On July 5th, 2007, I sold my 1997 Suzuki Marauder Motorcycle to Richard Allen after he left a business card on the handlebars of the bike which was parked in front of my residence.

The amount agreed upon by both of us was $1,100.00. I also included 3 helmets, a brand new motorcycle cover, and a pair of Leather saddlebags in the sale. He brought his two young female children to my door with him as he handed me only $1,000.00 cash wrapped in bank wrappers. I reminded him of the purchase price that we agreed upon, and he told me a long tale of just having lost a "cousin" in an accident that week. He did not seem to be too upset, neither did his children, and offered his promise that he would pay the remaining amount of $100.00 the following week, once the "funeral" was completed.

I stupidly took pitty on him and agreed to his promise, and handwrote a bill of sale which mentions the amount owed to me. He signed this document, making it legal and binding. My father and a friend along with her 9 year old son were witness to the entire transaction in my home.

After several weeks, I had not heard from him, and I have left numerous messages on his cellphone, along with emails sent to his Yahoo account that is provided on his business card. He has never returned my calls or answered his mail.

I happened to bump into him at a Monrovia Starbucks Coffee shop in February of 2008 and requested payment. He gets on his cellphone and ignores me.

I called his cellphone again during the second week of April 2008 to demand payment. He once again has refused, saying he does not know when he will be able to pay me. If he can afford Starbucks coffee .. he can afford to pay what he owes me. If I had the money to sue him civilly, I would. It's the principle of the matter that chaps my butt. My motorcycle was a gift from a now deceaced relative, and I only sold it because I needed money to find a place to live. I want my money and I want him to pay interest on his debt, as it has caused me much grief attempting to collect from him.

This man is a scam artist, and a liar and a thief! The first words out of his mouth when he approached me to buy the bike were "I am a good christian man..." blah blah blah.... Uh huh. Someone help me collect from this loser, please. It's been almost 10 months, and I deserve to be paid what I'm owed.

Small claims court

Since you have a written statement that he owes you $100 to complete the sale there are a few things you can do:

1. Sue him in small claims court. The court filing fees will be added to the judgment against him (assuming you win.) I wouldn't wait any longer. I don't know about CA but here in NY, the SOL for this type of problem is 3 years.

2. Go to your state equivalent of a department of motor vehicles and file a LIEN on the motorcycle (assuming you signed over the title) this way you can REPO the motorcycle.
