I had a check written to a grocery store returned for insufficient funds. Okay, Checkcare systems received it, called me and ASKED me if the funds would be available because the check would "run back through" my bank. I explained to them that it was enough to clear the amount of the check, but will they try to collect the $38 service charge also at the same time? Checkcare told me that "yes, both transactions will try to clear, but they had no control over that".

So, I just waited to see. Well, the check cleared, and of course the service charge didn't. So, Checkcare called me 3-4 times within a week's time stating that "I needed to come in and take care of the $38 service charge." I called them on a Friday telling them that I would be in Monday to pay it and asked them what time they closed. I went in Monday evening around 7:00 PM and paid Checkcare $38 cash, made sure my account was cleared and got a receipt. I woke up Tuesday morning to find my checking account was overdrawn!!!!

Now, I'm thinking WTF? so I see an ACH debit from CHECKCARE for $38!!!! Okay, now I'm livid!!! I waited until they opened and called them at 9:00 AM. After speaking to 2 people (cursing out one of them) I was told that Jill Lewis would call me back. I'm at work and I'm waiting and ready to drive back 30 miles to meet Ms. Lewis to find out what the hell is going on. When I did finally get to speak to Ms. Lewis, she informed me that "they probably didn't know the transaction was getting ready to go through since the "computer" automatically does it!"

I explained to her that this isn't the first time I dealt with them and that they have called to inform me that a transaction is about to go through, so they wanted to check to see if the funds would be available. Ms. Lewis said that they "never do that!" I explained to her that I had come in and paid the cash, that I should have left in my account since after they withdrew their money, it caused 2 items to bounce and now my account was overdrawn $70 because of them AND they have been paid twice.

All, she told me was that they would refund my $38, but I would have to wait until Friday when the "checks were cut!" I was about ready to reach into the phone to grab her! So, now I'm going to be overdrawn $105 ($35 x 3 transactions) that should have cleared because they only totaled $28, but did since CHECKCARE SYSTEMS took $38 from my account AFTER I had spoke to them and told them I would be physically coming in to pay.

All, they could say was that it was their "legal right" to debit my account. Well, I wasn't arguing that, I asked them was it their "legal right" to do their d**n job, which would have been to inform me when they called that this transaction was or might go through again! H*ll, I would have waited a few more days before I ran to the bank, took money out to pay them physically, if I would have known they were going to debit my account anyway!!!!

Violation of Fair Debt Collection Practices

To the points made by the ex-employee, I spoke to Jimmy Lee at CheckCare today, and in that conversation he violated the Fair Debt Collection Act a number of times, for which I filed complaints with the Better Business Bureau and with the Consumer Financial Collections Bureau.  His violations are as follows:

Calling my mother and telling her I had bad checks.  A debt collector is not allowed to disclose the name of their company or the reason for their call to a third party.

Calling me a theif, accusing me of stealing, and threatening arrest.  These constitute harassment under the Fair Debt Collection Act.

Continuing to call me repeatedly after I asked him not to contact me again.  When you request that communications cease, the collector has to abide by that accordinng to the Act.

Not providing me with proof of the debt and giving me 30 days to respond. 

These violations of Federal law deserve attention and action.

I am suprised that this Company is still in business considering its "tactics".  I am an ex-employee (not disgruntled) and I was amazed every day about the illegal things that went on.  Just to name a few- collectors used fake names, Credit card numbers were kept on paper in binders to charge people, clients were not paid on time, and so much more.  This Company collects in States it is not even licensed in (the only state they are licensed to collect in is Georgia) and tries to charge above the legal limit (please inform yourself on your states limits).  Checkcare has no legal department, frankly they only have a few employees so by telling people they are calling from the legal department and intent to "put someone in jail" is just not true- and also illegal.  If you get a call from CheckCare (Jimmy Lee also an AKA for the owner) I would suggest you get whatever is being told you owe in writting.
