My boyfriend has had a long history with Drive Time, and let's just say that none of it has been happy.

We are planning to file a class action lawsuit against Drive Time, Ugly Duckling and Kars Yes. We have already contacted a lawyer and have excellent grounds for this.

We need as many people as possible to take part, and hopefully rectify all the wrongs done by them.

If you are a dissatisfied customer and wish to join in the lawsuit, please contact me through the rebuttal key with your story and phone number and mailing address, so that I may get in contact with you.

They need to pay for what they have been able to get away with!

DRIVETIME Complant

AUTHOR: Ernst31 - ()

POSTED: Thursday, August 07, 2014

To Whom It May Conern

Hi my name is Vicky Ernst and on July 23, 2013 i purchased a 2008 Dodge Grand Caravan. With that i traded in a 2000 Infinti with no problems at all. Well in August i had to take the Dodge back to the Drivetime because they were a probklem with the tire and so forth and they argued with me to get it fixed and then my husband finally went ahead and fixed it himself and then in September my oil light came on so my husband took it to Walmart Auto to get the oil changed and the gentlemen said that he couldnt change it because of the oil plugged was stripped out and if he changed the oil he was afraid he couldnt get the plugg to work. so after that i called DriveTime were i bought the vehicle and they said to contact the AVEREX the powertrain limited warranty. so i did and they said they wouldnt do nothing about it and then i contacted DriveTime Customer Service and i did. and well they told me to fix the problem and then they would take care of my three months payments and did that and now here it is August 2014 and they still havent done anything and i tried to make a payment on my vehicle this past thursday and they refused to except it and now they are threatening me to come and get it and the DriveTime Customer Service Rep name is Kyle Smith. i am wanting something done to them they rip people off and i for one isnt going to stand by and let them get away with it .

Thank You

Vicky Ernst

Sold me Gold, turned out to just be nickle :-(

AUTHOR: greene_misses82 - ()

POSTED: Thursday, June 26, 2014

Hello,  i bought my first car from Drivetime is MArch 2009, a 2006 Buick Century and by August it had broken down twice.  i took back to Drivetime and they changed the oil, (which it wasnt due for) and capped all the fluids.  the car stillhad mechanical problems.  it then brokedown for good exactly 9 months after my initial purchase.

i asked Drivetime for help with mantainence because it had only been 9 months.  and they said i was beyond warranty. so the car sat un movable and i told drivetime that i felt it was their responsibility to fix it because i have never heard of such a short warranty and id file a lawsuit for selling me a lemon, and until the aided me i wouldnt make any payments. they refused and then repossesed the car.  they sold me a horrible car that gave me nothing but problems for the meir 9 months i had it. i want to join this class action lawsuit. please my email is mrsgreene82@gmail.com.

Drive time hell

AUTHOR: Shawna - (United States of America)

POSTED: Tuesday, January 22, 2013

I purchased my vehicle 3 1/2 months ago. Just past the 30 day no cash warranty, the rear passenger window broke, the cruise control stopped working, and the Abs brake switch went out, all of which Drivetime does not cover under there warranty. Now what the did cover in repair was the transmission which also started to act up.

The transmission is another story in itself. First I was told to take the car to ashop near my home. I paid the 50 dollars and then was told that I needed to take the vehicle to another city 30 miles from my home. While there, I found out that my vehicle had transmission problems with it before it was sold to me and that Drivetime was aware if this problem. They had sent the vehicle in to have the transmission fixed before putting it in their lotto be sold.

I would never purchases vehicle with transmission issues. This was never disclosed to me at the lot. I was showns the car facts report on two occasions while there and both times told there was nothing on the report except for the transfer of title, which was shown to me.

My car was eventually sent from the shop that I dropped it off at to another transmission shop in another city even further away from my home and was never notified that this had happened. A week later got my car back and my car was running exactly as it did before I dropped it off. So I decided to wait and see if the new trans needed to break in, since I was told nothing by the workers at the shop about what they did or didnt do.

