Courtesy Acura Lakeland Acura FRAUDULENT CAR DEALS Sanford, Florida

In April of 2010 my truck, which is registered and titled in the state of NC, was illegally reposessed by the co-owner while I was visiting friends in florida. She had it taken to Courtesy Acura in Lake Mary Florida and proceeded to trade it in. While she was there with the truck I found out it was there and I called the dealership. I asked to speak to the sales manager, Smitty, I informed him the truck was titled in NC and the title law for NC requires my signatue in front of a notary, I was not signing it and was comming for the truck. He laughed at me and tols me " the deal was done, nothing I could do about it and if I came for the truck I would be arrested for grand theft"

I called the police department in Florida who also told me not to come for the truck. I then called my finance company, who was extremely rude, and told them not to release the title casue I was not selling my truck. They told me "as far as they were concerned the truck was paid for, my account was closed, please dont call them anymore they cant help me". So I asked for a receipt proving the truck was paid off so I could buy another one. I was told I had to wait for the dealer check to clear before I could get any payoff receipt.

I then called the Florida Attorney General and explained the situation, they told me i was absolutly correct and transferred me to the head of the Florida DMV enforcement division. I faxed a copy of the title to them and they went to the dealership to pull the file. After 3 days of phone calling i was finally going to get my truck.

On my way their, Smitty, called me and asked me if i would allow him torefinance the balance at a lower intrest rate to "make this problem go away". I said that would be fine i am on my way to get the truck. He called me back and told me I would have to have 1000 dollars down to make it happen. I told him no way , I am done with this and I am comming for the truck. He said i could not have my truck until he got his car back. I told him I did not sign for his car that was not my problem.

When I got their to pick up my truck he gave me a copy of some paper showing me where she has signed a paper saying if they could not get the truck and title she would have to pay the trade amount off, and he said someone is goin to have to pay for this. I said it isnt my signature so good luck. 2 weeks later i received my pay-off receipt for my truck. i assumed they payed it off and were going after her for the money. # months later a repo man showed up looking for my truck.

I showed him my receipt and he was on his way. When I called my finance company they told me,nicely, they had to send the money back to the dealership. I told them they should not have done that cause she signed a paper saying she had to pay them. They got nasty and said they were just gonna take my truck. I politely reminded them "The account was closed , the truck paid off, dont call them, remember," and I have my payoff receipt in hand.

I am still fighting this matter as of now. I am trying to retain an attorney to get me clean title in hand. As far as I am concerned I own the truck outright and when she signed it over to Acura she had signed her intrest in the truck away. I want a title in my name only and lein free when I am done. Any attorney who can get this done please help !

I feel Acura is responsible because i told them before they made this deal they were breaking the law. They didnt care and they didnt want to listen to what I knew to be correct information reguarding the law.
