My loan was assigned to Chase in February of 2002. Chase contacted me in December of 2003 offering me a loan modification. This sounded good to me because I was struggling due to a horrible payment plan they offered me when I had fallen behind in May of 2003 due to an illness. At that time, they took me from paying $710 to $1,310. In hindsight, this is when I should have gotten an attorney involved.

I was given the particulars of my new "loan modification" by a Chase representative and was waiting to receive the papers to sign. I waited six months! I called and I called and I called again. I finally called a lawyer. Once Chase received his letter, they responded to me. They responded by telling me that they would not give me the modification that "I" had requested, and that I should find a way to either pay off my entire loan or get financing elsewhere. I was in shock!

Little did I know, this was only the beginning. What Chase failed to tell me was that, while I was waiting for my loan modification papers, they had commenced foreclosure proceedings against me.

On August 6, 2004, I received a letter from Chase's attorneys stating that my home was going to be sold at an auction on August 30th. They suggested that I contact either their office or Chase if I did not wish this to happen.

I wrote a letter dated August 20. I sent it by Express Mail to Chase, their attorneys and Fannie Mae, the investor. I outlined the details of this surreal situation and stated that I hoped we could reach some kind of solution. I was thinking that this just had to be some kind of mistake. The next thing that happened nearly gave me a heart attack.

I received at call at work from the concierge of my building on September 7, 2004. She told me that a man was there at the building trying to pin up a sign saying that the bank had foreclosed on my loan (an agent from Fannie Mae). He was going to pin a sign on my door for all my neighbors and friends to see. I was nearly hysterical at my desk. The concierge persuaded him not to do this -- my daughter and I have lived in this co-op for over 10 years.

I called Chase and they continued to tell me that they were going to work something out. I received letters from them telling me that they were working on a solution to the situation. And then I came home from work on October 20th, my daughter's birthday, to another notice.

This time they had made it to my door with a "10 Days To Quit" notice. I called again and again to ask what was going on and was told that by every representative I spoke with that "we're working on a solution." And then, I received more papers at my door. I was beyond humiliated at this point. This set of papers was summoning me to court.

Once I settled down, I realized that this might be positive -- at least I would get to explain what was going on to someone other than Chase, their attorneys and Fannie Mae, who all seemed to be ganging up on me like I stole something from them.

I was given an adjournment by the judge during which time I should return with an attorney. We filed an Order to Show Cause and an Affirmation stating the facts, including all the correspondence involved.

So far, we have been successful in turning Chase and Fannie Mae into the Defendants, and I am now the Plaintiff. Our case will be held shortly, in the Supreme Court of New York State -- that is if the Defendants don't try to settle first.

This is the worse thing that has ever happened to me in my life! Who would have ever thought that Chase was such a scandalous corporation? I recently began doing some research to find that there are class action lawsuits all over the country against this corporation. I was amazed by the scathing review that the Better Business Bureau has given Chase Manhattan Mortgage Corporation.

Once this is over, I want nothing to do with Chase ever again. I'd discourage my worst enemy from falling in with these criminals.
