I wish to file a formal complaint with your office against Cloud Nine Professional Business Solutions, LLC of Las Vegas, Website: www.cnpbs.com

Here are the facts:

I was called Monday evening 7/31/06 about 7:15pm, CST, by someone at Cloud Nine Professional Business Solutions of Las Vegas, www.cnpbs.com, and was solicited by phone by someone named Rick, to purchase their services of "placing my website at the top of any web searches for any Key Phrases I purchased." My computer consultant told me last week on Wed, 8/16/06, that doing this is fairly impossible.
So have several others.

The price quoted was $995 per Key Phrase, but it dropped to $895 per Key Phrase if I got 5. I asked for the phrases, "XanGo," and "Mangosteen," but they said they had just been purchased an hour ago. They said they have customers at XanGo, Noni, Herbalife, and some others, and "have a customer retention of at least 90%.."

Next, a young lady named Fiona came on the line. She had an internet demo chart which showed the "Value" of each Key word. Fiona guaranteed that each Key Word would result in my site being viewed 12,000 in the next 6 months. We went through more Key Phrases, and I selected 5, which showed High "Values." Health showed a "value" of 4.5 billion, Health Business showed 2.37. billion, Home Based Businesses showed 1.3 billion, and Heart Health showed 400 million. I purchased these 4 and one other for the sum of $4,475.00 for a period of 6 months.

Wed night 8/2/06 I was called by a friend in Georgia, saying that one of her downline was called by Cloud Nine Professional Business Solutions and was solicited by them to purchase their services, and that in their pitch, they said that "Ed Johnson, one of your company leaders, had just purchased 5 Key Phrases from Cloud Nine Professional Business Solutions." She asked me for my Key Phrases, and entered each of them on Google, and my website did not come up on any of them.

Wed night, 8/2/06 I called Cloud Nine Professional Business Solutions and left a message on 877-388-8481 x300, and I left a voicemail message stating
I am terminating the agreement based on fraud, lack of consideration, and deceptive trade practices, since my website did not even come up when I entered any of the key phrases. I further stated that I am an attorney, and a former Assistant US Attorney who served under William S. Sessions, and that I am furious with their company, and would report them to the Attorney General of Texas, and that I felt that I had been fraudulently been ripped off, and I have contacted my Credit Card people to contest the transaction, based on fraud, lack of consideration, and deceptive trade practices.

On Friday, 8/4/06 I was called by Murrell Sailer, Director of Operations at Cloud Nine LLC in Las Vegas today (702-804-5759). We initially has a very heated discussion, based on the message I had left on their voicemail, and the way that I still felt, and I told him that I do not appreciate my name being used without my consent, and that I did not want my name being used in their solicitations to induce other XanGo distributors to buy their services.

I also said that when I went to Google, and entered my Key Phrases, my website did not come up, and that I feel this is fraudulent operation. He explained that they are a large and very reputable company, well thought of all over the US, and that all I had been told by his sales people was indeed true, and would show me that. He explained that they would indeed do all that was promised. IN hindsight, this appears to me to be a clearly fraudulent operation, that engages in deceptive trade practices and defrauds consumers.

On Friday, 8/4/06 Murrell Sailer had a young lady named Sam (Tel: 877-388-8481 x600) call me. She guided me through the back office of www.cnpbs.com and showed me an "Activity Report" indicating that in the last 2 days about 400 hits have occurred on each of key words linking to my website.

Sam said that "the reason that I could not see my website coming up because I needed to upgrade my computer in order to be able to see my website when my key words are entered." This sounded very strange!! She put me in touch with their Computer Tech, William, who sent me to the following website: www.creditsolutions4life.com. He told me to click on: Click Here To Upgrade Your Browser & Find Our Site Faster.
William said that the upgrade installs "Frame Ethnology" which apparently allows people to do searches faster and easier.

After I clicked on the link, and elected to "upgrade my computer to the I Frame Technology," I went to Google, and entered each of my Key Phrases: Health, Health Business, Heart Health, and Home Based Businesses, and my site came up first on each one. When others I know tried it, they did not come up. The only came up on my computer which by now had their own special "I Frame Technology" software installed. I was later told by a consultant that this is actually spyware.

In fact, no one else who has tried it has seen my site come up. Several consultants have told me this definitely sounds like a fraud. On Monday, 8/17/06, at 6:50pm, I went to the "Tracking Section of my "Back Office" and found a total of 10,746 so called "hits" reported, however not one person of this "reported" 10,746 "hits" has contacted me, or sent an email, or responded in any way. As strong as my website is, I find it quite hard to believe I've not had even one inquiry from even 1 person out of about 10,746 supposed "hits." I am now quite convinced that Cloud Nine LLC of Las Vegas has an auto responder generating junk "hits" on my site from these 5 key phrases to generate these reports. I believe that this fraudulent operation should be exposed ASAP and shut down ASAP, before other unsuspecting MLM'ers are hurt.

I was charged $4,475 for these 5 key phrases, no small charge!! They "claim" that "22.7 million people have upgraded to their 'I Frame Technology' software on their computers" and are able to view my website when they enter any 1 of the 5 key phrases I purchased for the next 6 months, from 8/1/06 to 1/31/07." They claim that "millions of others with newer computers can also see my website when they enter any of these 5 key phrases." If that is indeed true, then why have I not had one contact from the supposed 10.746 "Hits" as of 8/21/06?!!

I have already put my Master Card Company on notice that I strongly believe it is a fraud. They asked me to keep them advised. I have been out of state for several days, but tomorrow I am filing an affidavit with my credit card company, contesting these charges, as being made as a result of fraudulent inducements, material and fraudulent misrepresentations, and deceptive trade practices in violation of the Texas Deceptive Trade Practices Act.

When I informed Murrell Sailer, Director of Operations at Cloud Nine LLC in Las Vegas on Friday, 8/4/06, he went ballistic, and said they are a Nevada Corporation, and not bound by Texas Laws and they have a good reputation with the Chamber of Commerce and the Better Business Bureau. I pointed out to him that his company is soliciting in Texas and made a sale in Texas to a Texas resident, and that I would report his company to the Texas and Nevada Attorney Generals, and to the Better Business Bureaus of Texas and Las Vegas Nevada.

I am relating these facts to warn other MLM'ers about the sales tactics, and what I believe to be very fraudulent and highly deceptive acts and trade practices. I will pursue Cloud Nine Professional Business Solutions of Las Vegas in court if necessary, however, I believe that the Attorney Generals of Texas and Nevada (and other states may beat me to it!!
