In Feb 2002 While working a major scenery company in Yonkers NY, I suffered a shoulder injury which would eventually require surgery. From day one Kemper was great, Comp checks were almost immediate as were approvals for MRIs and eventual surgery.

The MRI did not show all injuries, and thus my surgery was not exactly successful and due to constant pain and decreased range of motion I was kept out of work much longer than expected. During this time off I had several IMEs from 3 different Drs. Drs #1 and Drs #2 both recommended more time off, more PT, and possibly a second surgery. Dr #3 (this nut should get his own report) decided that my injury was not even work related!! Kemper and my company hatched a plan to return me to work based on Dr #3s IME, then lay me off immediately, thus getting me off of Kempers payments and collecting Unemployment instead.

This plan backfired when my company came under a dramatic increased work load and they were forced to bring me back. I was also told to due work beyond my light duty restrictions, if not go home.

Needless to say my original injury got MUCH worse, and I also caused new injuries due to favoring my injured shoulder. When I could no longer even shift my car, I said I had enough, returned to my original surgeon and was immediately told no work. Kemper refused to restart Comp Payments, due to the findings of their hand picked Dr. I eventually won the right to another surgery, this one much more invasive and also done by a top Dr in the NY metro area.

Naturally IME Dr #3 declared me fit to work thus causing Kemper to halt my Comp payments yet again and force me back to work prematurely. I am now permanently disabled with less than 50% use of my dominant shoulder, and Kemper's hand picked IME Dr also wrote his report to deny me even getting a scheduled loss.

I went from 32 years old making $70,000 a year to now just getting by on Social Security Disability due to Kemper's IME fishing and their rushing me back to work as an Iron Worker when I was clearly not ready to resume those duties. I bet you can also guess which Dr in the Orange County NY area Kemper/Broadspire now uses for IMEs.
