My husband and my went to David Mcdavid Nissan in Houston Texas to purchase a vehicle for me for Christmas. I had no idea about this, it was a surprise for me. Well 30 days later it really was a surprise. The car my husband purchased from them was a 2008 Nissan Altima, base model, nothing fancy. It was purchased on 12/21/2007, and our 1st payment was due on 1/20/2008. After reading over the contract on the next day I immediately call the dealership and spoke with the salesman LaQuentin, and asked him why was our payment due so soon, I thought it was supposed to be due in 45 days, and the intrest rate was horrible, making our payment $534.64. My husband got a cosigner for himself , and she had excellent credit so I wasn't understanding why the interest rate was so high, and why she was put with Drive Financial. well his response to me was It is what it is, Ain't nothing I can do with that, if your husband had a problem with it, he should have said so before signing the contract. I said ok, well I really think you got over on my Husband and There is no way this could be right because she has excellent credit. They still had to cough up 1,500.00 for a dn payment.

Well my she went to her bank and had them look over the deal and they told her she should have went through them, she would have got the lowest rate possible due to her excellent credit, and they said that dealership should have suggested it to her. They told her they smelt a rat, something wasn't right. Low and Behold, on 1/16/2008 a lady by the name of Donna called our home demanding payment from us that day. Well I told Donna that our payment wasn't due until 1/20/2008, not the 16th. Donna then preceeded to tell me that we needed to pay now or we don't have a done deal the deal is not done until she receive that payment today. I told Donna that I was going to contact Drive Financial, because our contract said 1st payment due 1/20/08. Donna told me that Drive had told her to contact us. I told Donna I was going to still contact them myself. well when I contacted Drive, they could not find an account for us they search for about 30 minutes and could not pull up a thing. They asked me to call back in 2 hrs, and let them work on it. I called them back within the 2 hrs, and still no one could locate us, So finally the lady @ Drive told me to contact the Dealership back because it must be something they done on their end. I asked them about a Donna, and they said they had not spoke to anyone by that name. So when I called David Mcdavid back I spoke to the finance manager that was working with my Husband I think his name was Brad. When i asked Brad about what was going on, He told me that The Bank had rejected the Deal, so there was no deal, and that the bank felt that we was a risk because we couldn't afford to pay the payment on the 16th when it was demanded, then how are we going to pay for a car for 6 yrs.What a way to tell a customer who trusted in you when purchasing a car. I was told by Brad, that I needed to bring the car back or make that payment, I assured him that wasn't going to happen before 1/20/08 because I was going by my contract.


I hung up with him because he really pissed me off, I contacted Laquentin back, he directed me to his manager, Scott who apologized for what had happened. I told him I didn't appreciate how we were treated and would kindly bring back the vehicle, but I wanted my dn payment back. scott assured me he would have our cashier's check ready. Well when we went to the dealership on 1/21/2008 to return the car around7:30 pm, Scott and La quetin met me and my husband at the door, I said here is your keys, where is our check? They both said come on over and have a seat we want to talk to you. I said about what, there is nothing to talk about. Scott said How did you like the car? I said I liked the car, but don't harass us for a payment before it is due, I could see if we were late on the 1st payment, I totally agree, He then proceeded to say, If you guys leave a check with us to make your first payment, we'll reimburst you for your 1st payment, we just need you all to make that 1st payment. I said wait a minute, Why would you reimburst us a payment If we are buying this car, this don't make sense to me. Just give me my check so we can get out of here you got your car back and we just want our down payment. Scott then told us We are not going to keep your dn payment we just wouldn't do that It takes at least 2 days to process it, and the business office is already close for today. We said ok, well when should we check back? he said in 2 days.

Well I called the next 2 days and finally I spoke with La quentin, I could never get Scott back, he was always with a customer, or on the phone, he never returned my phonecalls. So Laquetin finally told me that they was having a meeting to review our file, but the check should be ready because he would have to go across the street to David Mcdavid Honda to get the check processed, because they handle all the check refunds over there. Well we proceed to drive back to the dealership to pick up our check and half way there I decided to give them a call and let them know we were on our way but would be running a little late due to the rain and traffic. Well LaQuentin told me that They didn't have a check for us because we drove the car for a month and not 1 payment was made on the car, so the downpayment was being kept to cover the miles on the car. I said what bullshit! That is 1500.00 we are talking about, not $5.00. We work hard for our money, we don't have that kind of money to throw away, we have 3 kids and a grandbaby to support. This was our hard earned savings they took. Why didn't you give us a call before now? He couldn't give me a straight answer, his reply was Our GM manager Mike Deal said he tried to call you but got no answer. I say I find that hard to believe because we have caller id and your number never came up. He was speechless. He then said oh well that is what it is and there is nothing more I can do for you all.

Well I told him, you are going to either give me our money or another car, he then said we might can work something out. It may be possible. It is really sad how some Big Major Dealerships treat customers. do they think it is a game? Do they think we have money to throw away? Something should be done, there should be a law to protect us from rip offs like this kind. I checked BBB and this co. has had 45 compliants within 36 months. My God they should be closed. I would never recommed this Co. to anyone, I wouldn't want someone else to go through what we are going through. We are still calling everyday to try and get our money back. We are stuck without our money and a car. I will continue to pray for this Co, because they won't be Blessed and their business won't prosper because of their wrongful doings. They should remember that God sits high he never sleeps nor slumber and he sees all.
