Received a phone call from a Boyajian Law Firm stating that I am being sued for an ambulance bill acquired in 2002.

I am not denying use of the ambulance, but kindly stated that the bill would have been paid a long time ago, had I ever received a bill. I assumed insurance had taken care of it. I also requested a summarized bill of who I owe, how much I owe, and to whom I owe, be mailed to me. I got a reply of "Well I can guarantee that won't be happening!"

I have been dealing with an Elizabeth. No last name has ever been given to me.

Threatening to sue me for a bill from five years ago. A bill I never got, therefore a bill I never knew I owed. Refusing to mail me proof that I owe anyone. Telling me to check my credit report because it's shot. (I did check, nothing has EVER been reported).

I'm not paying this thing... How do I even know I'm going to be in the clear after I send the money? Elizabeth replied with a "Well you'll know we got the money because it will say the cheque was cashed by "Boyajian Law Firm".

YES, I have no doubt that this shady company would infact be cashing the cheque... but are they cashing it to erase a debt that isn't showing up on my credit report, or are they cashing it to line their pockets with my money?

Not sure if it's technically called a debt validation request or dispute of debt, but you can find samples on this site or at budhibbs.com.

I believe you have to do it in writing rather than over the phone, and in any case it provides hard copy proof that you tried to resolve the situation. Basically it's a form letter asking Boyajian to prove you owe a debt which he has legal claim to. The regulars here have done that (myself included) and never heard back from him. And the odds of him actually suing you are about the same as winning the Powerball lottery. As Steve, a longtime poster here once said, Jackie couldn't find a courtroom if he fell through the roof. Boyajian and his merry band of misfits (oops, sorry, convicted felons) are content to send out nasty letters and try to intimidate you over the phone, rather than pursue legal means to collect a debt. Think about how f---ed up that is.

Glad to hear you're smart enough not to send a check to get them off your back. If you did, they would probably come back after you claiming you owe more. Jackie Boyajerk has done similar things in NY and CT, which got the state attorneys general there to sue him for fraud. As far as I know, those cases are still pending. Do not let this vermin goad you into paying something you may not even owe (or is so far past the SOL that they can't legally collect it anyway).
