I recently changed merchant service providers, and notified USAG to close the account. I was with them for 15 months.  I received a notice that an early termination fee of $3510.67 would be withdrawn from my bank account, as per our contract. 

I carefully read the contract that I signed, and there was no mention of a term of service or minimum term anywhere in the contract.

When I contacted the company, they maintain that I signed the contract, and that all merchant agreements are 3 years.

When doing a search, I found that typical early termination fees are $200-$500.  USAG (CardFlex) is not operating in  good faith. Their representatives never mentioned a penalty or term of contract. The contract that I have did not mention a term of agreement.  I am told that the "welcome package" had that information in it.  However, this came weeks after I signed an agreement.  I have blocked their attempts to withdraw money from my bank account, but expect to be sued. Anyone interested in a class action lawsuit against these theives?

They will not attempt to sue you for early termination if there are no such terms in the contract.

You cannot sue them because you have not suffered a loss.

Been using cardflex for a little over 2 years and switched merchant account provided. Called in to cancel and they happily did it for me. I was like wow, that was easy, no push to continue with them or anything. A few weeks later I receive a letter with an early termination fee of $1500. This came as a total shock as I was not expecting this at all.

After multiple calls and email, they say that is how they charge and that I signed the agreement agreeing to it. Which I do not see anywhere in the signed document that there was a mention of early termination fees. Apparently they had a welcome guide that was 30 pages long that they sent to us and in that 30 pages, there was a small sentence stating that they will be charges the fees for the remainder duration of the contract (based on the average fees the last 12 months). So basically they still want to collect FULL & COMPLETE fees even though no service is being provided.

This is a total scam and I wanted to put the word out there. We are drafting a plan with our attorney right now and will bring them to court.

Long story short, avoid Cardflex with a million foot pole.......
