Every condition has its poster child - a shining example symbolizing the most stirring aspects of today's society. On one extreme, we have the war in Iraq, the breakdown of the ozone, incurable disease and the national debt.

But on the other, we have Dakmart.

Posing as an electronics dealer by day, by night they hone their skills as an automatic refund machine, imposing uncalled for refunds to any buyer with a complaint. I was a victim of one such refund, after weeks of pointless negotiating.

As of Tuesday, January 16th, my eBay status is ruined.

Here is my story:

I ordered a watch through eBay and paid instantly, stating my wish to receive it by Christmas. Being a reasonable buyer, I kept in mind that it may not arrive, it being the holiday season.

Christmas comes and goes, and no watch. My boyfriend got all teary on Christmas morning when I showed him a picture of it on the internet. He couldn't wrap it around his wrist, and it didn't display the correct time, but it looked really big on the website.

Eleven days after the order, I wrote Dakmart, inquiring as to its status, and in response, they requested I call them. After a couple days worth of attempted contact, I am told, "Hehe! Don't go by our eBay ads!" Guess what? They didn't have the product in stock, and they didn't even make that particular color with the particular band attached. I was particularly upset.

Why? Because if I hadn't called them, I never would have known that I wasn't going to receive the watch. They completely neglected the order. Took the money, of course but neglected the rest.

They said they'd maybe, kind of, like, try to put one band on another watch and create a reasonable facsimile to their ad, and would call me back. I did get the call back that night - saying that maybe, someday, they'd get an order in again, and maybe they'll have it, maybe not, maybe they'll call me, maybe not, and a few garbled sentences consisting of words Merriam Webster couldn't even define.

That was when they dropped out of existence. I called repeatedly, and no answer. I left voice mail messages. Time passes. Finally I call, lowering myself to beg for the dang watch, and wondering if maybe they had skipped Florida and hopped a boat to Haiti.

Time to write them, and I'm pretty mad. Again, requesting the watch I'd ordered, I asked how they would compensate me for their poor customer service and false advertising. The next day I received their friendly letter. To be fair, I will credit them by blaming their atrocious spelling on the assumption that the watch dealers were so tick-tick-ticked that they regressed back to the Pig Can Jig writing level.

So what was my reward for all those troubles? They refunded my money without my consent, and said they no longer wish to do business with me. Meanwhile, my poor boyfriend was still asking if the watch had arrived.

I'd had enough. I called Dakmart, spoke to a "manager" and a customer service rep, told my story, and was rightly furious. They said, "Well, we gave you back your money." But I didn't want my money. I wanted the watch. They sang the same song, saying maybe, someday, like if I wish upon a star and sing like Jiminy Cricket, my dreams would come true. They didn't know when or how or if but maybe if I clicked my heels, I'd be ballooned back to Kansas and my Luminox dreams would come true.

My dreams didn't come true. No calls until days later, when they left a message saying, "We don't have that watch or band, but like, how about the 3000 series?" I didn't bother talking to them anymore. I gave up my dreams, let go of the whole crazy watch idea, and let it rest.

Well, shouldn't a company that does someone dirty count their blessings if a buyer lets them slide? Not Dakmart. On January eighth, I logged into eBay to find that Dakmart had filed a dispute against me, and I had seven days to pay for a watch that I had already paid for, or else I'd face suspension of privileges. And I was cornered because I couldn't file a dispute against them. Wonder why? Although they likely use a monkey to manage their eBay sales, the monkey was smart enough to give me that speedy refund, knowing it would disallow me from filing a dispute. So, that's how it is. you can't file a dispute if your money has been refunded. Good going, Bonzo. He cain't spale, but he showww kin give a refund!

So I called eBay. I wrote eBay. I wrote Dakmart. I wrote and called anyone who could hear or read mail, and they came back with the same old line: "We can't help you." My records clearly showed that I'd paid for the watch, and yet, Dakmart got away with filing a dispute against me. EBay said they couldn't do a thing, only Dakmart could. But Dakmart wouldn't answer the phone! That's when I began wondering just how much eBay makes off of Dakmart.

When nearly a month had passed, I filled out the usual feedback on eBay regarding Dakmart's service, in a rightfully negative, but tactful way, and they finally, in turn, left me theirs. And it was so crudely slanderous, it was enough to ruin my chance to ever buy again on eBay. But their goal wasn't just to offend - there were conditions attached. If I remove my feedback comment, ie, my first amendment right to free speech comment, we can have a nice, little mutual withdrawal and live happy ever after. Wow. Kind of like, we won't hurt you if you retract the truth, and give up your rights. Sounds like blackmail.

It was a little too late when I did my research. Seems they've done dirty deeds to hundreds more, one for every letter of the alphabet. My eBay research uncovered five hundred and thirty six dissatisfied customers during past year alone and nearly four hundred mutual withdrawals where they likely made the same blackmailing comment to others, who gave in to their threat and conceded. The complaints included unreasonable shipping costs, misleading ads, items not received, and many items touted as new, but sent refurbished or broken.

On a personal level, their insults to innocent buyers are being broadcast to millions through eBay, and eBay provides no protection. Unless they are racist, or of "Adult nature", their policy states that they are not legally responsible for the remarks, even if they are defamatory. But who decides what words constitute defamation? eBay does.

What does this mean? Buyer can be thumb-smashed into the dirt by a seller, and yet, enjoy the peace of mind that they haven't been defamed because eBay says so. I'm thankful that my being called a Disgusting disgrace a liar, and warned to millions not to sell to me isn't defamation. Seems good buyers like me are losing the battle because it's Joe Doe versus the corporation, and Dakmart puts more money in the eBay collection plate.

So what does it take for a seller to violate eBay's policies? Apparently, more obtuse language. Statements like, If buyers are frequently unhappy, or, High levels of disputes or High percentage of negative feedback as compared with other sellers. What is the exact percentage? What is a "High level"? We need to know. We deserve to know. This is all pliable language which gives soul discretion to eBay.

And what about numbers? How much do they make off of Dakmart, and what is the real reason that they allow this slandering of responsible buyers? A privilege is earned, but a right should be free. It's a sad statement about today's society, when a right must be bought like a product, and that product is as damaged as Dakmart merchandise.

If anyone wants to buy something from Dakmart through eBay, do yourself a favor and research their history. Read the amateurish comments they have made about buyers, the name calling and lies. If you're lucky, they will want to be your friend and fulfill your request. But if the wind blows wrong or a flea sneezes, don't expect fairness. And don't bump into them unarmed in a dark eBay alley. They will mess you up and still sleep well at night.
