 days of the charge, or as soon as you know about the charge, don't delay, and tell them that there has been fraudulent activity within your account. Explain that you wish to file a dispute, and demand that they assist you in accordance with Federal Regulation E. According to the majority of victims interviewed by Rip-off Report, those who immediately called their banks to dispute the charges did not get very far. Many victims got the following responses from their banks: we could not do anything for you or you waited too long; it has been more than 60 days. If the bank is says that you have waited too long, explain to them how you called their 800 number as soon as the charges were found, and were told by the bank that nothing could be done. Remind the bank that they failed to assist you properly at the 800 #, and instead, provided you with an inadequate explanation of your right to dispute. Tell the bank that it's their fault time has expired, and since they gave you the wrong info to begin with, they will just have to deal with it, take the loss and reverse the charges. Tell them the truth; this was unauthorized and your account was NOT to be charged! Keep emphasizing how you never authorized anything! Direct them to the hundreds of victims reports that were filed on Rip-off Report.com. And if you're at the bank, walk them over to their computer and make them go to this site! If you are on the phone with them, tell them you will wait while they access this site! Either way, be persistent! DO NOT TAKE NO FOR AN ANSWER! Let them know nicely, that you were advised to Report them (the Bank) and this situation to the Banking Commission in your state. Since each state has a different name for the agency/controller over banks, find that name before you call or get to the bank so you can throw it in their face. The more knowledgeable you appear to be, the further you will get. And just continue to demand the Federal Regulation E form! The bank CAN, MUST and WILL reverse the charge! But, you must be persistent; ask to speak to the supervisor or the area manager for all the branches in the state. Let the bank personnel know you are meeting with the media later in the day, that you would much rather they do the right thing (as most other banks have) by looking at the complaints and immediately reversing the charge(s) to your account; no matter how long ago it was. Be sure to call the Media if necessary so you are telling the truth. If you have to, be loud (but nice) in front of other customers. If you are just calling by phone, the above tactics should still work. The bank can easily fax or mail to you the Federal Regulation E dispute form. CHARGES TO YOUR CREDIT CARD If the charge was to your credit card (not debit card, check card, or checking account), contact the credit card company as soon as possible to request a dispute form. Consumers usually have a little longer to dispute fraudulent credit card charges (up to 6 months), but it is better to act right away. In this type of situation, credit card disputes are usually successful since fraudulent companies often won't contest the disputed charge. In rare cases, credit card companies will review disputes, but refuse to reverse the charges. If this occurs, complain to a manager and let them know you will be filing a report here. Remember Don't let them get away with it! Make sure they make the Rip-off Report .. if you 'Google' this- THE WARNING: FRONTLINE PBS, you will be able to see, & hear for yourself from an expert (Brooksley Born) that the banks made investments in DERIVATIVES & CREDIT DEFAULT SWAPS, correct?


And many of the MORTGAGES that were sold in America & in Europe are a big part of what fueled the sale of those derivatives & credit default swaps, right? We all know that FORECLOSURES are happening at a faster rate now than ever before, correct? A CNNMoney.com article reported that there were over 900,000 foreclosures in July, August, & September, just a few weeks ago, didn't it?

So, to protect yourself, it would make sense to open an account with a Credit Union in your town where you could drive into that parking lot and then walk into that Credit Union and talk to someone in charge if your money is lost; like Jim Waldorf's $100,000 CD that he took out for his grandchildren's college education, correct? Jim took out that $100,000 CD for his grandchildren's college education with Wells Fargo, didn't he? And we all know that Wells Fargo is a Publicly Held bank, just like Bank of America, Chase, & others, right?

And we all know that many of these Publicly Held banks were taking out 'SECRET LIFE INSURANCE POLICIES' on their own employees, without their knowledge or consent, right? Anyone can 'Google' this- BANK EXECUTIVES PROFITING ON THE DEATH OF EMPLOYEES, and read that article, can't they? 

And anyone can 'Google' this- BANK OF AMERICA COMPLAINTS SECRET LIFE INSURANCE POLICIES, and read that article too, correct?

So, simply cancel EVERY ACCOUNT (checking, savings, IRA, CD, etc.) that you have at any Publicly Held bank in the USA. You can also cash-in your Retirement Accounts, your 401K's, your IRA's, your stocks, etc., because we all know that 90% of American's Retirement Accounts are invested in the stock market, right?

And we now know that the stock market is a COMPLETE LIE; a PONZI SCHEME; set-up to DEFRAUD innocent Americans & innocent people all over the world out of their hard-earned money, don't we? We know this because a Harvard Business Professor said that to a class of executives in late 2004, right?
