Bradley H. Spear ripoff Bad Lawer Drunk DUI Law Offices Van Nuys California

    O.k.everyone, listen up. My experience with Paul and Brad Spear are as follows: Brad Spear represented my wife in an accident claim, then kept calling her well after the case only to have her move in with him, and by the way, he is not divorced,  or is my wife from me. Which brings us to the point: I asked for a divorce in 2008, right after my wife moved in with him while I was in the hospital. I come home to missing furniture, my recliner, bigscreen t.v.: and you just don't take a mans recliner, or wife, or big screen t.v. , + two starving animals, a dog and a cat, which by the way I had to put the dog down because she was old and sick from not eating while I was in the hospital. Anyway, I paid to get the papers all ready to go with a court date for the hearing, when who shows up? The brother of the guy,"Paul Spear", who's brother is sleeping with my wife,:"Bradley H Spear", He came to ask the judge to hold up the divorce when it was his brother, Brad who told me to file it as a default; because they had been sitting on the counter for months, meaning a , non-contested " divorce. The adulterers' brother Pau, showed up to court in a missed matched jacket and slacks that were so wrinkled that it was an insult to anyone with sight. 
    Not to mention the moon scaped facial skin which d**n, looks like a piece of pizza. Paul spear had any business representing my wife who his brother Brad is sleeping with. We have a nephew in common and I know alot of his family. Anyway the judge continued the divorce for another day, Aug. 14th. After talking to Paul about him not being allowed to represent my wife, when Aug came  I was in the hospital again, this P.O.S. shows up to have the motion quashed; and this is after his brother, Bradley H Spear, the adulterater told me to file it as a default . 
    Now it is April 2011, and 30+ days ago I signed the papers for divorce that should have been filed in a few week period. THESE GUYS ARE BAD NEWS AND SOON WILL BE DISBARRED, OR OUT OF BUSINESS IF THERE IS ANY JUSTICE IN THE WORLD.
P.S. When they have sent me the divorce papers twice now because they couldn't get it right the first time, it was sent in a regular sized envelope for two sets of dicorce papers with both sides of the envelope wide open from being too d**n cheap, or just to mess with me. either way, stay AS FAR AWAY, as possible from Bradley H. Spear, and his P.O.S. brother, Paul Spear... 

This guy is still an active member of the bar. I am calling bs on this story. Can't even spell lawyer right in his first post. The story of the dui happened in 2006 not 2008. How do I know? It is on his profile on the California state bar. He has been admonished for un professional conduct but he hasn't been disbarred. It's these types of lies that make people want to shut this site down.

i looked up Bradley H. Spear with the CA Bar and Guess what, he has been DisBarred for Another DUI! If you are going to get Advice from this so-called lawyer just remember he has NO Bar or you can find him in a bar. get it? he will be found in a bar cuz he is a DRUNK. that's 4 DUI's that have been reported by the CA Bar. I am so glad he didn't take my Work Comp Case. he told me Good Luck! i say F** Him! Brad if you read this or the report PLEASE take me to court i need some cash so go and Sue me so i can have a counter clame. so you can Piss off the Judge. don't forget to get Drunk before you show up! if i was you, i would get a good Lawyer if you do sue me. like you said you would. Today i got a letter From Brad. This guy is now saying his wife, The Dr., and Him are going to Sue me for this posting on this web site. Dude Get A Life. If you where such a good Lawyer Mabe you wouldn't have time to care what is said on a web site with FREE SPEECH Timothy is Bradley H. Spear. i did a surch on him and found that it is the same person. and his threating letters are going to the CA Bar for my case on Brad being Drunk. have another drink Brad you only gave me 1 ride to court after i saw i was putting my life in danger ridding with a Drunk Driver i had my Mom give me rides to court. she fallowed you to the bathroom and saw what you did in the mens room (Was that COCAIN or was it METH) i think it was meth just by the way you looked after you came back.

I only posted after it was said that i have made the first post. at the time the first post was made i didn't even have a computer. nor did i have a car. (so don't just think that cuz i didn't have a computer i went to the local cyber cafe) I am not the only one that did see Mr.Spear DRUNK i have contacted and recived a letter from the judge in my case.
my friend Bob is doing the same.
i have been in touch with the California Bar about this matter and i have started the ball rolling to get this matter taken care of.

as far as this site goes, it very much seems as a way to vent and if Mr. Spear wants to sue me then let him sue me. I only have to show up and this guy will piss off the judge in that case that i will win. i have no worries and i as far as my taking a bigger bite out thats the same words Mr. Spear used in his letter in fact Tmothy wrote almost word for word what Bradley wrote in his threatining letter to me. (this letter is going to the CA Bar)i have also set up an ivestigater to get video proof of Bradleys actions and as far as i'm concered i don't give a RAT'S A$$ to what Brad is going to say or do.

First of all, ditch the "alter-ego" thing. You lose all credibility that way. Take a brief look around this site and you'll see hundreds of posts authored by me. I'm surprised you don't recognize MY name, because I recognized yours!

