I am not going to lie to any of you, I am currently an ex employee or I should say an ex Independent Contractor of CR England. I was an Independent Contractor For CR England for a month and a half. I was making anywhere from $900.00 to $1,000.00 dollars a week then get nothing.  All of a sudden my mother passed away on the 29th day of October in 2010.  I had to make an emergency trip to Arkansas, I was only gone for a week. Then on Tuesday November 2nd, 2010, it was payday so I looked online to see what my pay was going to be over a $1,000.00 dollars in the negative.  Therefore they screwed me on my pay for the week before I left. I called CR England and they would not fix it.  Mike Tucker the manager called me last Friday wanting me to be in his office Monday morning for a meeting. So when Monday came around I was at CR England like he said to be. He told me to come into the Burns Harbor Indiana facility.  Mike is ahead of Chicago Regional. I met with my DISPATCH MANAGER which her name was Crystal. Mike Tucker didn't even show up for the meeting. Instead he left a note with my Dispatch Manager Crystal, to terminate me from employment with CR England. They said it was due to service issue that I was having. The only service issue I had was beginning to fall asleep at the wheel hauling a Conway load. So I pulled over for a nap, which also I was practicing safety. Well CR England may tell you safety is very important but CR England does not care if you end up dead or not. All they want is for the load that you have to be there on time. Plus it states in my contract that CR England is supposed to give a 30 day notice before terminating employment. As well as the employee is to give a 30 day notice before quitting. I never received a 30 day notice. Keep in mind they did this crap during the time of my mothers death. Also in the contract drivers are supposed to be fully or 50% reimbursed on most of the tolls I never ever got reimbursed for any of the tolls I went through. Also when I was terminated, I found out that I was allowed to keep my truck whether I was employed  by CR England or not . All I had to do is make my payments on time.

When it all came down to it Crystal told me to turn my keys in for the truck.  They made me pay $533.00 dollars a week on lease payments, plus another $201.00 dollars a week for insurance payments. I think CR England should be shut down for mistreating their employees and being corrupt. The Eagle Atlantic Loan Services that was created by CR England just so the government would pay the same amount the student's had to pay. The school costs $3,000.00 dollars. The government turns around and also has to pay the same amount that the student has to pay.  The grand total that CR England gets from each student is $6,000.00.  Also the Horizon Truck sales and leasing center was created by CR England so they can make a profit off all of the drivers that they have. I was treated very unfairly by CR England and was screwed over on my last two paychecks. From all the hard work I gave to CR England I would just like to see some kind of justice with the company. Thanks for reading my thoughts and concerns that I had with CR England.

I suggest you get some legal eduaction Employee vs. Independent Contractor

CR England has been nailed for skirting this issue for years and has paid big fines, and even had locations closed, and drivers de-certified, etc.

The bottom line here is that YOU entered into an "Independent Contractor" agreement without educating yourself on exactly what that meant.

Then, during your whole post you keep referring to yourself as an "employee".

Which is it? Here's how you find out.

1. Go to the iRS website and obtain IRS Form SS-8. Fill it out completely and truthfully and mail it back in, keeping a copy for yourself.

2. Now, file for UNEMPLOYMENT. File on the assumption that you were an employee, do not say anything about any independent contractor status. After all, if any CR England member of management or dispatch ever referred to you as an employee, you are, right?

3. File written complaints with the FMCSA for any compliance or safety issues you encountered.

4. File a wage claim for monies earned but not recieved.

Stay off the phone. Do everything in writing and send via certified mail, return reciept requested. Keep copies of everything. Be sure to put the certified# on the body of each letter to prove exactly what you sent.

Unfortunately, you will have to take CR England to court to settle this, and that will be at your expense. They know this, and that's what they count on.

FYI..It is ultimately the responsibility of the CDL holder to ensure the safe and legal operation of a commericial vehicle. BUT, you have to learn how to PROPERLY document those issues as you go along, and how to PROPERLY take yourself out of service without putting yourself in a "violation of contract" status, which you obviously did.

WHY would you tell anyone that you were falling asleep at the wheel? Are you stupid? It is YOUR responsibility to get the rest you need, and YOUR responsibility to eat right, etc.

When you get tired, and start nodding off, it is usually because you have been sitting too long and blood flow is restricted, and/or you have made it too comfortable in the cab like with using the heat, etc.

When tired, I used to just pull over and walk briskly around the truck and trailer 3 times and get back in. You then feel energized and awake, and you lost a grand total of less than 10 minutes. Then, in your LOG BOOK, to cover your a*s, you log 15 minutes as "safety check". Now you are covered. Nobody can mess with you, legally!

It is a shame that companies prey on new, inexperienced drivers in these "lease agreements", but they are not going anywhere.

There are NO good lease agreements out there. Period. They are ALL bad. Be a company driver and get paid by the mile or the hour. Or, get out of trucking.

My brother signed up with this company.He was told he would have a motel shuttle pick him up in Gary, IN upon arrival.While he was on the bus he called the hotel only to find out the shuttle does not run after 7pm.He would be arriving in Gary at 11:55 pm.So he called me to see about getting a ride by a taxi.I called a couple of taxi services in the area.One would not go into Gary,IN at that time of night.The other I pretty much begged to pick him up and take him to the hotel.He was charged $20 for the Taxi ride in which C R England told him he would reimburse him for the Taxi.He has not yet seen the reimbursement.The hotel also made the comment to me that this company does this to everyone! They knew what time the shuttle quits running! They do NOT care about the safety of their emplyee`s obviously.Something was really wrong when the taxi`s did not want to go to Gary at that time of night.This is a serious safety issue! I have read in many places that Gary,IN is the murder capital of the U.S. I do not know how true that is.Beware before signing up with this company.I was also told after a few weeks of driving with a trainer they will bring you in for their "Upgrade" training.This is to get you to buy or lease a truck from them.If you do not "Buy or lease" a truck from them they will terminate your employment.This company needs to be stopped and shut down!
