I had a van financed through chase auto finance. Last year my husband and I were involved in a head on collision accident. The other guy was a fault and he admitted it to his insurance company that he hit us head on. I still owed 13,000 on it and I was current on my notes. Well when the guy hit us I didnt have the money to pay the monthly notes. I reported the accident to chase like I was told to do by an attorney. They had the nerve to ask me when was I gonna make a payment on the Van. They were so rude didnt ask if anyone was killed,hurt or anything. All they were concerned with was the following months payment. My husband and I were injured and we couldnt work so we missed days. We barely had money to live off of. The harrassing phone calls started and when I told them we didnt have the money to pay for something that was already totaled they got nasty on the phone with us.

The insurance company paid fair market value for the van and it left me with a balance. They called saying that eventhough the Insurance company paid for the van they were still expecting me to pay the monthly note as if the van was still in use. I told her that I couldnt pay for the totalled van plus pay for another vehicle also. She told me that wasnt her problem and for me to send something in anyway. I didnt and the calls kept coming in. Well Chase had the audacity to send someone to my home demanding a payment. I didnt know who he was so I spoke to him through the phone. He got a attitude because I didnt invite him in. He then demanded that I get on the phone with someone from collections and immediately speak to her. I told him no for her to call me. He stayed at my front door until I picked up my phone. I had to end up slamming the door on him and threatening to call the police if he didnt leave my property. he asked me how could I live in a big house pay my mortgage and not pay them. My mortgage is first and foremost. Anyhow the collections lady then demanded that I call gap insurance and file a claim with them. I did and it was turned down.

Anyhow they ended up sending it to collections and putting it on my credit report. I thought ok three thousand dollars ok whatever I will pay it when I get it. The collections department started sending me thratening letters saying that when I go to file my income taxes they were going to keep my refund check. I know that wasnt true because creditors arent allowed to keep refund checks. They harassed me on the job and made my life a total hell. I went to get financing for a New Vehicle and was told I couldnt get the 08 that I wanted because chase had put on my credit report that it was a repo charge off insted of a charge off. I only qualified for a 2002. When I called chase to dispute the repo she Bianca got argumentive with me and was real nasty on the phone with me. She wouldnt answer any of my questions and she wouldnt let me speak. I had to end up hanging up the phone in her face because she was so rude. Anyone who I know I will not reccommend chase at all to them. They are a bunch of scam artists and rip offs. Now I have to go through the three credit companys to dispute the repo that chase has on my report. How is it a repo when it was totalled in an accident.

FYI About Tax Refunds

Creditors don't "keep" a tax refund check. What creditors can do is sue you and once they have a money judgment against you, they can attach a levy to your tax refund (if any) so that the State will send the tax refund to them to offset the judgment against you. If they sue you in federal court, then they can attach a levy to your federal income tax refunds.

You will not be successful. It was a repo because you did NOT pay off the loan-just that simple. Your obligation to pay the loan doesn't rely on the driveablility of the vehicle. In this case, they repossessed a wrecked vehicle.

Since we seem to have a credit "crisis" going on, perhaps Congress will change the ECOA (equal credit opportunity act) so that lending decisions are based on a more fiscal criteria as it used to be decades ago. It used to be that if you didn't put a substantial down payment on the vehicle, the lenders simply said NO to your loan application.

First off, just because the car was totaled doesn't mean you magically get released from your contractual obligations with Chase. Nowhere in your contract does it state that you're required to make monthly payments UNLESS your car is totaled due to a not at-fault accident. During the coarse of a GAP claim your account still comes due with new monthly payments and if no payments are being made by the customer for whatever reason your account is just getting further and further delinquent and therefore affecting your credit more and more. It sounds like your account was already deliquent when the GAP claim was filed therefore the GAP company was unable to complete the claim per their requirements and the account charged off. It's either that or the company was too slow and the account charged off before the GAP company completed the claim. Nevertheless, neither one is Chase's problem so don't blame them. It all comes back to the contract you signed saying you'd make on-time monthly payments no matter what, you didn't so you get what you get.

First, I hope you are OK after the collision.

Technically it was a repo because your insurance company did not pay off the entire amount you borrowed and you still owe the balance. Say you still owe Chase $8000 and the insurance company only pays them $5000. Why should Chase lose because you were in an accident? They still want the $3000 remaining balance.

That is what GAP insurance is for. To pay off the balance owed instead of only what the car is worth.

GAP insurance is offered when you purchase a car, or sometimes by your auto insurance carrier.

Since you didn't seem to know what it was, check your auto paperwork. Maybe you elected the GAP coverage and do not realize it. See if you paid for it.
