Boyajian continues to call stating that my husband owes $325 for an 8 year old ambulance ride.

They will not show us an invoice or anything. We have talked to them, and they're very rude. They keep calling my house and leaving messages. I have written them a letter, but the calling continues.

Jace,

I should have been more clear.

Garnishment for civil judgements is illegal in TX. They can garnish for Taxes, child support and federal student loans, and some other government debt.

Even in the states that you can garnish, it is always based on the disposable income. Lets face it. If someone can't pay thier bills, that means they have no disposable income, right?

Can't get blood out of a stone!

Good response Steve....although you're saying that wage garnishment not legal in TX??? Does this include all debts, including child support, wage assignments, etc etc etc.? Not that I'm arguing with you, I honestly didn't know there were US states where wage garnishment was not allowed.

As for Boyajian, I hope you're right when you say that disbarment in CA is imminent. Short of throwing him in jail and suing him into bankruptcy, it's probably the best we can hope for. It's a shame that he collects money from people who don't know their rights.

Kimbra,

You have many things in your favor here. The first being that the STATUTE OF LIMITATIONS in TX is only 4 years max. This debt is totally uncollectable at 8 years old. Furthermore, wage garnishment is illegal in TX, so even if they could sue and win, they still could not get paid.

Boyajian never sues, as he is totally incompetent and could not find the inside of a courtroom if his little fat a*s fell through the roof!

Third, he is ONLY licensed to practice law in CA, and is barely hanging on to his license. DisBarment is eminent.

Fourth, he is NOT licensed to do debt collection in TX. He is only licensed for debt collection in CA & NJ.

Go to FTC.gov and file a complaint online for the harassment and refusal to honor your CEASE COMMUNICATIONS request as per your right under the FDCPA.

Then file a Bar Association complaint aginst him with the State of CA for his illegal and unethical collections practices. A lawyer must adhere to all state and federal laws at all times. They are required to know all laws that affect whatever they are doing. Ignorance is no excuse.

Look at other posts on this site on him for other advice and contact info of these agencies, and other consumer complaint sites, etc.

DO NOT speak to him on the phone.
