CBCS is threatening my credit report unless I submit a bogus payment of $191.00. They refuse to send me any form of itemized bill and are referring to an account closed 7 years ago in good standing (no outstanding debt). I have informed them that I've filed reports with the following agencies: BBB, FTC, and the FCC. I have also invoked the Florida statue of limitations (F.S. 95.11(3)(p) on 2 occasions. Their response is: "We'll see about that". There is no outstanding debt and the company is using extortion to get my financial information. If I do not pay it goes on my credit report, if I do pay then I forfeit my account information. I think these are some clever wise-guys but what do I do? I don't like the threatening tone one bit either.

HOW ABOUT A MONEY ORDER? Cashiers CHECK?? You dont have to give out personal info, and you are not GIVING IT OUT, YOU ARE VERIFYING IT because sadly but true, WE ALREADY HAVE ALL OF THE INFO on you, maybe not recent phone number and adress, in which case how are you requesting a letter of validation and you cant VERIFY THE ADRESS...

Call your bank or credit card company and TRY TELLING THEM THAT - send me a itemized bill, but i wont give any of my information.....

SOunds like a real braniac!!

Actually the statute of limitations only applies to the credit reporting. There are only a handful of states (Florida is not one of them) where they debt is completely wiped cleaned and cannot be sold to other agencies. Unfortunately, Florida is not one of those states. Again like many others on here making accusations against companies I would like to mention that any false accusations against CBCS (or really any company) could land you in court due to sander and false accusations.

You are responsible for finding out more information on the account like original credit, service address, service dates, etc.

The OP states that the collection agency is saying that unless the OP pays the debt that it will go on their credit report. I would think it to be a form of extortion also in the way it's stated. But I could be wrong.
I get the impression that the OP never had an outstanding bill from whoever CBCS is saying it is from.

Steve, I don't want to take the time to disprove your statement, but I HIGHLY doubt that threatening to turn a debt over to a collection agency constitutes extortion under ANY state's laws. If you can prove me wrong, PLEASE do so, because I would love to have that law in my arsenal.

Actually, under Florida Law, that is extortion which is a felony. File criminal charges.

If you can prove that they threatened to damage your credit report unless you made that payment, that is the definition of extortion under Florida law and is a felony.

In addition to Faron's good advice, be sure to indicate that you dispute the item in your validation request, as this statement gives you more legal rights under the FDCPA and forces them to stop all collections actions until the item is validated.

Negative credit reporting is considered a collection action, as they are reporting a "collection". Look at it like this. If someone has to stop all collections actions, how can they report a collection action? They can't.

As you know, That account is NOT legally collectable as it is past Statute of Limitations for collections actions which is 5 years in FL.

They cannot legally do anything to you and they know it. That's whay they are getting so nasty.

Just send them a CEASE COMMUNICATIONS request by certified mail, return reciept requested. Be sure to put the certified # on the letter itself, and keep a copy for your records. This procedure is very important. And, do not sign the letter, just print.

I would opt for the cease comm over the debt validation request.

By the means above, also send a letter to the legal dept with an intent to sue, and file criminal charges for extortion. Harass them some. Have fun with these morons.

Most important, STAY OFF THE PHONE!!!

NEVER speak to any third party debt collector on the phone!! NEVER!!

Send them a certified letter, you must not do this over the phone..because you want proof of your request

Send them a request for debt validation (google it on the web for an example). You also should file a complaint with the State Attorney Generals of Ohio and Florida. If they still refuse to validate it; you have some leverage in talking these scumbags to small claims court, which I would file action on them on this if they continue to bother you and especially if they put this on your credit. Do not communicate with them on the phone.

You notice it's not getting anythng accomplished by doing so, which is why everything must be done in writing. If they do put it on your credit report, send all three letters stating this claim is invalid because it's past the statute of limitations and send a copy of your validation letter request and any written answer you receive from them (if any).
