Last night, I checked my and my husband's and my bank account (not a capital one bank), and I noticed that capital one charged the account $183, resulting in overdrafting the account and causing 2 overdraft fees of $32 each.  My husband has two capital one accounts, and admittedly, we are behind on the payments.  At the time the charges were made, both my husband and I were graduate students with no income but expecting to have decent jobs within a year.  Since that time, my husband has become disabled and is unable to work.  We are living on my income alone, which is a struggle.

Anyway, I contacted Capital One immediately the next morning.  When I explained the situation, Capital One required my husband to authorize me to discuss his account information with them.  I fully support confidentiality rules and was glad they required this, but I did explain that my husband's disability (Panic Disorder with Agoraphobia) made it extremely difficult for him to talk on the phone.  I requested they make this as short and quick as possible before returning to talking to me.  The authorization was quick, and I continued to explain the situation.  Each time I was transferred to another person (5 times), Capital One required my husband to give his authorization again, even after I explained he had already done this and by asking him to do this again they were giving him undue stress.  My husband ended up having a SEVERE panic attack and smashed his head through the bedroom wall to "stop the pain and numbness and feel something real."  My husband ended up with a huge bump on his head, a likely concussion, and a huge hole in the wall which we had to pay to repair.

Back to the money...After I explained the situation, Capital One told me there was no way they could have charged the account unless someone gave them the number, and according to their records, it was provided through a phone authorization.  This was a complete lie because the account in question had previously been used to pay bills online.  When I asked what phone number was called and when to authorize the payment, they said the ONLY number called was my husband's cell phone.  They gave me the date and time, and I pulled up his call history online.  When I told them there was no record of the call, they said that they did not actually call that number, but instead they called his mother's house.  I told them he did not live there, his mother does not have our checking account information, and she does not have the ability to authorize charges to our checking account.  After being hung up on and treated like I was stupid, I finally got someone to agree to send our report to "investigations."  I am supposed to hear something within 72 hours, but I honestly do not have high hopes.

While it is possible capital one may return the charge and overdraft fee, what about the other ramifications of this event?  Our account is now $247 less than it would be if they had not committed a fraudulent act.  That means there are other bills I will not be able to pay on time and will be assessed a late charge.  This should be covered also.  Additionally, I feel there should be some compensation for the stress, time, and emotional pain (especially my husband) this has caused us.  This was an ILLEGAL, FRAUDULENT act they committed, and they tried to lie and cover it up when we brought it to their attention.  This was not an accident.  If it was, why would they try to tell me they called one number and then say it was another when I could prove they did not call the first?

I was wondering if anyone knows about any Class action suits against Juniper Credit Cards/Barclay Bank? I am having a problems with them assessing fees that make me go over my limit and then charging me another fee. ?????? When I spoke to the "manager" he said there was nothing he could do and that there was noone higher that I could speak to????  Any help would be appreciated.

Please, Please, Please tell me who to contact concerning this class-action law suit! They charged me over the limit fees, closed my accounts (2 credit cards) and refused to work out a payment plan with me that I could afford! Had only $500 on both of them, by the time they were done with fees, they said I owed them almost $1200 on each! The representative was rude and nasty and bragged to me that he was going to put a lein on my house and he refused to close the accounts completely although they are "closed"-also bragging that the accounts would still be accruing interest until I met with HIS terms concerning payment arrangements. How can I send you my information confidentially without posting it in this comment? Capital one might retaliate. I have also filed a ripoff report. Please help!

I have recently been a victim of Capital One. They have given me false information and have changed their story 3 times related to my incident. Everytime time I contact them they say send in your information and we will look into it. I have gone to the actual bank to go 1 on 1 with someone and they are useless also. My husband and I each got our own card several years ago to try to build our credit. We each had only a $200 limit. I started questioning them when I noticed that they charged an over limit fee of $39 on my card which was not over the limit until they applied that charge. They could not give me a reason why this happened. They just kept telling me that I was charged the fee because my account was over the limit. But what I could not get them to acknowledge (or admit) that it was that very fee that put the account over the limit. After going through that aggrivation and not getting anywhere I started really examining the statements and noticed on both of our accounts that the begining balance on one statement was always higher than the ending balance on the previous statement. Once again, I'm stuck on the phone for what seemed like forever trying to get an explanation with no success. You would have thought I was trying to explain quantum physics to a 3 year old (I probably would have gotten further)!!!!! They just played stupid and acted like they didn't see it.

