My wife and I recently stayed at the Clipper Ship Inn in Salem, Massachusetts. It snowed while we were there. Two days after the snow had stopped we were surprised to see how poorly the staff cleared the snow and ice both in the parking lot and outside the doors and walkways. (Amazingly the handicapped ramp was half shoveled and then left alone.

Three days after the storm I was heading to our room with my wife and two children. I was carrying my laptop computer in its case when I slipped on ice on the walkway leading to my room. I landed on my elbow and banged it up pretty good. I didn't think it was that big of deal. I went to the hotel office and told them what had happened. She said one of the workers (Jason or Justin I believe- not sure) told her he had shoveled all the walkways and salted the ice (again this is a few days after it should have already been done). The lady at that point came over and salted the danger areas herself (a little late if you ask me).

After checking out of the hotel I informed them I would be talking to a lawyer and pursuing this legally unless they refunded the cost of the room for the week and $225 to repair my computer (damaged from the fall). They offered to fix the computer themselves (I wanted a professional to do that). They can't even shovel a walkway, why would I let them fix my computer. Well after a month and a half I'm glad I didn't settle for so little. My elbow has a knot where I fell on it and I don't know if it's going to go away or not.

I would have already settled this in court but for the simple fact I live in North Carolina. I do have to travel back and forth quite a bit to Mass. so I will have my day. The one thing that made me so angry was the lady's attitude when I informed them of my intentions was "how do I even know you actually fell". Are you kidding me? I have three witnesses beside myself and I was bleeding in her office a few minutes after it happened.

I will seek in court the maximum I can get now. I would have settled this for $700 back in January but now I want justice so they will smarten up before someone else gets hurt worse than me.

The other thing that bugs me is the computer is brand new and I actually bought three (3) Toshiba laptops back in December at Office Depot in Salisbury, NC. I spent over $1300 and because I didn't buy the extended warranty Toshiba said it's not covered. It needs a new screen (hard drive still works) and Toshiba told me they would fix it for $425. I only paid $459 for it!! LOL Gee thanks a lot. Needless to say I'll never buy another Toshiba product again. The other two laptops were for my children. I'll never buy another Toshiba product for them either.

I'll address the last two posts. As far as posting a canceled check on here, how will I do that when the check wouldn't be made out to me? As far as any of the people on here who have nothing better to do than worry what happens between the motel and I; I really don't give a darn whether you know the outcome or not. There's only two outcomes as far as I'm concerned. Either settled with my computer being fixed and River Shelter gets $3,000 or we go to court and we'll go after whatever amount my lawyer sees fit. If he thinks we can get more then I will donate that
amount as well.

Responding to "counter suit" LOL I know the situation, you don't. I'm certainly not worried about that. Are they going to sue me for damaging their walkway when I fell on it? If their is surveillance video, I'm sure they "lost" it. They don't want that being entered into evidence.

Whenever someone is considering a civil complaint he/she should consider two very important words:  counter suit!

It will be interesting to review the outside surveilance video.

Whatever a jury will award me is what I'm suing for.
- That's not how it works.  You don't go into court saying give me what ever you want.  You file a suit and specify the "damages" you are claiming.  As for a jury, are you really going to go through the expense of a jury trial rather than small claims?  With what you have posted here no attorney is going to take a case like this without a huge retainer, and unless you prevail it could end up costing you several thousand dollars.  But if you want to..go right ahead no one is going to stop your gamble.

While I think you may have prevailed in court the more you post the more your "attitude" becomes apparent.  If you show this same attitude in court the chances of you prevailing are going to be very small.

If it wasn't for the smug attitude I wouldv'e already settled this

- Again their smug attitude probably came from your attitude of saying give me a free week and money to repair my computer or I am going to sue.

All I want is my computer fixed and the motel can donate $3,000 to the River House Shelter in Beverly, MA. That's what I think about the money. Anyone wants to pin "it's about the money" on me can stick it. It couldn't be further from the truth.

- Okay file suit and post the information here.  Then post the result and a copy of the cancelled check showing that you donated the entire amount of the judgment to the charity(of course blocking out all of the personal information).


By the way I have not worked for this or any hotel.

What I sue for?

