I was behind one payment, which I fully intended to make albiet a few days late. When I called in to let them know this payment would be late I was lied to and told that it could not be debited from my account, that it had to be sent via moneygram and that if I didn't have it paid by the following week I would be in default of my agreement and they could demand the entire balance upfront. This was a lie. They debited my account before I could take the money out on my payday to moneygram it to them.

Fine. I owed it anyway. I found the email that arrived the following day to notify me of an automatic debit hysterical. Two weeks later, another debit was taken from my account in the same amount. I figured that was probably to make it "current" since the other payment had been late. Last Friday, ANOTHER debit was taken from my account. This is three in six weeks time.

I stopped calling them after the first lie about having to pay via moneygram. They however, have not stopped calling me. 97 calls on my cell phone (it only tracks them for two weeks at a time) several calls to my work with my office manager and others telling them they are not to call, this is a place of business.

I laugh at the calls to my home. I come home and that little light is blinking 10 times with people who aren't aware they are talking to an answering machine "Hello, hello? Hello? Helllooooo?" then they think they are outsmarting me "Oh c'mon I heard you pick up the phone!" or they think they sound like a pal calling to say hi and that I'm just screening "oh hey, just calling you back. I know you're there" I'm waiting for them to learn my pets names and start talking to them through that machine!

Here's the kicker: I am current in my loan status! They've gotten ALL of their payments now, plus late fees! Yet today I get an email telling me that I'm in default of the agreement!

These people are as shady as they get. I'm adding my recent correspondence here to maybe give people an idea of how they act and how to respond. I attached my bank statments to my email to show them proof of payment.

You must include any additional payments or late charges that become due, along with the amount shown above, to bring your account current. CashCall, Inc.'s acceptance of less than the total amount due does not waive our right to demand the entire balance due under the terms of your contract.

If you fail to bring your account current within 30 days of the date of this letter, we may exercise acceleration of the loan and demand the entire balance outstanding under the terms of your loan agreements. This amount includes, but is not limited to, principal, interest, and all other outstanding charges and legal costs. We will start legal action to collect these amounts. You will have the right to bring your loan current even after legal action has begun.

We want to work with you to resolve the problem and help you bring your account into good standing. We urge you to contact our collections department at the toll free number (866) 899-1844; we will be happy to discuss possible solutions to the delinquency.

This communication is an attempt to collect a debt and any information obtained will be used for this purpose. As required by law, you are hereby notified that a negative credit report reflecting on your credit record may be submitted to a credit reporting agency if you fail to fulfill the terms of your credit obligations.


I wrote back:
Dear Cashcall Customer service,

This loan is current. Attached is a statment reflecting payments taken May 1, 2007, May 18, 2007 and June 1, 2007 in the amounts of $199.02. NSF fees in the amount of $44.00 were also debited from my account the prior week.

In the past, I have been in better communication with you if a payment was to be made late. Due to the lack of coordination between your departments, my contact with you made no difference. I was lied to and told that payments made late could only be made via moneygram. This apparently is not the case, since it was debited from my account anyway. Even after payments (albiet late, with warning they would be) were made, my phone number remained on your auto dialer.

It was especially inappropriate when my account was up to date and I recieved 34 phone calls in 72 hours. In those 72 hours, I was burying my father and called your "customer service" to let them know that a) the bill was paid and b) this was a horrendous time to be calling and harassing me for a payment that HAD been made.

Considering how inept all of your departments are in coordinating information, I have no desire to answer my phone or speak to any of your reps. You will always get your money, whether late or on time, you will get it. I fully intend to pay this loan off. Sometimes things happen that means a payment has to come late. It's called life. If I were in a situation where I never had to make a late payment, I never would've taken out this loan in the first place.

Calls to my workplace are at this point illegal as I have asked you not to call here, my office manager has told your people not to call as have others. At this point, you are harrassing others in a place of business and that IS illegal. If you need a quote on the specific law, I'd be happy to obtain that information for you.

Now, this loan IS current. Please get together with your other departments and figure that out. Payment for June will be available on June 15, 2007.