Capitol One has done a great deal of harm to the persons who have filed in the RIP OFF REPORT. Capitol One has done harm to many others out there who have never heard of the RIP OFF REPORT. AND WILL CONTINUE TO DO SO as long as they can get away with it.

The Rip OFF REPORT has allowed this group to come TOGETHER in an effort to try to build strength in numbers in order to obtain the help we need as working class citizens to put a stop to Coporations like Capitol One from destroying our GOOD NAMES, and credit that we have all worked so hard to achieve and protect.

The people filing these reports are not FLAKES. Capitol One is guilty of Fruad, Deflamation of Character, Reposseing peoples homes, cars, over inflated interest rates, and yes many broken homes, and families.. { you surely didn't think Countrywide was the only one, DID YOU ? ]

Power is in the numbers, and I don't mean dollars. It lies within people like us standing together, standing STRONG to say to Capitol One ' WE are not going to allow you to do this to us any longer.'

I welcome these reports. I hope one day there will be enough of them and someone out there has the right type of authority to shut Capitol One Down. Perhaps we can all rebell, stop paying them and they will have to file for Bankruptcy and the GOVERNMENT will step in and really do what they should have already done......

For those of you who think this is just a worthless group of whinnies who just dont pay their bills on time, and can't seem to manage thier lives, I say " DAM YOU, ". you'd better think again and remember you may be the next casualtiy of Capitol One.

Obviously, Liz & Clifford haven't read ALL the posts - re - fradulent charges, credit protection in event of loss of wages, 'ghost' fees - stolen cards with the fees carried to the new account - Capitaol One royally flushed my credit when all of my cards were stolen, when I reported it within hours of the theft, they closed the account BUT allowed all pending transactions to go thru - then, carried them over to the NEW account - need I say more????Only when I started to file small claims AGAINST Capital Onefor all but $50 of the charges, they credit the account, HOWEVER they shoed my credit report as having SETTLED on a delinquent account. Nice, huh? Those glass houses break sometimes

Only one time with an over the limit fee ????? This sounds like a PROBLEM to me.

Your problems with Capitol One are just begining.

Further more, if you just wanted to make a statement of sentiment you should have used another site. This site is for the Serious people.

I'm not sure why so many people seem to have a problem with Capital One. I've been with them for a year and have had absolutely no problems with them. I paid late once but never got charged late fees. I only ever had an overlimit fee issued once, legitimately of course. I'm confused why some people seem to think there's a need for a CLASS ACTION LAWSUIT. I'm sorry if this sounds rude, but it really seems like a bunch of people can't effectively manage their credit cards and can't admit that its their fault, not the company.

I never authorized account access to Capital One or showed any interest in what they had to offer. Today, I checked my acount history, and some how, they have run my credit report 30 times since the end of '08. Legal action needs to be made. This is unacceptable!

i have just filed a Ripoff Report against Capitol One. My report number is 352804. It is there for all to see. Capitol one accepted charges on a credit card I had paid off, and closed the account. Capitol One then opened a bogus account , new account number in my name without my knowledge. I recieved a credit report from Eqifax, Capitol One showes me with a charge off in the amount of $1474.00.

Also using the fruadlently assigned account number. There has been a complaint filed against Joel Avery, He created this account. And I truned it over to the fruad department at Capitol One. It has not done any good. I have also mailed a copy of my Ripoff Report to all the credit reporting agencies. I have not heard from Capitol One since December 2006, however this is still an ongoing matter. Please read my Ripoff Report. thank you

Prior to 2001, I enjoyed excellent credit history with reputable credit issuers, such as American Express and Discover Cards. My credit lines and scores were always high, and I simply couldn't understand how people with low scores could gripe about "being Ripped off" by these great institutions that would help them get back on their feet with a $300 credit line. Frankly, they "shouldn't look a gift horse in the mouth." What got these people into trouble was their inability to balance their budgets and watch their card balances.

