some middle-eastern sounding guy stating that his name was Steve Jones called me at work today stating that i have been named as the primary suspect in a case against me filed by the state of california regarding non-payment. it took him forever tell me who the plaintiff was, in which he finally said CashPay USA, and charges for various things like check fraud and stolen funds were being brought against me. He then actually read an affidavid to me over the phone, and even used words like " you have the right to an attorney" and so on and such. Then he said I owe the amount of $280, which actually is the exact amount of a previous payday loan from another company with a similar name I just paid off. So, I thought that it was real. He even had my address, email, AND work #.

He then said that If I have a lawyer, that I should have the lawyer contact his office, which he said was in California. I told him that this is not a criminal issue, this is more of a small claims issue, usually resulting in consequences like wage garnishment, not criminal charges. I have not received anything from the state of Maryland informing me that a litigator has filed judgement against me. He said that this is not a civil matter, this is criminal, and that if I don't pay the full $280 in one week, i then will owe $5000, and can be arrested and put in jail if I don't pay it. He said law officials will come to my house, which he verified my address, and deliver a subpeona against me to appear in court one week from today.

he said the only way he can help me and delay law proceedings is if I pay the full amount. I told him I did not have it, and won't have it for another 2 weeks, since your only giving me one weeks notice. he said the least I could do to delay proceedings is to pay him $100. I actually told him that I will not be able to pay him  for another 2weeks. I asked hiim for his telephone #, which he gave me 760-459-4656, and told him i would speak to my lawyer first and then call him back. I tried to call back literally minutes later, after my lawyer told me its unlawful under the Fair Debt Collections Act for him to threaten criminal charges. I did not get an answer. I then googled CashPay USA in California, only to find that there is no such company. However, I did see a link for Ripoff Report, quoting an article on their website describing an incident that sounded a LOT like mine. so, here I am. I hope they don't steal my identity.
