Last year we were finally able to get a protective injunction against this man for our kids. Within a couple of months he violated it twice. 2 weeks before going to court for the violations, he calls in a false report of a fire at my address while he was extremely intoxicated. When my wife walked out to speak to the firemen, this man came running across the street, onto my property, with his hand raised in the air, right up behind my wife, where I tackled him inches from her feet. Once on the ground, an altercation took place which ended with him being sent to the hospital.
Did he get arrested for public intoxication? Nope! In fact, the officer refused to test his alcohol level. Did he get arrested for filing a false report of a fire, violating our kids' injunction (this all happened right in front of them), tampering with a witness, assault? NOTHING! Instead they arrested me and tried to charge me with felony battery. It took 8 months and $8,000 before the state attorney's office dropped the charges against me. During that time, Judge Eddy granted him a protective injunction against me! This injunction was filed more than 6 months after most recent alleged act of violence and based on a single act (there are suppose to be 2 acts of violence for a protective injunction). Judge Eddy refused to let me testify about this incident and refused to watch the video from my surveillance cameras. He did let the other party testify about the incident and show their pictures.
So, after all of this, what did the man get for exposing himself and grabbing himself in front of my 6 and 15 year old children? He got a $100 fine! Not even court costs! Now that the man has a protective injunction against me, he literally chases me through town trying to get close to me so he can take pictures and get me in trouble for violating the injunction. He has actually sat in his van waiting for me to come home, and when he hears me coming, he pulls out onto the road and parks his van in the middle of the street, then jumps out and stands there in the street blocking the road to get home. I had to turn around and go around the block to get home.
I have filed six motions to vacate this ludicrous injunction over the last 2 months but they have all gone unanswered so far. The police won't do anything other than write a report. The state attorney's office has called his actions benign and not worth their time. The city of Ocala and the state of Florida are almost as responsible for his actions as he is, because by refusing to act they are teaching him that his behavior is acceptable.
