We refinanced our house in Dec. 2007 and got stuck in a Pick-a-Payment loan. A loan audit shows many violatins of TILA. A certified letter was send to Wachovia/Wells Fargo and they never responded, another violation. FTC was made aware of this and they never did anything. In Feb. 2011 we contacted Wachovia for loan mod and we were told they could not talk to us because for legal reasons. Really. Unbeknown to us 26 attornies had filed a class action law suit on behalf of 51900 people. Judge Jeremy Fogel awarded them millions and we got a whopping $178.00 (we never cashed). That was outrageous, what an insult. Berns & Weiss LLP sent us a letter that they were lead attorneys in the law suit and would try and help us, because we were never contacted by the banks who now were supposed to help us according to the law. The attornies kept us dangling for a year. We had sent them info that we had been denied the modification. It took three months before they noticed that the request was in 2010.  Every week a new legal aid "was taking care off" our case. Sounds hopefull doesn't it. 26 attornies now having to represent 51900 people. Clearly they would have to find out a way to get out of that commitment and they did. Even though every one knew in 2011 and 2012 that no loan mods were given, and we had been told to not contact the banks..... they now request documentation that we asked for a loan mod again in those years. Confused.... yes so am I. To do or not to do, that's the question! Yesterday we went to Wells Fargo, in short; asked about loan mod and made her aware of law suit. I told her we wanted written communication only, she said no written contact, only by phone (therefore no trace of anything). The woman said that the case was closed because the attornies won and Wells Fargo did not have to do anything. Is this like saying a killer goes to court and found guilty. Case closed. Does not have to go to prison. Three years of sheer agony, mentally, emotionally and it has taken a physical toll on me. I contacted Obama, Shwarzenegger, Mary Bono, Benoit, Steve Pougnet and  Attorney General Kamala Harris and nothing was done. What does this tell you... there is no justice, the court system does not work and attornies are able to collect millions off of our suffering. First we were raped by the banks and now by the group of attornies. United we stand..... not.
