My first experience modeling was not all it was cracked up to be, thanks to a deviant photographer, Bill Schwanke. I was working with a company, Continental XO, who had decided a website was the best way to 'get my name out' and they used Bill Schwanke as the photographer. Now, I must admit that I should have done a little bit of a background check on Mr. Schwanke before trusting him to take pictures of me. The website was in no way aimed at perverts or their perverted fantasies...no offense perverts:)....Newayz, of course when a photographer photographs people, there is a 'Waiver' or 'Release' form. This is to ensure that no one takes the rights to his pictures, basically no one can claim that they took these pictures. In Mr. Schwanke's waiver/release, the last line states something close to, these pictures will not be used in a demeaning or pornographic context. So, with that, I signed. Little did I know, I signed away my body.

During the photo shoot, I was told to take 'practice shots' just for him to get a good focus. Pictures were taken without my knowledge while preparing for a pose. Such as, bending over to adjust my shoe, or if one of my breasts came out of my top while trying to achieve a pose while laying down, Mr. Schwanke made sure that a second didn't go by without a snap.

To make a long story short, the website was headed in a different direction when other girls were added that were willing to take off more. The website was cancelled. But oh, come to find out, this was not the end of it. Remember when I said he took pictures without my knowledge of them being taken? Mr. Bill Schwanke sold those pictures to 3 (that I know of) other pornographic websites and filed me under false names.

The way I found out about it was awful! I received an email from one of the websites. In the subject line was my middle name, it was eerie because no one calls me by my middle name except for my deceased aunt. I opened the email and this website, thickmodelspot.com, was telling me how much they loved the pictures and they wanted more for their site. They include a link to 'my profile'. I clicked on the link and there's a big a*s picture of me that I had never seen. They also had a smaller picture of me holding my breasts with a flash of my left nipple, making it obvious that that was not the intention of the shot. The profile was under my middle name, different city, a different age (younger, I suppose making me more appealing to the perverts), and a provocative statement next to the profile, somthing along the lines of: "We can't wait to see more of that p***y, and she's so thick, stop drooling guys" I cried, cried, cried, and cried some more. I sent the website a simple email requesting that they remove these pictures, and that I had no idea that they had these. I received a very rude response, something along the lines of, "at least we aren't promoting you like some of the other sites with hard core porn". That's when the sent me link to the other sites, with girls posing nude, which I was not, on xxtremecurves.com and playbbw.com...then of course, I cried again.

After doing alot of calling around, I got in touch will Bill Schwanke. He told me that he sold those pictures to the websites and that models have to be prepared for things like that. He also stated, I should stop being sensitive about my body and that by signing his waiver he's entitled to do whatever the hell he wants to. When I first met Bill Schwanke, he came off as a very nice guy who had a unique interest in the beauty of fashion photography.

At this point I feel like a piece of property that was sold off. No one had told me anything, people are able to see me without my consent, and they're making money off of it. I don't want a dime from it, because those were not my intentions of taking the pictures in the first place. I just want my pictures off of these sites as soon as possible and I want people, especially young women, to know about Bill Schwanke and other photographers that are looking to make a quick buck off of someone else's body.

Good on ya Bill for the response. I think that consumers will be on your side in this one.

Readers of this post should be wary of the nature of this woman's complaints, basically that she wants to be a provocative paid model but she did not understand that the agreement she made turned out to profit other parties more than she. This is not a scam, she just did not take the time to understand what she is agreeing to. If you want to evolve from amateur to paid, watch your money..

I love the statement she made -"No one had told me anything, people are able to see me without my consent, and they're making money off of it. Joi is not a victim, she is just naive.

I was hired to photographer Joi and several other models by ContinentalXO to promote their business and make websites for the models. They were a start up company and entered into an agreement to shoot on a TFP basis. This is common in the industry where the photographer retains the rights to license the photographs in return for shooting for free.

They could not afford my normal fee. This was my compensation and the only reason I travelled to their location and worked for 2 days. They did 2 other shoots for models where I was paid and they retained the rights to those pictures (their client paid for these shoots). I beleived the models were fully aware of this and Joi even signed her release form (my company's release)in front of me and I photographed her ID. She was to receive promotion and a website from Continental with the promise of making lots of money.

She did get some promotion in the form of flyers promoting events featuring her (using my photography)The failure of her website was her agent's responsibility. I am furious with them for not explaining things (apparantly) and not taking responsibility.

There were no trick pictures. The photography was under the direction of Continental. They received all the pics and presented them all to the model. I don't trick my models into poses, this is a ridiculous statement. I have been in business for years with a very good reputation and almost all work comming from referrals.

The last lines of my release forms read as follows "I waive any claim that I may have for alleged violation of privacy, defamation or libel by the use of such photographs.
I hereby represent that I am over the age of 18 and have read the authorization and release prior to it's execution. Underpenalty of perjury, I swear that each of the identification documents that I provided was lawfully obtained by me and has not been forged or altered. Further, I have not been induced to sign this authorization and release, other than by the recited considerations, by any representation or statement made by the photographer, his agent, or anyone acting on his behalf." Joi, why are you making false statements? I know you are unhappy but this just makes you look bad. You should be mad at your agent.

Maybe if they made the website a success then the other sites with your pics would help promote your site and earnings. This was the intent. When a site contacted you they wanted to offer you a job doing similar modelling (clothes on)for $1000. as a start. Itried to help you with this when you called me.

I have treated you with the utmost respect from the first day. When you called me with your complaint I explained the exact agreement that we had and was furious with Continental especially because I haven't heard from them in a year after they didn't pay me for the last shoot I did. Those pics were never used because we didn't have a TFP agreement. Furthermore since I couldn't do anything about pics already licensed I agreed to stop licensing (even though I own the copyrights) because it became apparent that you were not aware of the arrangement or felt undercompensated.

I have nothing against you JOI but if you continue to make slanderous and false statements about my company I will need to refer the matter to my lawyer. Let's end this here and stop the damage.

I will not continue to reply to reponses to this thread. This is my statement.