Whatever a jury will award me is what I'm suing for. How can anyone defend a motel/hotel
that doesn't shovel snow or clear paths that are going to be walked on constantly? I come from
that had several family businesses where the public came in and out. We cleared those paths and
walkways not because we were obligated to, but because we actually cared about the safety of our customers. How anyone wouldn't do the same is beyond me. Two days isn't adequate time to
make the walkways clear? What a joke. These responses are only making me more angry as I truly believe they are coming from the hotel itself. I will not be willing to settle out of court now and they
can see the evidence when we get to court. Pictures (walkways and my injuries will paint a picture
that will show negligence). If it wasn't for the smug attitude I wouldv'e already settled this. I'm not
in this for the money in the first place. I don't even need the money. It's all about showing
the motel they need to care about their customers more. In fact here's how much I care about the money. All I want is my computer fixed and the motel can donate $3,000 to the River House
Shelter in Beverly, MA. That's what I think about the money. Anyone wants to pin "it's about the money" on me can stick it. It couldn't be further from the truth.

Attitude..

The one thing that made me so angry was the lady's attitude when I informed them of my intentions

Your told her that your intentions were to seek a lawyer and sue them unless they refunded the entire week and pay to repair your computer.  Exactly what attitude were you expecting her to display?  Perhaps you were expecting her to bow down and cry at your feet begging you not to do that.

When someone says something along the lines of do what I want or I am going to sue you, a lot of people will see that as "blackmail".  So her attitude could be seen as understandable.

 It is part of a business' responsibility to ensure the safety of their customers.
- To a point, there is still some responsibility a consumer must excercise.

As was mentioned by others the sad part of this is that if you do sue you may actually prevail.  So exactly how much are you going to sue them for?

If I understand you correctly...you stayed at this motel (it's not a hotel)?

May I presume that you entered and exited the motel room on more than a few occasions and did not fall down.

By your own admission, you knew "how poorly the staff cleared the snow and ice both in the parking lot and outside the doors and walkways".

After checking out of the hotel you informed them you "would be talking to a lawyer and pursuing this legally unless they refunded the cost of the room for the week".

Just want to make sure that I understand this correctly.

Yes clumsy

As a person living in the north, I have walked on many slippery sidewalks and have even clumsily fallen down a few times. However, it never occurred to me to try to get rich because of it. I was always just annoyed with myself.  It's just part of living in cold country, not a get rich quick scheme.

Of course I am accused of working for the place, that's what people always do when they don't like rebuttals.

Toshiba fixing for free?

Excuse me but where did I say I expected Toshiba to fix my computer for free? I said they wanted to charge for a new screen what I almost paid for a brand new computer. I found a few places that would charge me a little over $200 which I will pay on my own. See if you can follow this. If you bought a new car and the transmission blew and you wanted Toyota or whatever

manufacturer built it and they wanted to charge you what you paid for the whole car, how would you feel? You sound like an idiot with such a foolish statement.

Clumsily?

I fell on a sheet of solid ice outside my doorway that wasn't salted or shoveled. I had my hands full carrying my computer and my two young children's luggage. Without you seeing the conditions I had to walk in you have no right to comment about how 'clumsy' I am. You make yourself look like a fool making a statement like that. It is part of a business' responsibility to ensure the safety of their customers. I wouldn't at all be surprised if you were the very rude lady that worked there.

I don't get it

Part of of learning how to live is being able to walk in all kinds of conditions.  The walking surface is not always absolutely smooth, level and flat with proper non-skid in place.

So because you are not capable of navigating on a slippery sidewalk (there are lots of those in the winter) you clumsily fell on your a*s and now want to blame someone else and get rich.

You should be embarrassed because of your clumsiness but instead you are trying to use it as a way to get money.

The sad part is that you may succeed.

This is one of the more pathetic aspects of our country.  You should be ashamed of yourself but you probably are proud.

Toshiba?

  Since when has a factory warranty covered damage to a dropped computer?  Can you think of any electronic product that you can damage and still be covered by the manufacturer's warranty?  Hint : Warranties cover manufacturing defects.   Some retailers sell additional coverage that covers accidental damage, but you elected not to purchase it.   Why do you think you're entitled to have your computer fixed for free?