Now a month and a half later and my transmission is blown. My car had to be towed which I had to pay for back to the second shop 30miles from my home. I'm going to pay another 50 dollars for something that was never fixed the first time and my window, abs switch nd cruise control are all still broken.

Now it's all amazing for a car that only had 42000 miles on it and only previous owner was the car dealership that owned it before me, at least that's what Drivetime told me.

I want to know what can be done to stop these people from selling crap to people, both in their lots, on the phone nd most importantly in the cars!!!

Total Rip Off!!!!

AUTHOR: Lu1962 - (United States of America)

POSTED: Wednesday, January 16, 2013

This is the 2nd car I have bought from drivetime.  The first car was no trouble, but I paid dearly for the car @ 21% interest.  I was contacted by Drivetime in Nov 2010, stating I qualified for their "DT Champ" program, so I purchased another vehicle from them, thinking it would be lower interest rates, and relied on there "54 point" inspection and the "Auto Check" report.  This is the WORST car I have ever owned in my life, and I am 50 years old.  Since August of 2012, I have had to spend over $2500.00 on repairs and parts, and the frame sounds like it is about to fall out from under the car.  The drivers door fills up with water inside the door when it rains, and the automatic lock and unlock, and windows do not work at times.  The repairman advised the switch for these items had corroded and was probably the reason for them not working.  The "Check Engine" light stays on, and I have already replaced one sensor, and another one needs replacing, which is going to cost me over $600.00 for parts and replacement. The fan clutch in the motor has to be replaced too.  There is probably much more that I am not even aware of at this time.

To top this off, I decided to run a real "CarFax" report on the car myself, and not to my surprise, I found an extensive accident this car was involved in that was not on the "AutoCheck" report from Drivetime.  I would have never purchased this vehicle knowing it had been in an extensive accident in the rear.

I called drivetime and asked if I could at least trade within Drivetime to get rid of this piece of crap, and I was advised my loan was not low enough to do so!  REALLY?  What a rip off.  I owe $11,000 on a 2005 Chevrolet Trailblazer, and I have contacted every dealer I can in the Atlanta area that advertises "No Matter What You Owe", and they cant even help me.

I am extremely interested in the class action suit that you are referring to!

Bring Out the Violins! And Its Wailing Time Again!

AUTHOR: Jim - (USA)

POSTED: Sunday, December 30, 2012

You wrote them a BAD CHECK.  You wrote them a BAD CHECK because YOU can't manage a checking account, otherwise there would be no "unexpected check" coming thru.  You don't use a CHECK REGISTER to keep a running total in your checking account.  Imagine that, YOU own the checking account.  YOU have YOUR MONEY in that checking account and YOU don't even know how much money is in YOUR checking account.  So you write a BAD CHECK.  Smart...real smart!  But the problem goes back even farther.  Before doing business with them, YOU trashed YOUR credit by developing a documented reputation of NOT PAYING YOUR BILLS on time.  You couldn't go to a regular dealership and get bank financing because the banks DON'T TRUST YOU.  (I can't imagine why!)  So you go to this place which finances anybody and what do you do?  You bring with you the baggage of self trashed credit and you write them a BAD CHECK.  You're very lucky they didn't prosecute you.  They are so, so, so, so unfair!  Bring out the violins as still another deadbeat wails!

Drivetime has unfair practices and are ripping people off

AUTHOR: jcmama - (United States of America)

POSTED: Friday, December 28, 2012

In November 2012 I purchased a vehicle from Drivetime. I wrote a check for $2,000 for the down payment. Over a week later when the check was sent to my bank account & did not clear due to an unexpected charge from another company. That same day I called the local Drivetime & told them what happenned & offered to bring in the $2,000 that day.

They refused to take the money & stated I will have to return the car if the check does not clear. My bank stated that they could run the check a 2nd time & that it would clear. So I waited to see if they would run it again. But they never attempted to run the check again.

