I went to visit Mr Montoya at his home on Monday to see if there was any chance I would be collecting any of the money that he owes me from all the deals I brought in for him, and wow, imagine that, he tells me I am not going to be paid all becuase of the note that I put on this site about him.

What a joke, he also said that his wife was doing the W-2 for the employees, comforting that this is the same wife, Kristen, that was doing the books for DBASF, and we all know how well that worked out. I wanted to let you all know that I am filing a civil lawsuit against this piece of garbage, as well as now working with some others to ensure that Shutters USA be stopped as he is currently selling product, FOR WHICH HE DOES NOT HAVE A SUPPLIER FOR!!!! I guess some people never learn.

As I have stated before, I will do my very best to assist you all with your complaints and provide all the documentation that I have kept along the way from Ken and this company.

Do not be fooled either, Ken Montoya IS the owner of Shutters USA, it shows James Mclaughlin on the Maricopa County Recorders webpage, however I contacted Wes today to find out what was up with this, and he went down there to get his name taken off all that on 12/17/2005 is when it was done. This is Ken and Kristens business only and they are doing the EXACT same thing as before. UNBELIEVEABLE!!!!!

What I am doing to get my money back

I spoke to my attorney who gave me the Department of Labor's phone number, since they have a wage board. I am going to file my suit with them, as they are kind of like the ROC in that they will fight for the little guy, and I wont have to go broke doing it. The downfall to the Deptartment of Labor is the fact that they will only go after $2,500.00 and I am owed $7,000.00. There is a chance that Ken and Kristen did the right thing, and listed all of us for the bankruptcy, if that is the case I will be in the same boat as you in that I will just have to wait it out. I too contacted Rick Debruhl at 12 news, to see if he had any guidance as to what I might be able to do and he said that what I am doing is really all that I can do.

I would be more than willing to meet with you all, or be in contact with all of you as well. If you find away that we can put communication methods on here, please let me know. I can assure you that if I do not get my money, and Ken and Kristen DONT do the right thing, I will personally send a letter to one of the editors at the Arizona Republic, as that is my new place of employment.

I can only speak for myself but I'm waiting tohear back from the attorney gen, the ROC and the state. Some of the people who attended the meeting at the ROC told me that the attorney gen office filed a reoprt with the police department-I tried to file a report but I was unable to. I'm just waiting at this point.

Information Regarding Clas Action Lawsuit

First, Gary, I did put my e-mail address on my last message addressed to you, but noticed it was deleted. I think that we cannot leave phone numbers, addreses or e-mail addresses for obvious reasons.

I was finally able to get through to the attorney that we have been telling all of you about. He advised that a class action lawsuit is not feasible because all of us are assessing different damages. Class action lawsuits are done when all the plaintiffs have the same complaint (amount of money, etc.). However, he advised that each of us contact the Maricopa County Attorney's Office and advise them of what each of us has gone through. When you call him, be sure to use the wording of "criminal enterprise" this is very very important. The attorney said that even in K & K's present business they are conducting business in a criminal manner because they do not have a supplier, but are taking customers money and have no intention of filling those orders.

Gary, how do you know that this is true?
We can continue to communciate via this website.

In addition, has anyone heard from Tom Allen's office (the bk attorney for K & K)? I try and call about 2 - 3 times per week and am constantly being put through to the voice mail.
FYI: I was incorrect in my previous messages wherein I stated that Chapter 7 was a personal bankruptcy. It is not. It is a liquidation of business (per the attorney).

There has been less and less movement on this website and we pray that everyone has not given up. Please don't! If we give up that means that K & K have won.

Marie and George: How do we Email you? What is your Email address? I heard back from Micheal Margot at Shoreline- he was very nice and offered to do our shutters at cost. He confirmed a lot of what we've all been saying and but I'm not sure if Shoreline has an attorney to fight K&K?

We All Need To Work Together

Gary -- Thank you for your report. What we feel should happen is that ALL of us need to stick together and file this class action lawsuit. By "all of us" I mean we should include all the employees of DB&SF. We had been friends with Ken and Kristen for many years and this is the 3rd house in which they installed shutters. It wasn't as if we randomly picked them out of the phone book. Our mistake!!

Anyone reading this rebuttal, please e-mail us so that we can get enough people together to file a class action lawsuit. K & K are going about their business, taking money from more customers under the new company name, never giving a thought to any of us that they hurt.

While I firmly believe that "what goes around, comes around", we need to take the bull by the horns and band together to stop these guys.

Gary, I'm not sure who James McLaughlin is but I had lots of dealings with Wes McLaughlin. I'm just so disappointed in him because he wasn't man enough to talk to me in person, but had one of his employees talk to me. While I do understand that many of the employess did not get their paychecks, just think of how much money K & K put in their pocket from their customers alone! I hope they are enjoying their new home and pool, that were paid for by our money and yours. Please contact as many people as you can and anyone reading this please e-mail us.

We had our hearing on January 19, 2006, and still no decision from the Judge. We understand from the ROC that there are now over 40 complaints outstanding. So what! K & K are back in business on our dime!! We will keep everyone posted on the decision. Also, it is our understanding from Tom Allen's office that DB&SF has NOT yet filed for bankruptcy. Now isn't that a surprise. Ken told the Judge at our hearing that they were not filing Chapter 13 (corporate), but filing Chapter 7 (personal). Keep calling Tom Allen's office until all of us get an answer.
