So, here's the short version. On or about April 8, 2009, I was told by the photographer - representative of the company that came to my college for portraits that for a $23.95 fee I would have my portraits made for the group composite photo that would hang in the hall, a smaller 8x10 of the composite for myself, and severeal smaller 3.5x5 photos of my individual shot.

Under these pretenses, I sat for the portraits, under MS-035-ADN05. They would not accept any other form of payment, so I gave them a check that was good. I kept checking to see if the check had gone thru yet.

Weeks to a month later, they finally attempted to cash the check and it was rejected by the bank. No one contacted me weeks later saying that I was being charged a fee ontop of the $23.95 for portraits that had been sent to me. I never recieved any such portraits.

I called to explain this to the company and spoke to one representative who was extremely rude and told me that my payment only covered as a sitting fee. That I was not entititled to receive any portraits. She then put me through to a manager, whose first words to me were, "so you have a descrepancy over a bad check?" I then explained to her that I never recieved the promised products and therefore didn't understand why I owed them the balance.

She proceeded to talk over me, even when I asked her to please let me finish, not listen to what I was trying to say, and very rudely talked to me degradingly. She spoke to me like I was a child!

She then proceeded to laugh at me and say, "fine, dont pay it. Ill just turn it over to collections." She made no attempt to help me or to even understand what the problem was. She just got an attitude, laughed at me, and threatenedto turn it over to collections. I have never felt so disrespected in my life.

I understand if payment is due, Im liable, but I expected them to at least hear what I was saying and offer some sort of solution. They did none of the such. This company misrepresented their products by not sending what was promised, and then made no attempt at customer service when questioned.

Digital Pix prides itself on its great reputation and would like to refute these statements made by Erica Burleson on 6.23.09.


1.)Ms Burleson states that she did not get what was promised to her. Our promise was for $23.95 a person, our package includes; the large framed master composite for the school, and 11x14 copy of it for each person photographed, and 3-2x2 state board photographs for each person photographed. Ms Burleson was photographed with her graduate program and she was promised a photography sitting at her location and all of the above mentioned items to be shipped to the school. We shipped the 3-2x2 state board photographed on April 23rd, 2009, the 11x14 composite copies on May 14th, 2009, and the large master composite to the school on May 15th, 2009. Additional orders, such as an 8x10 of their individual selected portrait pose, are available for purchase for an additional fee. These terms are clearly stated in the pre-photography picture chairman packet that is sent to the organization to be photographed as well as on our website.


2.)Ms. Burleson states that we cashed her check late and we did not let her know about the fee for the bounced check. The participants present the photographer with a check, money order, or credit card payment right before they are photographed. After they are photographed, the groups payments and paperwork gets sent to Digital Pix. This takes about a week depending on the location from where it is being mailed. Then the paperwork has to be sorted and organized by different departments which takes about another week handling time until the checks are cashed. This is our standard procedure and a standard mail processing rate to cash a check. If an individual has written a check, it can be assumed that the funds are available and negotiable at anytime thereafter. If the check is bad, then we have the right to collect any reasonable processing fees, which in this case, happened to Erica Burleson. We mailed her a bill including these fees and she called us upon receiving them, making her statement that we did not contact her regarding the charge completely false.


3.) Ms. Burleson states the customer service representatives were rude to her. The customer service representatives attempted to explain this to Ms. Burleson. The final Digital Pix representative she spoke to had tried to assist Ms Burleson, when Erica proceeded to swear at her and hang up the phone on her. We know that Ms Burleson was in fact upset about her check bouncing and did not like having to pay the charges, in which we were trying to explain to her. Our staff was swore at and hung up on. We stated clearly what our packages included and Ms Burleson received all of her items. She wrote us a bad check and we were simply trying to collect the fees that were incurred. We feel that we shipped everything on time, cashed checks and processed payments in a timely matter.


We deliver quality products and treat our customers with the utmost respect. We feel terrible that Ms Burleson had misunderstood the terms of what she was receiving and our bounced check policy but would like to maintain our good reputation by clearing up her statements/accusations.  We do thank Erica Burleson for paying her account in full on 8/3/09, $61.95 which included the participation fee and the bad check fee.