I received several calls & emails thanking me for my business after that. Then on December 17th after my first car payment was taken out of my account, I received a call about the $2,000 check and the caller "Sarah" stated that she would call me back in 2-3 hours after she talked it over with her boss about any possible resolution.

I then received 2 more thank you calls that week from Drivetime on the purchase of my new vehicle. Then without any notice on December 22nd they repossessed my vehicle. They refuse to refund my money or let me reconcile the matter in any way. But they reassured me that I could get another car with them in 6 months, as if...

It does not seem fair that they can take my money & my car. It is also not fair for them not to allow people to cover a banking error. I am very interested in a lawsuit!

class action on drivetime

AUTHOR: mcshannon2004 - (United States of America)

POSTED: Monday, April 23, 2012

I was late with my payment. I talked to 3 different rep's and 1 manager. The manager was rude, and I got 3 different stories from the rep's. They put my car up for repo, when asked what I needed to do to get it off repo, the 1st two said there was nothing I could do. The 3rd one talked to the manager and they said if I got the payment in by 4 p.m. PST(6 my time) then they would not repo it.

I called back at 5:30 p.m. to give them the confirmation number to the credit card payment. I was informed by another rep that the woman I had to give the information to was away from her desk, and he would email her my confimation number, and have her call me back. At about 10 minutes to 6(my time) I called her back, since I still hadn't heard from her. At that time she said it was too late, and that they would refund my payment in 7-10 days.

I asked to speak to a manager. He never did give his name, but he was extremely rude, and informed me I should have called before making the payment to make sure that it would be accepted. I told him I did exactly what she told me to do, and within the time frame given. He said it didn't matter, and that it had already been turned over to the repossession company, and they couldn't take it back.

So if you're able to get a class action suit started then by all means count me in, somebody needs to do something with these people. Their business practices leave a whole lot to be desired.

Drive time RIP OFF

AUTHOR: Kyosco - (U.S.A.)

POSTED: Sunday, January 15, 2012

I purchased an Olds Alero from this dealership in November 2006, the first thing I noticed was that the drivers window was ready to fall into the door, which the dealer fixed, less than a year of having the vehicle I had 2 things go wrong with the vehicle, the same window problem and the car will not start. I called drivetime and all they would tell me is that the vehicle is no longer under warranty, they then told me to call the manufacturer, the manufactuer told me that the extended warranty drive time purchased on the vehicle was never transferred to my name and that it expired. I told the dealer what I found out, they then told me that it was my responsibility to get it transferred in my name, ( they never told there was a warranty in the first place) so how am I to get it transferred??? they then said if I take the car to an approved repair shop they will help me with the repairs, well I took it there, I was told it would be 766 to repair the vehicle, drivetime then said if I make the down payment on repairs they will then tack the rest of the bill onto my car payment which by the way is 400 a month on a 2002 alero which is blue book value of 2500 ( by the time I am finished i will have paid 13000). Well I paid the down payment picked up the vehicle and again I no sooner park it in my garage it doesn't start again, that was it I told drivetime take the car back because I am not paying another cent. Thats when they threatened to have my wages garnished for the full 13000 I am besides my self and these people have got to be stopped, They also told me That I need to make the payments and take a bus to get where I was going !!!!!!! if there is a lawsuit against them I would like to be a part of it Please !!! My credit is already messed up and I know have to file bankruptcy because of it. Horrible company and they should not be allowed to be in business. They need to be banned from the state of florida and everywhere else. This company has put me in so much debt. If not I would like to start one hear in tampa. Class Action Lawsuit Against DT Corporation

AUTHOR: Georgia - (United States of America)

POSTED: Wednesday, November 09, 2011

I also used DT Coproration and they absolutely ripped me off. I traded my 1992 Firebird in and was only given a $700 trade value for my car. I ended up having to return the car because the interest and car payment was so high I coul dnot live and keep the car.

I did a voluntary repo. The original cost of the car was close to $14,000.00 and when they sent it to auction they say that they only rec'd $5000 for it at auction which means that I now still owe on a car that does not exist anymore over $8000.

