A year and a half ago I got a job delivering pizzas and my current car had just broke down. Typical story I had no credit and didn't have money saved up or anyone to co-sign for me. I had no choice at the time to go to car and credit. When you are looking to buy a car they are your best friend. They act like they will do anything they can for you.

I bought an 02 Impala with 130000 miles on it. After the first week I was at a hotel and it was snowing really bad outside and my car wouldn't start. With it being Saturday night they were closed and I couldn't leave my car in the parking lot. I ended up replacing the starter in my car and called them Monday morning. Even with a receipt for the starter they would not reimburse me because I did the work.

After about a little over 3 months of having the car I was headed down the road that went right by the Car and Credit store. I was going 55 when a lady in a van swerved into my lane and hit me head on. My car was totaled. The ladies car insurance lapsed the day of the accident and I had full coverage. Even with full coverage my insurance company only paid the worth of the car not what I owed. They paid about 3800 when I still owed over 7000 dollars.

I got a lawyer and even with my injuries and her not having insurance I did not have a case. All I was looking for was to get enough money to pay off the car and buy a beater until I could save some money up. Car and Credit showed no sympathy to what happened. At the time they said they would get me into another vehicle and add it to my current balance which would of brought it up to around 18000 dollars. I declined and the manager got visibly angry and irritated because I refused.

It has been over a year now since my accident and 2 weeks ago I missed a payment(which by the way is 80 dollars a week) because I had to put money into getting brakes on my current car. I called them on Monday and told them I would make a double payment on Thursday. He wanted proof of why I couldn't make the payment. Shortly after a guy from the store showed up at my house which is a 20 minute drive from the Midland store and I told him I just got things sorted out on the phone.

Again the next morning they showed up at my house asking about where my payment was even though I told them I was making a double payment on Thursday. At the same time they were still calling 3 - 5 times a day. They brought another "amazing" deal to the table. They wanted me to trade in my current car which has about 25000 miles less than any of there cars and they would wipe my balance and then I could get into another vehicle in their front lot. I told them no and they got irritated again like I was refusing the golden deal.

I work 11 hours shifts and do not get home until 530 in the morning and again the next morning they showed up at my house and this time I was very angry because not only was this the 3rd morning in a row they have showed up when I already had things sorted but the guy sat there and beat on our doorbell over and over and over. The guy said he was wondering about when I was making a payment and I was pissed at this point said I am making a double payment Thursday. After he left I called the manager and he lied to me over the phone saying they just wanted to get me to come in and trade my car in.

So after all this non sense I went in to make a double payment of 120 dollars and got my receipt dated 10/25/12 and compared it to my receipt that was dated 10/12/12. On the 10/12 receipt My Previous balance was 3893.59 and current was 3833.59 and on my 10/25 receipt my previous balance was 3938.69 and Current 3818.69. So this means my current balance on 10/25 has went up 106 dollars since 10/12. There is a spot on the receipt for late charges and it says I was not charged a late fee. So how do I owe more now than I did a month ago???

Car and Credit has already received over 7000 dollars from me and my insurance company. I owned the car not even 4 months and not only have they most likely doubled their money on me...I am paying on a car I don't have. I am not asking them to wipe my balance free and clear but a bank does not show up at your house 3 mornings in a row looking for your money. I DON'T EVEN HAVE THE CAR. They are literally ripping me off and harassing me over ONE late payment that wasn't even a week late. That was the only time I was ever late.

 I have tried calling the lady that managers both midland and bay city stores but every time somebody tells me she will call me back she never does or she "is not there." I have no idea what to do. What they are doing is not right and I know it cant be legal. I need advice or help from anyone that can lend a hand

You need to place blame where the blame actually lies...with the woman who hit you and didn't have insurance.

If the lady that hit you did not have proof of insurance, even by a day, she was violating the law.  As a result she "could" be charged with a crime and actually end up in jail.  In MI it appears to be up to $500 fine and a maximum of 1 year in jail.  So the first question is did you get a Police Report for the accident?

Next, there is nothing that says you still can't sue the lady for any additional damages you had that insurance didn't pay for.   So if you wanted to sue her for the remaining balance just based on the fact that she had no insurance you probably have a good case.  Since the amount is small enough you could probably even do it in small claims court on your own(no attorney) for very little money.  Now, if you prevail you may not get the money right away, but you can then take legal actions against her to force her to pay.  Which by the way if this company ever decided to sue you, would be the exact same remedies they could use against you to get you to pay.

If you do file suit, just the fact that you filed may get her to cut you a check without going to court.  Because if she goes to court and can't show proof of insurance for that day..the judge may not take too kindly to her.

As to this lender.  Unfortunately it doesn't matter what lender you are with, but no longer having the car does not mean that the loan balance goes away.  So while you don't think it is legal..it is 100% legal for them to hold you to the loan agreement you made, and if by chance you stopped paying them.  They could take you to court and you would loose.

As for their methods, while annoying there is not anything technically illegal about them coming to your house and knocking on your door.   But if they were bothering you, you could have called 911 and had the cops show up and if they still happened to be there write a report on it.   You could however make it illegal by having a trespass warning given to them, but they may counter by taking you to court and suing you for the remaining balance immediately.

Your balance increased because you were late so were charged additional interest.  You weren't late enough to be charged a late fee it looks like, but even 1 day late gets you charged additional interest.
