On March 31, 2010 I received a scooter purchased from thier wewbsite, I first called them to feel out their customer service, I spoke to a gentelman called Justin, when I asked him what will be the difference on ordering the scooter from him compared to ordering it from other websites that pretty much offer the same products he sells, 1st he started bragging about how much better his company & service is compared to others, He also mentioned that i shouldnt make the mistake and ordering my scooter from Scooter Depot, since they are supposely under investigation for fraud and a bunch of other crap, I was promised that I would be getting the initial color I requested, so went and purchased helmets, now that I've  received the scooter, the color is completely different from what i had initially ordered and told by Justing that i was getting (Burgandy), The Trunk was smaller with no back cushion, scratches all over it, the windsheild is missing the installation hardware, the Mirrors are white,they should be the color of the scooter, I have been getting the run around from all of thier staff, At one point i even spoke to the so called Owner!, he promissed me that he will fix things, then i never heard from him again, now all I get from all of them is alot of BS, now they are telling me that these things happened oftenly, since they are not the ones who stock these items!, More BS, it would be nice to start a Class Action Law Suit against this company, i dont think its fair to any consumer to go through this ordeal, especially when you are trying to save money by buying a scooter, NOT THROW IT AWAY, OR GET RIPPED OFF!  i LIKE TO GET KISSED BEFORE I GET SCREWED!

After investigating this report this is what we have found. This consumer purchased a scooter from our website on 03/22/10 and received their product on 03/31/10. Consumer did immediately call our claims department on 03/31/10 to report the issues they had with the unit. Consumer was advised of our terms of agreement that are stated on our public domain at and at the end of every checkout that the consumer agrees to before the sale is complete. Consumer was shipped the second color choice in their order. The manufacturer changed the style of the truck and packaged the wrong color of mirrors in the order.  In the terms we state:

PRODUCT DESCRIPTIONS:  By shopping on this website you agree to the terms that you understand some units may have slight variations with color and options. Due to the high rotation of volume we process and mfg standards, some products may have slight upgrades or changes that we are unaware of. This is due to the high volume and low cost we secure these sales at for you. It must be understood that this is a price driven site and color options / schemes may change slightly. We must collect (2) separate color choices from you at the time of sale. If we do not contact you, it can be assured you will receive one of the two colors you select. By shopping online you assume the responsibility for this. If your model arrives with a different color accessory, we will attempt to resolve this for you however the final word will be from the MFG directly. We appreciate your wholesale shopping business and ask you to consider this information before placing an order. Our main goal is to deliver the most affordable means or fun and transportation to you. Slight variations in options can happen and do occur. Please understand this when ordering. We would like to note however, 98% of all orders arrive exactly as  shown. Our main focus is to present the products we carry as close to exact on how they will arrive to you. If you have questions, please ask them before placing an order. 877-868-5828

Also in the same terms of agreement we state:

This agreement is also during the order process and checkout.

1) Your order will be shipped directly from the manufacture for best service. On average shipping takes approximately 5-15 business days. (this does not include weekends) will be forwarding your tracking number to you once your order is placed on a Shipping Truck for delivery. Please note that the shipping container is cardboard, and steel framing, and probably will have tears, or dents. That is what it is placed there for. The insides as you will see is very tightly packed and well stored and safe. Accept the order within reason and as a precaution, please note any visible damages either on the box or the product on the BOL (Freight Bill) when you sign for your package. Once you have it assembled, if you notice anything missing or damaged, file an online claim, and we will work on getting your parts out to you that you need. Parts normally take 5-21 business days to receive.  If the safety integrity of the machine has been comprised by shipping damage we ask you to make sure the delivery driver makes notes on the Bill of Lading delivery slip and gives you a copy. Please decline the shipment and fax us a copy (702) 628-5468 and we will send a replacement. If you purchased insurance we may not be required you to wait for the arrival of the damaged machine for inspection. If you did not purchase shipping insurance you may be asked to wait 1-2 weeks for a visual inspection if the damaged item before shipping your replacement. Nearly all shipments arrive completely undamaged.

2) Due to the high volume of orders and expedited processing provides. Payment and shipping will be processed as fast as possible to get you the item you purchased within a decent amount of time. Although most of our processing and shipment take about 5-7 business days, there are times orders can take up to two weeks to arrive. We can only work as fast as our warehouses. If at any time the item you originally purchased is not in stock we will offer an optional item at equal or greater value as our commitment to great customer service we provide. If the customer declines the changes and the payment has been processed the customer will be responsible for the restocking fees which are 5% of the order if the order has not shipped. If the order has shipped and the order is declined or cancelled by the buyer for any reason there will be a 25% restocking fee. This fee is non-refundable as in order to continue to bring our customers overall lowest prices anywhere this requirement is effective for all customers.  We at CMS has responsibilities to our customers and we ask our customers to do all research before buying as once the order is placed our customers to have a responsibly to ensure payment is honored.