I have family members that work at the car auction here in Tampa FL and know that if this car made it to auction they made more than this on it but I cannot get them to show me that is all they sold the car for.

I think that it is a crying shame that there is a company out there that would take advantage of people like this in this kind of economy. I am a single parent and was recently divorced when I made the mistake of going into DT to get a car. Now my credit is being destroyed and this needs to stop.

Need Class Action Lawsuit Information...........

POSTED: Saturday, November 21, 2009

I am not happy with my experience with DriveTime. I entered into a contract with DriveTime to buy a 2002 Dodge Caravan in October 2007. Within two days of having the vehicle the engine light came on, the arm rest and other parts of the car fell off or came apart. We contacted DriveTime with regards to the problem and was told that we could not return or exchange the vehicle. DriveTime threatened if we return the car, it would be a repossession. Placing the loan cost to our credit reports. We were stuck. There was a warranty but when I took the car to their approved mechanic, their warranty did not cover the costs. The engine light is still a problem to this day. My husband and myself are unable to afford the cost to fix. Also I bought a 2002 Dodge Carivan SE for over litte over $20,000 in 2007. Market value at that time was between $8,000 or $9,000.

I want in!!!!

AUTHOR: Robyn - (USA)

POSTED: Thursday, September 03, 2009

Samantha ~

I would really like a part in the class action lawsuit. I am in the beginning stages of returning my vehicle that I purchased from Drive Time and I just know there is going to be trouble.

I am doing a voluntary Repo on the vehicle that I purchase back in December of '08. The problem that I am having is the motor on this vehicle is about to go and since it is past the "160 Days" that they "give you" as coverage on repairs they want ME to take it to a mechanic in my area (who will not deal with Drive Time) and then charge me for fixing the problem. When I spoke to 2 ASC Certified mechanics (both with multiple certification) regarding this problem they stated it was going to cost me several thousands of dollars. Both mechanics stated that returning the vehicle was in my best interest. I do not want a part of this scam to soak me out of what I don't have.

I am scared that this will go on mine and my husbands credit as a regular repo and that is not the case. I have always been on time with my payments and even pay more than the amount that I have to just to keep my account looking sharp. I will not fall for their scams and BS. If I have any chance of being a part of your class action suit please contact me and let me know.

To all the mouth-breathers who claimed they were contacting a lawyer...I notice no updates.
Why? Because you have no case. No attorney would take these guys on...because they've done nothing illegal. No one forced any of you to buy the cars, and I guarantee that if you had paid on time no one would have called and "harassed" you.
These problems are your own fault. Grow up and move on.
I defy ANY of you to post the attorneys name you supposedly spoke with and what he/she said.

I have had horrible experiences with Drive Time. One of the examples is they took my down payment of 1300.00 and instead of subtracting my down payment from the total financed they added it instead. Another complaint I have is they will call you if you are one day late and threaten to repo your car.

I bought a 2004 neon from drivetime. In April I lost my job and returned the car voluntarily. I was not beind in payments and was told my credit qith them was excellent. When I reutrned the car, they suggested I would be receiving unemployment and could still make the payments. I said no I need to give the car back. They took it back. 2 months later, i get a letter from a collection agency saying I owe them 10,000 dollars. (I gave them the car, they were not looking to do a repo or anything) I called the collection agency after talking to drivetime and being told to call them. I was informed that I had signed the contract and was still responsible for the money. I am sure they have already sold the car to some one else but they still want 10k from me. Oh I have since found that they overcharged me for the car. It is only worth 4k in the dealer section of the kelley blue book. Aint that a kick in the pants. I will surely join the lawsuit. Anyway I will join a class action to remove information from credit. (They listed the full price as write off, however they sold the car and got almost half of what was owed) They never disclosed intrest, They had an agreement to inflate purchase price with dealer. POSTED: Wednesday, June 10, 2009

Not only did Drivetime in Orange County CA sell me a PT Cruiser in 2006 that later severely malfunctioned, they gave me a lot less value for my trade-in than it was worth and finalized the paperwork without the original title of the trade-in vehicle. I still have it, by the way. Young and naive, I kept the car and ended up falling behind in payments. They harrassed me as soon as I was three days late. I let them take the car back because I no longer wanted to do business with such a company. I'd like to join the lawsuit because consumers should challenge their unethical and unlawful business practices. My email is (((Redacted)))

Willing to Join Class Action

AUTHOR: Krystal - (U.S.A.)

