I went into Crown Jewel on 11/29/17 to buy my wife a Christmas gift.  I was looking for a necklace and told the clerk that my budget was no more than $80.  She showed me two and I made a decision and she offered to gift wrap it for me.  I presented her with my credit card and she completed the sale on a handheld device at the counter where I was standing and held the small tape for me to sign.  

I did not have my reading glasses with me and she was talking to me with a heavy hispanic accent and I am hard of hearing.  I then went home and put the package in the closet.  The next evening I was checking my credit card account online and was shocked to see a charge for $3,621.!

 I returned to the store the next morning and tried to explain the misunderstanding.  The owner, Carlos Isolica was alone in the store and was very rude.  He told me that there are NO RETURNS! He said that I could exchange it for other merchandise within 3 days.  I told him that this was not a case of "buyer's remorse" but a misunderstanding.  He ushered me out and stated that he was used to "my kind"!

 I went home and contacted Bank of America where my Visa acct is. They assured me that we would get this matter resolved and put the transaction in dispute.  I felt confident until I received a letter from them on 1/10/18 basically stating that the merchant has a no return policy and they can't help me and that the charge will be on my next statement!  

I have contacted several agencies as well as an attorney.  According to FL statute 501.142 merchants with a no return policy must have it clearly stated on the sales slip, point of sale and their website.  My wife went into the store to look for signage.  There was a small sign on the wall in the rear of the store behind a register.  I was never back there as the clerk broght the handheld device to me.  The receipt I was given does state no returns at the bottom of a tiny thermal paper with fading ink.  There is nothing about returns or exchanges on the website which touts "your satisfaction if GUARANTEED"  I received no other documentation in the bag with the gift.  There is NOTHING that states the type of gemstone, whether gold or silver, no mention of carat or weight.  I went online and found several recent negative reviews as well as a few glowing recommendations probably written by his family and friends.
