as you can guess I have contacted a lawyer and the Attorney General....

hello. account num. xxxxxx I always paid by telephone using a variety of payment methods. I never was required to put "a card on file."  was a customer since 2006, this is a "grandfathered in account." I was also NOT married to my husband then and he was never authorized to get information or make changes to my account.

I spoke with a Tony, Brian, John, Samantha and a Brandon. Who claimed I was not allowed to know their last names...

ID #s w2713 and w2962 but they said the same thing over and over. Brian agreed to credit my husbands accnt $40... that hasnt happened.

I will return these receivers as I have NO use for them. I canceled my service and went with another company that has provided internet, phone, cable, dvrs and FREE installation.

The card that was charged was not mine. It doesn't have my name affliated with it and was also opened before our marriage. There was NO authorization to charge one penny. Without auth you would need a judgement or lein and your company doe not have one. Someone from Directv, called the card, verified funds and took out every penny we had. I learned that we have ZERO dollars as I was attempting to purchase groceries for my family.....which includes two children.... and Thanksgiving is this week. My husband gets paid ONCE a week and I was recently laid off. So this is devistating to a family like us.  I know that this is illegal. I know that this is a violation of the FDCPA and consumer trust mind you.

I don't want to take legal action. I want to feed my family.  I want the money that DIRECTV illegally obtained back.Thank you for your help.

Thank you writing.  I am happy to assist you with your DIRECTV billing concerns.

I understand that you are concerned with recent charges to your husbands credit card.  I understand that this is a difficult period for you and I am happy to clarify this information for you.  DIRECTV requires customers to maintain current credit or debit card information on file at all times. Please refer to section 5(e) of our Customer Agreement (online at directv.com/legal) for full details about this requirement.  This information must be presented at the time you place your initial order for DIRECTV service.  Regarding payments made to DIRECTV after your services have been disconnected for non-payment, under the terms of the DIRECTV Customer Agreement, when your DIRECTV service is cancelled, all outstanding charges are billed to the method of payment we currently have on file. The

Customer Agreement is available online at directv.com/agreements. Please see the Payment Upon Cancellation section for more information. 

As these recent payments made on your account are for valid charges, we are unable to honor your request for a refund.  Currently, your DIRECTV account is in collections for the remaining amount due of $436.10.  Of this amount, $180 will be credited back to your account once we receive your DIRECTV DVR and standard receiver.  Upon carefully reviewing your account information, I see that the equipment return kit we sent you arrived this past Friday (Fed Ex # xxxxxxxx).  To confirm, it was shipped to the address listed below:

Instructions and pre-paid shipping label are included in an envelope attached to the outside of the box. Please return your receiver, access card, and remote control within 7 days of receiving the recovery kit.  I thank you for your patience and understanding.

You apparently gave them your husbands credit card no. at some time or they would not have been able to bill it.

All I can say is good luck getting the money back. You signed a contract with them that agreed to the terms and conditions of their service. One of those is payment upon cancellation. They are absolutely correct in how they took the money.

"(e)  Payment Upon Cancellation. You acknowledge that you have provided your credit or debit card account information to us. You understand that you will incur fees and charges as a result of your receipt and use of Service and/or Receiving Equipment, and may incur early cancellation fees and/or equipment non-return fees (as specified in any lease, programming or other service commitment agreement you entered into in connection with obtaining Receiving Equipment). By giving us your credit or debit card account information at any time, you authorize us to apply this method of payment, in accordance with applicable law, to satisfy any and all amounts due upon cancellation. You further acknowledge that you are required to maintain current credit or debit card information with us and agree to notify us whenever there is a change in such information, such as a change in the card number or the expiration date."

That is how they can legally charge you. You agreed to these terms.