3) We do have technicians on staff to assist you with any issues that you may have with your product. Please remember that you are purchasing your item wholesale, and because we are not physically on location with you, you will need to be our eyes and hands to walk you through any warranty or technical issues and have patience. If there are any technical issues that cannot be resolved over the phone or through email then the customer will need to take the unit to a certified mechanic for diagnosis. We suggest and search ATV Dealer, Scooter Dealer or Small Engine Repair Shop to best locate them.  Please remember, due to the low cost of our product the parts are included in your warranty however the labor naturally is not.  If there is a significant issue we will work with you to correct your needs.

4) Please understand that laws in every state are different, make sure you research and understand the laws in your state regarding your purchase. CMS Inc. supplies a safety page that we strongly urge you to read before making your purchase. Check with your local DMV and state laws to find out what they required for using your purchase on public land or private lands, we believe some of the Go-karts can be green or red stickered for California residence and are marked on our website passed on from the MFG. and posted on the items we have been informed are.  Registration is the responsibility of the purchaser. The process is rather simple by contacting your local DMV with your VIN and TITLE/MSO. We can assist you with any questions.

Consumer was told by our claims department that we apologized for the manufacturers error and would do everything we could to fix it. After consumer filed the claim on our website at, we in turn immediately filed the claim with the manufacturer and even requested that the parts be expedited since it was their error. The parts for the installation and the new mirrors were overnighted on 4/6/10 and a different style truck was overnighted on 4/08/10 to this consumer. This consumer received his parts from his warranty claim within 5 business days of filing his claim even though we state on our website that warranty claims normally take 2 weeks to be filled by the manufacturer. Our claims department had gone above and beyond our normal procedures/terms to satisfy this consumer. We feel that this consumer filed this report before allowing us ample time to resolve their issues and may have not fully understood the terms of agreement at the time of checkout.



We do agree that every consumer should take their time and research fully on any large purchase they make online. Every consumer should be aware of the terms of agreement, warranty/claims, shipping, return policies and assembly requirements on any website they are thinking about ordering from. Every dealer may have different policies on warranty/claims, shipping, return policies and assembly. As far as our company, I can say that we do make sure that all of our consumers are aware of all of our terms of agreement by posting them on our public domain at and requiring that they agree to these terms at their checkout by signing a "Digital Signature".  We also offer a lengthy FAQ at that covers shipping, shipping insurance and assembly requirements. On that page, the standard warranty page at and one every page of the products we offer, we HIGHLY recommend that a certified mechanic at brick and mortar shop assembly and PDI any product we offer on our website. Most consumers feel that they are qualified to assembly the units themselves and if they do, we offer technical assists to those consumers by phone and email.

We are a dealer that drop ships to the consumers directly from the manufacturer. This is why the consumer receives such large discounts on the product they order. This is the only way a consumer can buy any product they want to purchase. This would be the same circumstances if the consumer walked into a scooter/ATV dealership. All dealers/dealerships order their product from a manufacturer, consumers are never able to order directly to the manufacturer. And all dealers/dealerships only offer a PARTS ONLY standard warranty by the manufacturer. Not all online stores can offer an actual store to go into. Our company offers products online and at our brick and mortar shop in Santee, Ca. Our company is also American owned and is a public entity under San West, Inc. Sorry to hear about your situation. A piece of advice for you and anyone who considers purchasing a scooter/motorcycle/atv or the like online. You are making a huge mistake. Most of the people who purchase these scooters online and have them drop shipped are first time buyers of this type of product. Scooters are motorcycles, make no mistake, the 150s go 60plus mph! Would you want to put your life in the hands of someone who put this thing together in their living room? These things are not toys and should be assembled by a trained professional, usually a brick and mortar store where you can go if you have problems.

All of your online sellers of scooters are simply resellers who bought, or will buy for you through brokers, chinese scooters of the cheapest quality and then arrange to have it shipped to you. They have little to no knowledge of the operation of the bikes. The stuff that some sites say about PDI or inspection is crap. Do you really think those people would uncrate a scooter, assemble it, gas it, check the oil, battery, etc., test it and then reverse the whole process recrate it and ship it? It's hogwash.

The testimonials you read on their sites are all fake, those people don't exist. A lot of the people behind these sites are Chinese. The Chinese don't do business like an American. They have no business ethics and consider it an honor to get away with ripping off the customer and ignore any law they choose. There is no enforcement of these sites so if you contact your state AG or any other agency, DMV, etc., you can expect to get nothing. These guys don't get promoted by helping a consumer get revenge for a scooter sale. They could care less unless there are multiple cases and they could get their name on the news. Remember, the people responsible for protecting the consumer from the fraud that you experienced are government employees and by definition will do as little as possible to help you.

You will continue to have problems with your bike and soon it will not run if it runs now. Then you will give up and maybe try to sell it to someone else and make it their problem. That is what the seller is hoping for. They just want you to go away.
