I was contacted by Rx Financial over the phone and was guaranteed a $10,000 Visa or Mastercard of my choice. I was told I would receive a package and a card and a $250 shopping spree on them and could cancel at any time if not satisfied.

I was asked permission to record the phone call and they wanted to debit my checking account for $219 prior to receiving the package. I scheduled payment on 4th of September.

I phoned Rx Financial inquiring about the package and credit card as was told it would take 2 to 4 weeks for the package to get here. My account had been billed on September 3 and not September 4.

I received the package containing a cd, book, certificate for shopping spree and no credit card. My account is currently overdrawn and I am on a limited income.

Rx Financial is a ripoff and credit card fraud!!!!!
Please help, what can I do?

#2 Consumer Suggestion

This scam sounds too familiar.....

AUTHOR: Jason - (U.S.A.)

POSTED: Saturday, January 15, 2005

I used to work for a company did "third party credit card processing". What this means in a nutshell is that certain companies are ordained by Visanet as "high risk" and cannot open an account, therefor they have to go through a third party who has a Visanet account to assume the risk for them. A big bonus for the scamming company is that their information generally does not appear on your statement, making it more difficult for you to get in contact with them. This reminds me of a similar company based out of Arizona by the name of Financial Credit. They charge $499.00 saying they can get you a credit card at one of several different banks. Then all you get is this stupid pamplet in the mail with a list of banks you can apply at, no approval guarenteed (they will tell you). So you essentially pay $500 for a list of banks that offer credit cards.

The EDitor is correct in stating that usually the only way you can get your money back is by disputing it through your bank. However, unless the laws have changed, you have 6 months to dispute the amount, but do not wait this long, DO IT IMMEDIATELY. Even if the bank says they cannot help you, please follow the editor's suggestion and keep pursuing it. Yes it is a pain, but I have assisted alot of people in doing this (something the processing company I worked for did not want me to do) and have never been unsuccessful in retriving funds and reversing bank fees. It may take months to do this, but it will happen. This causes what is called a "chargeback". This is VERY bad for whoever processes credit cards for these people. After a certain (and this is a very low number) number of chargebacks, Visanet will shut down the account and open an investigation. By doing this, you will also help hundreds, if not thousands of people who have not yet been victimized. Don't feel bad for the processor either. In most cases, it's scum feeding off of scum.

Don't hope to locate these companies either. They are pros at remaining evasive, using ficticious information, and moving state to state very quickly. They are masters of the PO Box. The REAL owners of the companies use loopholes and other people to keep their names off of corporate documents. Telling these people you will report them to this, that, or the other thing does not intimidate anyone and will not help you. They seriously laugh at people like that as soon as they hang up the phone because most people are lazy and make idle threats. For Godsakes, please contact the AG (Attorney General). He can make life very unpleasant for these people. EDitor is also correct in stating that the BBB does nothing. They send a letter notifying the company of complaint, the company sends one back saying it was resolved (even if it wasn't). Issue dropped, no further investigation. The company I worked for stole millions upon millions of dollars every year and got a little decal every year that said something to the effect of "This company has maintained a complaint free status for the year of..." despite the fact it had hundreds of complaints.

If you can contact the processor, it may be easier to get your money back through them. They know the company that they are processing isn't legit, but they would rather give back your money than see a chargeback. That is the magic word. Say it and you have a 99% chance of retrieving your money. They won't cover bank fees though. Many banks will see that the charge is erronous and reverse the fees for you (but you have to contact them), some will say it's the responsibility of the company that charged you. If your bank does this, I don't know what to tell you. The company I worked for has never paid bank fees. Reason? "Sir /M'am, technically it wasn't our company that charged you so...." If you reach this point, my prayers are with you. I'm sure you could collect it with a lawsuit, but these companies are confident you won't go through the time and expense for $20-40.

USEFUL INFO FOR SCAM COMPANIES:
The sales reps talk fast and unclear on purpose. They don't want you to have the time to comprehend what they are saying before they get you to agree.

They only save voice recordings of your actual order, not any calls afterwards, so they can say you legitimately ordered their product.

