In January 2005 I opend up a checking and money market account, Net bank alows only online business, with my iving in Texas, and they being in Georgia my onlu access was online or by phone; which i attempted daily with no success.

By February I became aware of visa check cards missing and tried to report it to them, to no avail. I bega receiving ugly letters regarding my accounts, I deligently worked to contact netbanks custmer service and became ware of unauthoried "pay day loans" being taken out in my name and deposited in my accounts then withrawn using the lost cards.

This went on until this May 2005, The police department near my home contacted the bank making them aware that they had found my cards (2) I am still missing (1) In a letter written to me by net bank they accuse me of taking out these loans and withrawing the money.

Now, let me ask you; if the police found the cards n someone else, how then did I withdraw the money? right, I didnt and I have emails dated back to Feb 2005 begging them to close the accounts, have they? no.

To top that off they are ruining my credit by not accepting resposibility for allowing someone to impersonate me. I have creditore badgering me for money that I am not even aware of. What does the bank do?

Ignore me, they want you to trust them, now I know why, so you can become a victom of identity theft and they make the interest off the the charges they have applied to your accout.

I recently pulled up their BBrecord which describes them as very unsatisfactory, wish I would havwe been wise then as I am now. This bank is borderline extortionist, and they prey on those that still believe in some goodness in the world, unfortunately I now trust nothing ecspecially if they make money off others misfortune.

I am now out at least a thousand dollars, and banking credit thanks to netbank's negligence. i hope they get exactly what they give which is pain and suffering to their customers.

Buying a schredder was one of the smarter things I have done. As for the pin and the cards I am looking into sme things on my own that I recently fund out about a previous neighbor wo has a warrant out for fraud, so, we'll see what happens. I still upsets me to think that the bank blames me, ya know if I would have done this to myself I wouldn't draw attention to the matter, or file reports etc. I think that bothers me worse than anything, do you understand that? As for the credit beureaus, I was asked to fax the reports to them so I did, but I was never told that they would keep the alert on longer than 90 days. I am a law student, and I bust my tail to make ends meet, so when I feel I have been wronged I feel I, just as everyone does; have the right to voice my opinion, and feel violated. I do know this I will never bank online again. I have read many complaints about most of the online banks, as well as BBB and it doesn't look to promiseing for the future. My life as changed so much because of this and the stress it has caused, along with the fear of my credit being ruined. I have decided to let it go and take the loss, I am only one person, I haven't the resurces that NetBank does. I don't knw how they got the cards but apparently they confiscated alot of them, and yet there wasn't an arrest s I don't know, as I said before; I know what I knw and that is all I know. I Lost all I had. Lets give a hand to the criminals and teh corps that let it happen. still my feelings. I have got that right I know.

The cards and PIN are mailed to you under separate cover for obvious security reasons. It's HIGHLY unlikely that someone is able to steal cards AND PINs from an account that was opened legitimately.

As for the cards that were "taken", were they stolen from you, from your mail box, home invasion

And no, you wouldn't necessarily know who took them if you knew how the police got them. Were the suspects already under investigation and your information was included? Was it a traffic stop and they found your stuff in the car? Was the house raided and they found it. The police aren't going to tell you everything (names, address, etc of suspects), but they should be able to tell you how they obtained plastic and account information in your name (unless the investigation is still ongoing and divulging that information would compromise it.)

Properly filed fraud warnings stay on credit reports longer than 90 days. In most cases, several years. You can have one placed immediately by filing a telephone report. Those DO expire in 90 days. You need to follow that up with a written complaint and a police report to each of the major bureaus along with a notice to ChexSystems (www.chexhelp.com).

You have quite a fight on your hands. Having both your PIN and your Cards compromised is unlikely. It usually means the consumer was negligent in protecting the information and that makes them liable. It's not just NetBank... any bank will hold the customer liable for it. Shred your checks when you throw them away. Cut your cards in several pieces. Never keep your PIN with your card. Always sign the back. And most importantly, play by the rules, file your disputes timely and completely.

In answer to your question; yes all affidavits have been filed, police report was filed, some cards never arrived and two wer taken, by whom? I don't know, the police still have them, and I have spoken to the officer twice (officer Duncan) "how did they find them?" If I knew that then I would probably know who took them, don't you think? Maybe your commerce with netbank went unaffected, and thats great. I know what I know, I know how I have been treated, I know I did nothing wrong, and I know I did not make ATM withdraws on those cards; This I Know. So, as for protection against such activity, I have alerts on everything, but the thing is, it haults the offenders for 90 days, when that 90days is up; Then what, I know people this has happemd to; 8 yrs ago, they still struggle to get back on their feet, so I caught mine early but that doesn't make it much easier after all, it still happend, NOW WHAT???

This is exactly what happens when a good identity theif gets YOUR information. This is what happens when a bank or credit card doesn't detect the fraud. This is what happens if they don't investigate. Is this what you want to happen to you? What's worse... sending in a couple pieces of paper and maybe having to pay for things on your credit cards for a couple of days while they get it straightened out, or having your credit ruined? And along with that comes "risk-based pricing" when you buy a car, when your credit cards pull your credit report periodically too see if you have earned a credit line increase, and the worst time to find out is when you TRY buy a house.

Now Bonnie, let me see if I can help you.

First, don't assume that NetBank advocates Identity Theft. They don't. They're ultimately on the hook for the money that is lost.

Second, some questions:
1- How were the cards compromised? Did you not get them or were they stolen? How long do you think they were missing?

2- What kinds of transactions were on the account? Cash withdrawals from ATMs or face-to-face transactions at a teller? If they were ATM transactions, how did they get your PIN? If you wrote your PIN on the card or kept it in the same place, you are considered negligent and owe the money.

3- HOW did the police suddenly find your cards? How did they know where to look? Was this a family member?

4- Have you completed the necessary affidavits of fraud yet?

5- Why didn't you monitor the account activity online? You could have detected the fraud on day one and had them block the account from further activity.

To speak to your other comments:
* NetBank doesn't make "interest" on charges. This is not a credit card. They make money on POSITIVE balances in accounts. Negative balances cost them money.

* Most of those complaints are from people that had their accounts on hold because NetBank didn't want what has happened to you to happen to them. You just can't win with some people.

* They're extorting nothing. They are probably mid-investigation and more information is forthcoming.

Finally, here are some action items:

- Complete and return every form they ask of you.
- Keep copies of everything for your records.

- Create a "form" letter you can send to anyone demanding payment for fraudulent sales and always attach a copy of the police report and Affidavit of Fraud as well. You may want to block all but the last 4 digits of your SSN if it's on there.

- File a consumer statement with ChexSystems.
- Place a fraud warning statement on your Credit Report.

*** Stop it before it continues to grow and do more damage. ***
