Official Colorado Notice:  Denver Judge Terry Fox Makes Decisions Without Reason -

 Different states have different methods of selecting judges, including partisan elections, non-partisan elections, and uncontested retention elections.

 Colorado uses the worst method of choosing judges (uncontested retention elections) by which Colorado power brokers (1%ers) on the State Commission on Judicial Peformance select lawyers for appointment as judges and then recommend they "be retained" if they haven't been caught committing high crimes. These aristrocrats appoint and retain politically connected lawyers to be judges based on who they know instead of what they know.

 The information in this Report comes directly from the 2014 Colorado State Ballot Information Booklet published by the Legislative Council of the Colorado General Assembly (Research Publication #639-4) in September 2014 and mailed to all registered voters in Colorado, but unfortunately too few voters will read it.

 How would you like Colorado's future on the issues of fracking, voting rights, marital rights, taxes, and your family's legal rights to be decided by a judge on the Court of Appeals who received her education at the Colorado School of Mines, never presided over a case in the trial court, and whose peers say she "does not make reasoned decisions"? 

 Judge Terry Fox, a graduate of the Colorado School of Mines, was appointed to the Colorado Court of Appeals in Denver 3 years ago and has been unanimously recommended by the Commission to "BE RETAINED" in the upcoming November 2014 election, even though a survey of lawyers who know her best say she is "WEAK in making reasoned decisions, writing opinions that are clear, and writing opinions that adequately explain the basis of the decision."

 Terry Fox's peers also conclude that "Judge Fox's opinions seem more focused on reaching a particular conclusion than in explaining a clear line of reasoning."  That means she decides who should win the case by the seat of her pants and her emotions rather than by the facts and law, and then tries to dress her decisions up to pretend she is following the law instead of her personal agenda.

 It is also commonly known that other (women) judges on the same appeals court never tried a case as a trial judge (a prerequisite in many states to become a judge), with the same reputation for emotional rather than rational decisions.

 This is the low quality of judges being selected and retained because of Colorado's "who you know" way of selecting judges. Surveys by people who best know the judges mean nothing because the Commission recommends that incompetent as well as competent judges be retained, judges whose peers agree make "decisions without reason."  Judge Terry Fox is just one example.

 Colorado should scrap its "high brow" judges selection method and allow voters to choose judges in non-partisan elections based on what they know rather than who they know. Judges like Terry Fox whose peers say "does not make reasoned decisions" would not be elected or retained in non-patisan elections.  The people of Colorado deserve better.
