In November 2004, I refinanced my house due to a divorce situation. The loan I got was a 2/28 ARM with HomeEq. The payments were within my means and made in a timely manner. In February 2005, Countrywide Home Loans bought my loan and immediately the payments increased. When I questioned this, no one has ever been able to explain to me why. As a result, I became delinquent in my payments.

When I saw that I could not make my payments, I took the responsibility of contacting Countrywide to see what could be done. After several failed attempts and threats of possible foreclosure by Countrywide, I finally got someone on the phone who offered a solution regarding a workout program. In September 2005, following the instructions, I faxed in a letter explaining my situation to their workout department.

For two weeks after that, I tried to contact this department, found out who was assigned my request and finally got a call back. There was an agreement made of monies to be paid to Countrywide during the workout program, including dates to be received and amounts. Basically, they were going to do a modification of my mortgage loan and any past due payments would be spread throughout the life of the loan.

I finally received my modification loan papers in May of 2006 yes, 8 months after my initial request! Of course, during that time, making my payments, I would try to follow up on the progress of my loan and to inform them I had been laid off from my job however had another lined up and gave them the new income information and documentation.

When I received my paperwork, I immediately contacted Countrywide and questioned specifics as to where my money I had paid them during this time was applied. During the conversation, with detailed questioning on my part, the response I got was Uh oh.I'll have to call you back. Seems nothing I had paid had been applied. Within a week, I received new documentation which was satisfactory.

In November 2006 I decided to refinance the house and get away from Countrywide. I could not refinance earlier than that since I would have to pay a huge penalty since I was locked in for 2 years. It was then that I discovered that Countrywide had reported, in May 2006, that my mortgage had been 150 days past due! Never had I ever been THAT late on my payments.

I made several attempts to have them correct this and they refused, even though I was in their workout program for 8 of those 5 months they claims I was delinquent! I could not refinance and the payments began to increase due to the ARM. I had to file Chapter 13 to save my home from foreclosure and start the process of selling my house.

After the filing, I began getting notices from Countrywide regarding my homeowner's policy, stating they needed proof of insurance. I made several calls to them and several faxes from my insurance company and myself and the letters stopped. I was finally able to sell my house and thought it was over. Once my house was sold, for three months after, I received payment statements from Countrywide. Then I get a small check for the overpayment of escrows, then another letter stating I owed THEM because they had to get homeowners insurance for me during the break in my policy.

There was no break, I had insurance all along. Please! I have never dealt with such unprofessional people. It is obvious that no one around there communicates or knows what is going on in the servicing of these loans. Even though they have been paid off, I am now in the process of reviewing all documentation from the beginning and questioning every dime paid to them. Granted, I do take responsibly for my own actions during this time period however still do not feel this nightmare is over yet, even though the house has been sold due to the fact that they still send me information on a loan that doesn't exist any more. Best of luck to those still dealing with this mortgage nightmare.