Yeah, right. It wasn't until after I was forced to file bankruptcy due to family separation that I tried to rebuild my credit with a Capital One card. Four years ago I was issued a $300 line with the promise of increases every year or so. It is now 2008 and I have yet to see an increase. But what is more troubling is the THEFT that I have seen by any company, stateside, nontheless. What they do repeatedly, is appalling: I paid my account off, entirely...and the next day it shows that I was past due on my account. "Not this time" I thought. I have a print out -- proof that I paid on time, as always. And I did.

So I waited 45 minutes on hold until finally, someone from the Phillipines that can barely understand my questions, simply stated, "I'm sorry Ms. ...., we can't issue you a credit because you already got one last month." Like that's relevant - -you stole from me last month too. I spoke to a supervisor who assured me this was a decision for Virginia to make, and he would file a supervisor's complaint.

That was a month ago. Where did it get me? For paying off my bill entirely on the due date, I was charged a past due fee of $39.00 and an OVERLIMIT fee of $19.00 for a ZERO Balance. This is flat out theft and arbitrary. So, I thought, there's got to be a class action for this behavior, and I have yet to see one. I am in the legal profession, getting ready to take the bar exam in California. I have resource. The people I know. And so I now started searches to see if this is Capital One's protocal, "preying" on people that so many, including myself in the past, chaulk off to irresponsibile management--who would listen to them? And that is their edge.

I can guarantee you, Capital One has HURT my credit, not helped. I am constantly "dinged" for this or that--for an overlimit fee when my balance is below the limit or zero, which is in turn reported to a credit agency, and in turn, is picked up by reputable credit issuers who won't touch me--I've had to explain, over and over. In short, I don't think Capital One's intent is to collect fees like Bank of America's class action revealed, I am sure it is a way for Capital One to interfere with Interstate Commerce, by ensuring that their clients remain only their clients and stifling/dissuading/circumventing competition from taking their cardholders away. In this regard, Interstate Commerce violations and Fraud, a Class Action must be done.

I currently work at a municipality law practice firm, and if there is interest, I would be more than happy to assist a class-action attorney with my time, my education, my knowledge and the leg-work to sue these predators. What the hell do you think hurts our economy....but these people. Please let me know who is interested.

i have had a situation with a capitol one credit card. capital one aloud fruaduent charges on my credit card. this card had been paid in full. i was shocked to recieve this bill. after months of arguing and refusing to pay capitol one, they found a solution to the problem. capitol one closed my account to prevent and more fraud., after a while i recieved another billing statement with an account number i did not reconize. after researching my files and finding i did not have a credit card with this account number. i called capitol one inquiring about this new bill and account number. it did not belong to me. capitol one said they solved the credit problem i had by closing out my old account and opening a new account, new account number, and transfering the fruadlent charges over to the new account. now i could pay my bill !!!!! needless to say the bill is still unpaid and i reported this employee to capitol ones fruad department. i have not heard from capital from capitol one concerning this matter for quite some time. ia am sure, however this is still and on going matter with them. i do not know what my credit rating looks like due to this matter, but i am about to find out. if the l.a. attorney would be interested in speaking with me, i have all my files and you are welcome too review them. lynn (((ROR redacted)))

I was particularly victimized by their "payment protection." Unlike most people I willingly took it because I wanted to be "covered" in case of something bad. Well about 2 years later that something bad happened. I became unemployed from my first job. I was so relieved I bought that payment protection. So I called and got the paperwork to activate it. I filled it out and sent it back. It was returned to me "incomplete." So I fixed it to their specifications and sent it back again. This went back and forth a few times. Eventually nothing came back. So I assumed all was well. Wrong.

