Division Of Child Support Enforcement ripoff they told me over the phone 2 weeks ago that my husbands case had reached a zero I called today and they said he still owes This is the 4 screw up in 3 years Charlottesville Virginia

I was the non custodial parent for a time. He was made to pay child support starting in 1999. They forgot every year that I had my son all summer and therefore, wasn't supposed to pay during the summer months. I got behind and they tried to say that I was behind by $5,000, But I was put in jail in April of 1999 and the amount that I owed had to be paid before I could get out of jail. I still got behind but not as much as they say I was.

In April of 2002, my son moved in with me and instead of making his mother pay child support physically they just reduced the amount that I owed every month until it reaches a $0 balance. They sent me a letter stating that they were going to withhold the money from my son's mother in January of this year so my wife called to make sure my account was at a zero balance and was told that it was so she told them to close out the account because it was never his intent to accept money from Deanna. He just wanted what he owed paid then to drop the case.

I filed my taxes on Feb.17, 2004. I was going to get it rapid refund, but to my dismay the bank wouldn't give us the loan because on my credit report it shows that I owe the DCSE money for back child support. My wife called and asked them to send the credit bureau a letter stating that my account is paid in full and the lady on the phone informed her that she couldn't do that because I still owe money for my past arrearages. My wife asked how that was possible and they came up with a long song and dance about it being a mistake in sending Deanna the letter saying they were going to start withholding money from her paycheck and they were sorry for the confusion.

When they first gave me custody of my son they sent in a withholding order to my work (VDOT in fairfax camp #30)for the amount that she was suppose to be paying. My wife had to call again. Then they intercepted my meal perdiums from the state and they held my federal tax return for six months. I got some of the money back, but not all of it and I let it go until now. I am seriously considering taking them to court and sueing for mental anguish and my money back that they withheld.

My wife faxed them copies of the court order so they would release my meal perdiums and they did send back most after that and they were suppose to stop the check intercept, but then come March we recieved a letter telling us that they had our income tax refund and that they had to hold it for six months so they would know if my wife had filed an injured spouse claim and of course her word wasn't good enough, but through it all their word is suppsosed to automatically be believed. I am really tired of being stressed out and afraid that every check I am suppose to get will be intercepted by them even though it isn't supposed to be. This situation has caused myself and my wife a lot of grief. I would appreciate this case to be reviewed and revised as soon as possible or I will have no other alternative than to try to handle it through our lovely judicial system.
