A few weeks ago, I went to my bank to get some cash to go to the grocery store. I asked the teller if I could have my account balance. She gave it to me and to my HORROR, it was over $8000.00 overdrawn!! I asked the teller what was going on, She had no idea and referred me to the CSR...she tapped a few buttons on her computer, wrote down a phone number and told me to call the number. I asked what number it was and the CSR said rather rudely, that it was for Cohen & Slamowitz a law firm. I was like ummm ok..the CSR would not give me any further information..like it was top secret...This is MY money we're dealing with here I want answers...I contacted the firm and informed them that this debt was not mine..they told me that the burden of proving whos it is was my responsibility and they told me it was for a credit card I had quite a few years ago and that the freeze on my bank account was legit. I told them that I was never served or notified about this and they told me that someone served me at my apartment..which is not true as the date i was told I was served was on a SUNDAY!! LIES!!! I further inquired if they had a name of the person who accepted the notice...suprise, suprise, they had no name on file but, a rather vague discription of just about any male of hispanic decent(which I am not, nor were there any living in the apartment complex at the time). SO, who exactly did they serve?? I have yet to get to the court and file an order to show cause and obtain the affidavit of service they claim they did however, its a little difficult when you have no mode of transport and the court is an hours car drive away!
Bottom line is, this "law firm" ( and i use the term very loosly) apparently is a habitual offender of Fair Debt Collection Practices Act.
Its absolutely appalling that this firm can lock a bank account with absolutely no notification what is so ever and financially cripple people..As of this moment, I have Zero dollars to my name, lost a job because I could not pay the car insurance, on the verge of being thrown out of my home, and almost no food in the pantry.
THESE PEOPLE NEED TO BE STOPPED!!!!

You need to get as much evidence against them and file suit. These "people" think the "the tribe" will protect them. But since they are all cowards there will ne nobody there to back them up, they think that anyone whose pockets they go into that they will not fight back....But I did and found that they were the cowards that I always knew they were.
Just make sure that you fight back and take down more members of the tribe! You can and WILL win!

Well hello all, just giving a update on this most heinous situation...I managed to file my paperwork with the court..Order to show cause and such..It was signed by a judge and goes to court this Tues 03/02..hoping for the best! will update after court

Ok as stated in my earlier update, I did all the research..got all the necessary forms filled out for the court, obtained all the necessary copies however, unfortunately, have not been able to get to the court to file them. I just got a letter in the mail from Cohen and Slamowitz stating that the judgement has been paid in full. I am at a loss here am I still able to file my paperwork now that they have MY money????

OK, I have managed to pay the court a visit (thanks to a very good friend) and obtained the judgement file through the court clerk. According to the affidavit of service, I was allegedly served June 2 (while the description is way off and clearly not me) however, it was filed with the court June 5. So, from what I understand from what I have been reading, this constitutes improper service? I would love to be able to hire a lawyer however I just don't have the cash for retainer fees as my account is frozen and I no longer have a source of income. I really need some help here

These two debt collectors are using their law firm and bottom feeder agency to buy, collect and file lawsuits on. Located in Woodbury, NY, the debt collection law firm of Cohen & Slamowitz and Gemini Recoveries, Inc. This is typical of lawyers buying old, mostly worthless accounts and filing lawsuits so they can make money off the misery of others.
The problem with these type debts is that they must be proved in a legal venue. Consumers are warned that bottom feeders, such as Cohen & Slamowitz, aka Gemini Recoveries have a VERY difficult time in producing the correct legal documents. Any suit should be challenged, make demand for all documentation that validates their claim. Do NOT accept anything other than original documentation, containing your signatures. Make them prove what the annual percentage rates are legal, i.e.; proof that you were notified of the prevailing rates y the original creditor and that it was a part of the cardholder's agreement.
NEVER, take a default judgment from a bottom feeder, make them show up in court, always answer a summons. If you need assistance in dealing with these bottom feeders, I recommend you talk with a REAL lawyer by contacting a consumer law professional from: www.naca.net
CAUTION: I recommend you NEVER disclose your bank account or credit card information to a debt collector, as you risk them emptying your account, or maxing out your credit card.