6 months later I called to reinstate my payments and was told no credit protection had been active. I was WAY over my limit on finance charges, overlimit fees, interest etc. And my APR had skyrocked to over 30%! I was so upset and was able to talk them into putting it all right again (at least putting me back under the limit and giving me a lower interest rate than 30%. But they didn't fix the reporting to Equifax. That was 3 years ago and my credit is still so bad from that even though I have been making dilligent and on-time payments to everything ever since. They ruined my credit and because of them I can't buy a house. I want them to fix my credit with Equifax and whoever else they report to, after all I paid for all that crap "Credit Protection" and filed the paperwork. They were the irresponsible ones. I work at a small financial institution now and we offer that and I would NEVER dream of doing that to one of my customers. It would be over my dead body that one of my customers got screwed like that! If there is a class action in the works, let it be so! Don't let any more innocent people be taken advantage of!

Capitol One and reporting positive credit

I was a Capitol One account holder for three years. I opened up an account with Capitol One to rebuild my credit. Every payment was on time. I found out that Capitol One NEVER reported my positive credit to any of the three bureaus. I contated manager after manager at Capitol One. I received two form letters indicating that Capitol One did in fact report my credit to one buruea. Needless to say, I contacted the bureau in writing and verbally concerning my credit report. To this day, four years later my positive credit has never been reported by Capitol One to any of the three bureaus. I found out that this is one of Capitol One's scams to keep their customers from receving solicitiations from other potential creditors.

If anyone files a class action suit, please contact me.

Capital One just put my account into collections for $385 even though I paid it in full and ordered it closed over a year ago. I sent the collection agency a letter offering three settlement options for Capital One. Option 3: being they do nothing and I get in on one of these class action lawsuits. Even if they settle, screw them.......I'M TOTALLY IN

I was a victim of a lawsuit where Capitol One agreed NOT to sue former card holders in California. They sued me anyway in violation of their court settlement & now I have no job & owe collection agencies $10,000 for a judgement that never should have been entered.

I am tired of them telling me that I am dead or not allowing me into my own account. I also don't agree with their $29.00 extra fees being billed to my account.

I also don't like when I call in having to speak to someone in customer service, that does not understand English. Has Capitalone outsourced jobs to India? This morning my wife and I were hung up on when we asked to speak to a supervisor.

I would like them to correct the problem in there system that says I died in 12-21-2006. I am not dead, I am still alive. They still won't let me have full access into my own account.

Maybe if they feel I am dead they can forgive my whole bill? LOL LOL LOL LOL!!!!!!!

Why are they treating customers like this?????????

I would like to be included in the class action against Capital One's unfair charges. Per my complaint, my separated wife took out an account and I never found out until collection agency tried to collect. I called Capital One and they would not change my address, send me a statement or give me the account number. How can this be fair to me? The original bill 300, now is over 1000. It's not fair and I want justice.

My original card was issued in 1999. In 2001 I contacted the company to pay off the balance. I was actually doing this with alot of my high interest credit cards. I was told they had no account for the name or account number I gave them. It was repeated to them several times through mulitple calls. I finally gave up and cut the card. In 2002 I received a call from them stating I was past due and owed an amount. I told her about the above. She began to argue with me and without my okay ran a credit report on me.

To make a long story short the original balance was around $80. Now almost ten years later with over the limit fees and late fees it is almost $2000. Every month they charge it even though they have sent it through multiple collection angencies. If you were to look at my credit report it would show car loans, home mortgage loans and creidt cards, up to date and never late, except for the ever glooming capital one's mark on it.

I would love to join a Class Action lawsuit against Capital One.
I'm not sure how we contact you. My gripes with them center around two things: if you file a disputed charge, they give more weight and more refute time to the merchant than they give to their customers, even though we are the ones paying their annual fees. Secondly, they raised my APR just for filing a disputed charge; I was not late or over limit. Their customer service is poor also, rude and condescending. I have closed my account with them. Their "No Hassle" advertisement is a farce!

The class action asserts that Capital One fee practices (late fees, etc.) are illegal.

I cannot say with any certainty how Capital One might handle your accounts if you participate in the suit, however, I can tell you that in the past they have treated accounts of parties suing them no differently than they have handled other accounts. It is a possible that they would close the account, but under the circumstances that might not be a bad thing.