They have your information before you ever get the first phone call. ALL OF IT

If you get ANY calls of this nature, watch all of your accounts, even cards you have in a safe deposit box or that are owned by dead relatives. They usually charge you anyway. Sometimes you don't even get the courtsey of hearing the sales pitch.

Don't belive any call or complaint is being logged. It is up to you to provide this proof. Most time they tell you whatever they think will get you off the phone, if that includes some fake typing, well hey....

You think your speaking to a Supervisor/Manager/Head of the company? Here's how it really works: One employee to another "Are you on the phone? No? Good. there's someone on the line who want to speak to (insert desired contact here)" You are only getting another rep.

For GODSAKES do not give these people your CVV2 code on your card. Who knows where it will go after they get done ripping you off. It also makes it harder to dispute the charge.

Companies that "slam" credit cards often start with a small charge before they hit you with a big one. They do this for two reasons: 1) To make sure the account they have is good 2) To see if you notice. They love accounts that people use for emergencies. They always have available credit and since you aren't using the card, chances are, you disregard your monthly statement. Always look at your statements even if you do not use your card. After 6 months, you have no chance of seeing that money again.

I hope this information will help people that have been victimized find justice and potential victims protect themselves.

*EDitor's suggestion on how to get your money back for fraudulent charges to your bank account!

AUTHOR: ED Magedson - Founder - (U.S.A.)

POSTED: Saturday, September 25, 2004
EDitor's Suggestions on how to get your money back!

HERE IS WHAT RIP-OFF REPORT SUGGESTS YOU DO:

Go to your bank within 60 days of the charge, or as soon as you know about the charge, don't delay, and tell them that there has been fraudulent activity within your account. Explain that you wish you file a dispute, and demand that they assist you in accordance with Federal Regulation E.

According to the majority of victims interviewed by Rip-off Report, those who immediately called their banks to dispute the charges did not get very far. Many victims got the following responses from their banks: we could not do anything for you or you waited too long; it has been more than 60 days.

If the bank is says that you have waited too long, explain to them how you called their 800 number as soon as the charges were found, and were told by the bank that nothing could be done. Remind the bank that they failed to assist you properly at the 800 # , and instead, provided you with an inadequate explanation of your right to dispute. Tell the bank that it's their fault time has expired, and since they gave you the wrong info to begin with, they will just have to deal with it, take the loss and reverse the charges.

Tell them the truth; this was unauthorized and your account was NOT to be charged! Keep emphasizing how you never authorized anything! Direct them to the hundreds of victims reports that were filed on Rip-off Report.com. And if you're at the bank, walk them over to their computer and make them go to this site! If you are on the phone with them, tell them you will wait while they access this site! Either way, be persistent!

DO NOT TAKE NO FOR AN ANSWER!

Let them know nicely, that you were advised to Report them (the Bank) and this situation to the Banking Commission in your state. Since each state has a different name for the agency/comptroller over banks, find that name before you call or get to the bank so you can throw it in their face. The more knowledgeable you appear to be, the further you will get.

And just continue to demand the Federal Regulation E form! The bank CAN, MUST and WILL reverse the charge! But, you must be persistent; ask to speak to the supervisor or the area manager for all the branches in the state.

Let the bank personnel know you are meeting with the media later in the day, that you would much rather they do the right thing (as most other banks have) by looking at the complaints and immediately reversing the charge(s) to your account; no matter how long ago it was. Be sure to call the Media if necessary so you are telling the truth.

If you have to, be loud (but nice) in front of other customers. If you are just calling by phone, the above tactics should still work. The bank can easily fax or mail to you the Federal Regulation E dispute form.

CHARGES TO YOUR CREDIT CARD

If the charge was to your credit card (not debit card, check card, or checking account), contact the credit card company as soon as possible to request a dispute form. Consumers usually have a little longer to dispute fraudulent credit card charges (up to 6 months), but it is better to act right away. In this type of situation, credit card disputes are usually successful since fraudulent companies often won't contest the disputed charge. In rare cases, credit card companies will review disputes, but refuse to reverse the charges. If this occurs, complain to a manager and let them know you will be filing a report here.

Remember Don't let them get away with it! Make sure they make the Rip-off Report .. The more Reports filed on a Company or individual, the more likely it is that the authorities, media and attorneys will want to take action.

And good luck Let us know how you do!