Next, take a look at this statement: "this guy walked away durring the court case to go take a drink or do some drugs as the courts was moving along"

Ok, so he walked away during the case to "take a drink 'OR' do some drugs." This is an equivocal statement. Think about it long enough and you'll realize that the reporter didn't witness anything and is merely speculating.

In other words, the reporter really has no idea whether or not the lawyer was drinking or using drugs. By stating that he WAS using something without any actual evidence or witnessing thereof, the reporter is recklessly making defamatory statements without regard for the truth.

A "reckless disregard for the truth" resulting in the publication of a defamatory statement IS sufficient to sustain a libel charge. Whether or not the guy has a reputation for being a drunkard, whether or not he has a flask in his office, an allegation that he was drunk IN COURT is NOT acceptable in the absence of first hand or otherwise reliable knowledge.

Don't be so naive as to not realize what is really going on here. A semi-literate RoR post is NOT how you deal with an attorney who you really feel was so intoxicated during your suit/prosecution that he jeopardized your legal rights.

If what is alleged actually happened, this guy would be writing letters to the judge and/or hiring another lawyer to sue the first AND filing complaints with the state bar AND filing complaints in consumer sources.

But this fella is ONLY lodging complaints. He's making NO effort at rectifying the alleged harm caused by this attorney. Isn't that one heck of a red flag?

And what about the fact that he posted under two separate names, thereby attempting to conceal his identity not only to the attorney but also to US? Can you really look past that, or do you just not believe me? Because if you need me to convince you that the above posters are the same person, I can easily do so.

If this guy did what the posters allege, then I don't see how this can be libel. Its not too difficult to prove any prior criminal complaints, and normally, a drunk has a local reputation anyway. Transcripts would show disrespect and other problems in the courtroom.

I've seen much harsher ROR's, and they don't disappear just because someone doesn't like what was written. The tone taken by the last poster sounds like perhaps it may be Mr. Spears in a last ditch attempt to gain compliance of his written request. LOL Yup, that works around here.... NOT.

First, you're the same person. It's patently obvious.

Second, I think you've bitten off quite a bit more than you can chew here. I would take your former lawyer's advice and BEG Ed to remove your posting. He won't do it, because to do so involves himself too much in this process and sets himself up for liabilities that he can otherwise avoid.

Third, your understanding of the First Amendment is WAY off. The First Amendment applies only to the government. It prevents the government from stifling your ability to say what you want. It has no bearing, and was never intended to have any bearing, on the actions of private parties.

However, were you to be sued by this lawyer, which I would anticipate if I were you, the First Amendment would be implicated because a governmental entity, to wit a court of law, would determine the legalities.

But rendering and enforcing judgments per the tort of libel has since time immemorial been recognized as an exception to the First Amendment.

But I expect that you will soon learn all of this the VERY hard way. Here's a bit of advice for you: in the future, if you believe somebody has done you wrong, stick to the known facts and refrain from character attacks.

The other day I received a call from Brad Spear. as soon as he said who it was i hung up. the guys an A**Hole. I then received a Letter saying that i have posted all this stuff about him on Rip Off Reports. his letter says this:

"Dear Mr. ******:
I was advised today that there exists a website entry which is libelous to me. I got onto the Ripoff Report website and read the entry, and it is clear that the document was written by you.
Upon reading the item I immediately called your number and spoke to you However, once I mentioned my name and the item listed on the website you immediately hung up on me.
Accept this as my demand that you immediately remove that libelous document from the website. it does not matter how you do it, or how difficult it is to get off the internet. Just do it.
Your letter represents libel to me, my wife and Dr.Nicholas Houston. You have overestimated yourself, and underestimated me.

So, by reading this. Bradley says I'm the one that wrote Bob's post. this guy thinks it was me.
so you're Dr. that was a quack is Dr. Huston? you did not say who the Dr. was Bob. and Bradley H. Spear was drunk during My Case too? thats what is sounds like to me. I know he acted out like a jerk to my Judge and Jury but to go out and blame me for something i didn't write. that doesn't surprise me at all.
well that was not the end of this. i called to find out why he blames me. i told him i didn't do it. he went on to say he was going to sue me. Bob you where close he threaten me that he was going to sue me not you. you're right, what a LOSER.
Bradley H. Spear can not be Trusted with a case. I personally looked up his records with the California Bar and he does have 3 actions against him. when i talked to Chris over at the California Bar, they said if he gets one more action against him he will lose his license. well i have the paper work to start that 4th action sitting right here. and if HE Does Not Adhere to the First Amendment Rights that Rip-Off Reports uses to protect the people that post on there website then he is a bigger A** then we think.
I know you will read this Brad so listen up. I Have The Right To FREE SPEECH you can NOT take that away from me. this web site was made to use My First Amendment Rights to FREELY say what I want when I want. If you take me to court all that is going to happen is you are going to Waist you're time and my time to have a Judge get pissed off at you like the judge in Irvine was pissed off at you. and I will win over the right to FREE SPEECH.