POSTED: Tuesday, May 19, 2009

I bought 2002 Dodge Neon from Drivetime about two years ago. Initially I went to Bill Heard Chevorlet and after the way I was treated there I just wanted to get a car with no hassles. I had heard that Drivetime was first time buyer friendly and decided to take my chances. My first problem with them came about a month after I had the car and they started telling me that I owed them $295 for the collision insurance that I purchased from them to drive the car off of the lot. I was told that I only had to pay the premium if I wanted to continue their coverage and if I didn't pay there was no issue. Then the calls started. We went round and round for months over it and eventually I didn't hear anymore about it. That is until I was a few days late making a payment. My payments were due the saturday after my pay day and on Monday they started calling. Not only did they call me they called my references and my job. I admit that I was a few days late here and there depending on my finances, but I got calls everyday and again they started talking about me owing them for the insurance. Funny thing was I only heard about the insurance if I was "late" making a payment.
My problems got worse when I got another job and my paydates changed. I notified them several times that I no longer got paid on the dates originally set up and needed to change my due dates and was told that because I owed them for the insurance they could not change my due date. Again for months we went round and round about me not owing them for the insurance and I informed them that since they would not change my due dates I would make payments according to my new pay schedule(this made my payments about a week late). I got called every single day and again they called my job and references. In Feb of this year I finally found an employee that was willing to help me and had me come down and sign a loan modification and change my due dates. At that time I was told that they were showing some of my payments as past due and so they deferred 3 of my payments. Or so I thought. The contract I signed said that my next payment was not due until around the 21st of Feb and all payments from Dec to Jan were being added to the back of my loan. I knew at the time it was b/s, but I was tried of seeing them on the caller id and having my relatives in Texas tell me they called.
I recently tried to get another car and was told that Drivetime has reported me as making 6 payments 30 days late or more. Not the total monthly payment, but the two week payments. I checked my credit report in 01/2009 and saw that they had me late only in Nov of 2008, so imagine my surprise when I see that in May of 2009 they are now saying Ive been late every month since Aug 2008. I reviewed my bank statements and found all the payments i have made to them and while some may have been a few days late, none were 30 days, in fact I even doubled up payments or made payments and a half to catch up, but they claim I was only making larger payments on certain dates and those payments didn't apply to what they showed as being late. I was told by the other dealer that my credit score has gone from around 600 to a high 400 because of the way they have been reporting my payments. The dealer even said he can't see how I would even still have the car if what they said was correct. I am trying to get another car and put my severly upside down p.o.s. on top of my new purchase, but because of my credit score in todays market im having a very hard time. I never would have thought that buying a car to help build my credit and making the payments would ruin my credit the way it has.

My name is Michelle Young and I was also ripped of by Drivetime. I purchased a 2006 Chevy Impala in Feb. of this year. I had the car 2 months before the water pump started to leak and it blew a head gasket...I had made 2 payments also....long story short, Drivetime said the damage to the car was my fault and I would have to pay for the repairs...to the tune of $1400..money I do not have. After going back and forth, they offered to pay half of the repair costs...I said no. Then, when I did not make a payment, they called harrassing me and I told them where they could pick their car up from and what they could do with it. I have requested a refund of my $1650 downpayment as I am now without transportation and this will be going on my credit, I have not gotten a refund. I would be very interested in joining your lawsuit...pls contact me at dmichelleyoung@yahoo.com

I am a recovery agent that dose alot of work for Drive Time, First i would like to make a comment to all the concerned with your credit reports, first if you would have had good credit at the time you bought your cars you would have not gone to dt to buy a car. Companys like dt provide a great service to your community. they are their to finance you a car when nobody else will because of your past credit history.

