I attempted to lease a 2013 Cadillac ATS from Coulter Tempe on March 30, 2013. After about three weeks, I contacted the bank to check on my payments and they had no account. Ally bank suggested I did not have financing and I should contact the dealer.
I contacted Ken Bowers and he said he was not at work, but would look into the matter. I felt bad because it was his birthday. The following evening he called me and said there was a change in my lease and he was not sure of the details, but I would receive a call from Peter St. John about the matter.
Peter St. John called me that evening to tell me they had made an error and since I purchased the Smart Lease Protect product, Ally bank rejected the document because Coulter erroneously charged a $625 security deposit that is no longer required. He informed me the payment for my 36 month lease would change by $1.10. I asked him what happened to the other $590? I would like that back. He then stated, "if you want to renogotiate your deal you have to talk to sales." He said he would have someone from sales contact me. I had to make another call leaving a message for Peter St. John the following day to get any further communication.
The following day I finally received a call from Sales Manager Jeff Dohlbert. He presented my options thusly, an approximately $10/month payment reduction and the removal of lease protection or a $13/month increase to keep it, which would I prefer. I responded neither and if that is the way they do business I would rather they come get their car back. I advised at that time that I would not sign any new documents as I could no longet trust this dealership.
No account was created with Ally bank until May 1st. General Manager, Greg Depaola, drafted a letter April 30, 2013 with many errors, including when we attempted in good faith to lease the car. There was no deal at that time and he claimed in the letter a payment was due.
I spoke to Ally bank and they want me to pay an amount different than in my signed contract. They also changed the payment due dates without my authorization. I have no idea what figures were used to obtain this new payment, nor why my due date was changed. I NEVER agreed to any changes.
Greg Depaola, Peter St. John, Ken Bowers and Jeff Dohlbert beleive and stated they do not need my signature to make these changes. Be warned: Coulter will change the terms of your contract whether you want it or not.
