covers repair or replacement of the vehicles tires and wheels in the event
that the tires or wheels become unserviceable due to a road hazard during the
term of the agreement. The policy terms clearly stipulate that damage caused by
driving on tires that are not inflated is an exclusion.
The customer submitted a claim for a damaged right front tire and right front wheel
on February 21, 2012. As part of the claim process, his service advisor at
BMW of Manhattan was asked to provide photographs of the damaged parts.
Upon review of these photographs, Auto Knight concluded that the wheel had been
damaged by an impact. This was determined by scuffing and a significant bend at
the point of impact that was severe enough that it would allow air to
escape. The customers wheel was then authorized for repair and was successfully
repaired.
The tire photographs showed no impact damage at the point of impact or elsewhere on
the tire. The customers service advisor was also unable to identify any tire
damage caused by the impact. The only damage to the tire was a cut all around
its circumference parallel with the circumference of the wheel. The nature
of this damage is consistent with a tire being driven on with no air pressure
for an extended period of time. In these situations, the damage is caused when
the wheel cuts into the tire as it rotates. This is why these types of cuts
will appear as one single and even line all around the tires sidewall.
Based on the damage to the tire and wheel, we concluded that the wheel had lost air
after initial impact and that the tire had been subsequently damaged as a
result of being driven on flat. Per the terms of the policy, a tire damaged
because it was driven on with no air pressure is a non-covered item. As you can
appreciate, insurance companies do not pay claims for activities that are not
covered by the policy.
Since our founding in 1984, our company has been dedicated to total customer

P.S. We are curious about the validity of this complaint based on the fact that ClassicTrak tire and wheel warranties are neither offered or nor sold in New York State.
