I have a personal, business and merchant account with Bank of America. My complaint is that this bank is capturing overdraft fees by debiting amounts that are larger first then each smaller subsequent amount is debited. This ultimately leads to further fees that otherwise would not have been charged.

Example. If your balance was 250.00 and the following day you have several checks or transactions debited from your account, the bank's rational is that they would debit the 251.00 first thus leaving you with an overdraft of -1.00 then each transaction afterward say for 10.00 25.00 17.00 15.00 would all incur overdraft fees. This total of charges amounts to 67.00 if you add the 29.00 fee for each transaction, it totals 212.00. 145.00 in fees.

Were the bank to pay all of the other charges or debits first, they would only make one fee of 29.00. They assume that you want your larger items paid first. This is just a way for them to make more money on otherwise problematic accounts furthering their financial difficulties. This is truly a rip off. I would like to do whatever is necessary to make them change this process to benefit the consumer, not their bottom line.

the point is.. they should not mannipulate your money

The point is that putting transactions in this order that they charge not one $29 but 5 times of $29 for rediculus amounts. Yes you are right it's better to make sure you have enough money on your account, but they should not mannipulate your money anyways!!!

I am not an employee of Bank of America or any other bank ... I just watch my money carefully and never spend more than my check register says I have.

It's unreasonable to spend more than you register says you have and then complain that the bank is assessing NSF fees. The order they post items in does not matter if you make sure that you have enough in your account to cover ALL transactions.

As for the order of posting, go back and read your Deposit Agreement. That agreement, which all customers agree to when they open an account, says that the bank may post items in any order they wish. You should always read all materials that the bank gives you when you open the account.

Take action...file an Attorney General Complaint

Let's spread the word that every account holder who feels this way needs to file an Attorney General Complaint. I never agreed to, or had any policy in writing to say that posting by amount rather than date / time was okay, acceptable. They changed this at their leisure to rip us off and earn unscrupulous fees.

Complain to your AG and let's see if we can get a class action complaint started!

b of a is a scam... bank manager yelled at me

how about a response thats not from a bank employee! I had bank of america and ran into the same problem. I went to talk to the bank manager about the issue. I discussed the matter in the middle of the bank and he yelled at me like it was my fault that they tagged me for six things after i ran out of money. i know that was my fault, but not that last three they could have rejected the debit card. I got nothing resolved.

I decided to change banks, mainly because of him yelling at me in the middle of the bank, very unprofessional. i left the account open so i could recieve me direct deposit while my employer switched it. I left exactly $1 in the account.

My gym i go to didnt not change my eft and they charged that account. By this time their had only been $1 for over a week and they still let it go thru and charged my $29. they said they didnt want me to be embarrased about not having it go thru. Are you kidding? IM only embarrased that you stole my 29 dollars again!!!

The real issue is not only that they chose the order that helps them but that they will cover any amount to make 29 bucks. all while acting like they did you a favor! I left behind my 10 years with bofa and took three account with me.

Compass has been great. they even have called me personally to left me know they had to hold a out of state check so i would not get into any trouble with my account.

If you had the money in the account for all the items you were spending you would not be complaining about the overdrafts... banks do offer overdraft protection you know !

Complaints about NSF Fees

I completely agree that Bank of America and other banks post items from largest amount to smallest amount to maximize NSF fee income, which is a very lucrative source of income to a bank. Banks will tell you that they post things in this manner so that the most important checks will clear (rent, car payments, etc.), however, I DO NOT buy this argument.

However, having said all of that, it is the CUSTOMER'S responsibility to make sure that there is enough money in the account to cover ALL ITEMS. If you make sure that you have enough money to cover ALL checks issued, then it DOES NOT MATTER what order the bank posts checks in.

For example, if you have a balance of $250 and have written 5 checks for $100, $20, $15, $25, and $10, then ALL CHECKS WILL CLEAR, regardless of the order in which they are posted. It comes down to not spending money you don't have.

I know all about not having enough money to pay certain things ... been there, done that. I have had to live from paycheck to paycheck in the past. However, I have worked to get myself out of that situation. I realize that this may not be possible for everyone, however, spending more than you have and then blaming the bank is not the answer. When I was living paycheck to paycheck, yes I did have checks bounce. However, I realized that it was MY fault for spending more than I had in the account. I may have asked for a courtesy refund or two over the years, but I didn't blame the bank.

This practice of posting items from largest to smallest is not going to change, regardless of how many complaints and lawsuits there are.

This comment is not meant to put anyone down, just to help.
