My son bought a 2004 BMW 5 series that was a lease, a few years back After doing all the BMW scheduled services, at the dealer, he now has what many others already might have known. BMW says that you do not have to change the trans fluid for lifetime? Having driven cars for years I could not believe this, This was true after I called dealer, they said lifetime transmission fluid , never having to change it Now the transmission has decided to give out and they have another story
I plan to report this to NHTSA for review, Also many who have blogs as well as forums where you can read many issues about the Ultimate driving machine. The ultimate is the repair bills. I wished we would have read this before the purchase They do not stand behind the product as say Toyota or Honda
Beware. The German luxury dynamo will eat your lunch, and dinner. Buyer beware read the forums and the blogs

From a mechanics standpoint

You would be damned if you did and damned if you didn't.
Often times once a car misses it's transmission fluid change schedule it's best not to change the fluid because as the internal parts begin to wear the fluid would gradually get thicker thus providing more of a protection to the internal parts and perhaps provide a buffer for worn out parts. Changing fluid on a worn out system can leave you with a dysfunctional transmission all together.
However by not changing the transmission fluid in general you will end up with thicker fluid somewhat full of metal fragments that in time will give you problems come winter since the thick fluid can't move as fast as a fresher thiner fluid would and you will experience transmission lag.
Now if your agreement told you not to change the fluid and you did just that the best thing to do is have the transmission looked at by a third party. Perhaps the damage done to the transmission had nothing to do with a fluid change but rather an internal failure.
If the third party confirms that it was not changing the fluid that caused the transmission to fail you have a lawsuit
