I wish to submit a rip off report regarding the negative option scam that Berkeley Premium Nutraceuticals has going. The website does indicate that unless you cancel you will be shipped a new 60 cycle about 5 days before your current cycle runs out. There were about two weeks left before the cycle ran out.

There were about two weeks left before the cycle ran out when on 8/5/2004 I cancelled and got a confirmation number (#323836). On the advice of the website I did print my confirmation.

On 8/7/2004 a $70 charge was made to my card for the next 60 day cycle. That day I called and faxed my confirmation number to (614) 413-3505. I received a faxed transmission ok report indicating that they did receive my fax. Of course, today is 8/16/2004 and no product has arrived (not that I want it anyway) nor I have I received my $70 back.

I am having a difficult time with them and am still working on getting my money back. I spoke with Jim today at extention 5603, He is the shift manager there. I tried to get a manager last week but according to the girl (I didn't get her name, nto that I could understand her much anyway) there was no manager available. I will be going to my bank next and submitting a form for an unauthorized charge. I have proof that the "managed care program" was cancelled.

I am submitting a complaint to the the AG's office in Maine as there is a law that indicates they have to give 15 days notice before the account is charged. I want to make others aware of this company and it's unclear approach to charging consumers a great deal in advance of when they say they are going to.

After 7 weeks of trying to obtain a complete refund of my $70, it actually happened. I was not going to give up on this. I work too hard for my money to have someone just take it from me.

The day they told me I would only be getting half, I decided that was not acceptable and submitted a complaint to my own State's Attorney General, The Ohio State Attorney General and even the Better Business Bureau. I indicated the only acceptable resolution was to receive a complete refund. It must have worked because I got a complete refund of my money.

My advice, don't roll over and say well at least I got half. It's better than nothing. It's barely better than nothing. It's your money fight hard for the money you earned. Especially if you know you followed their stupid rules and actually read their lies like I did.
