I was sold an iPod Touch "New" which the owner, Hamidur Miah, told me was "sealed retail" and current gen, it was in the original box and had packing tape to seal it, but I didn't see this until I got home. It was the kind with the picture of John Lennon which turns out are first gen, not fourth gen. I get home after paying $250 for it, when I could have got a new 4th gen for that much.

It was obviously used, it was missing the cleaning cloth and manual, the earbuds were tangled and just thrown in there and had some earwax on them, and the screen was scratched. And it didn't have the speaker or voice commands or any of the stuff the new ones have. I went online to verify this, then called them and the salesperson pretended not to know me.

I went into the store and I was then told that they knew it was used and told me that. They didn't they told me it was new and the most recent kind. They then pointed to some sign they have up saying "no returns all sales are final" but it didn't say anything about their policy on lying about an item saying its new when its clearly used, and lying about what the item is.

They refused to give me my money back, and the owner actually yelled at me. So now I'm stuck with this piece of junk and am out my money.

I googled the owners name and it turns out he has a huge criminal record, if you google "hamidur miah" he is actually on a ton of legal websites as some example of some federal court thing which was decided against him and he was ordered deported for violating his student visa by opening a store, then getting charged with receving stolen property, several DUIs, refusing a chemical test, disorderly conduct, and more. Had I know this I would have never trusted this man with my money.

I don't know what else I can do but warn others. Stay far away from this place. He uses a fake name on his busines card Syed Mia but it says in the federal case that is one of his aliases.