You have the option to have your car checked by a mechanic prior to any purchase, In some states you have to sign a paper that clearly states that you agree to take the car AS-IS.

Finance companys DO NOT want to repo your car, They are willing to work with you with in reason, once a car is repo the car is sent to the auction and it is sold for almost nothing.
Next time you should ask your self a simple question. If this would be your company would you lend someone like yourself w/ poor credit history, No employment history, low income, skip hazard ect... any of your money.

The smart people use companys like dt and others for their benifit they pay thier cars on time for 6months to a year and trade them in to a franchised dealership for a new car with low intrest once they have shown they can pay the payments on time and rebuid their credit.

Been ripped off too by Drive Time, caught payment up and repoed car anyway at my sister's leaving me stranded in another town where my sister lives

AUTHOR: Pam - (U.S.A.)

POSTED: Thursday, January 22, 2009

I was behind but I caught my payment up had a receipt for it, I go to Fruitland Park to visit my sister for the weekend and even though I had the receipt where I paid it up, the repo man shows up at my sister's on a Sunday just as we were leaving for church and took the car. I was so humiliated, not to mention absolutely livid for one because they did this in front of my family and two, I had paid it and had the receipt to prove it along with the names and numbers I talked to at Drive Time telling me I was caught up and no longer in repo status. Supposedly they forgot to send a fax or email to the repo company letting them know and when I called on Monday, they said in order for me to get my car back, I would have to make two up front payments and pay the repo fee. I let them keep the darn thing. The first week I had it, it left me stranded on I-75 and I had it towed to the Kia dealership (it was a Kia Optima) and they told me there was sand in the motor and I had to fork out $1000.00 dollars for that. I would like to join in the suit against them.

POSTED: Tuesday, August 26, 2008

my boyfriend and his mom both bought their cars from the sanford drive time. His mom bought hers first, about 3-4 years ago and my boyfriend got his car 2 1/2 years ago.

When my boyfriend got his car, drive time decided (on there own) that they were going to co-sign him onto his moms car (without his consent.) He was 17 at the time his mom got her car which made him too young to be a co-signer. And he was only 18 when he got his car from them. They didn't even bother to tell him that they decided to put him as a co-signer. He found out on his own when his mom was a week or so late on her bill and one of their agents called his phone 7 TIMES IN A ROW leaving some not-so-nice messages demanding that he is the one responsible for the payment (because he's the co-signer) if his mom can't come up with it.

i have heard nothing but bad things about drivetime so i thought i would share my boyfriends story becuase im sure they have done the same thing to someone else before.

the DeLand location was even shut down becuase they were ripping off so many people.

I suggest a REALITY check here. Think about these things. Use some common sense.

AUTHOR: Steve - (U.S.A.)

POSTED: Sunday, August 17, 2008

First of all, I am in no way on the side of Drive Time here. They are scum,

However, being scum is not illegal.

As long as they do full disclosure on the terms of the sale, they have no other legal obligation to you.

Someone complained about the 29% interest rate. Well, nobody held a gun to your head to do the deal, right? YOU agreed to it. Fully disclosed.

These cars are sold "AS-IS" in most cases. That too is CLEARLY DISCLOSED.

And, there is a reason like your crummy credit that you are dealing with DriveTime in the first place! If I am wrong on this, why not just go to your bank for the loan?

Again, just a reality check here.

Many of the people who posted here are borderline illiterate, and that could be the root of the problems. Maybe you could not read and understand the contract you were signing.

As far as "class action" lawsuits go, they are VERY expensive and rarely does any attorney do them on contingency fee basis, and rarely does any member of the class action recieve more than a few dollars after expenses.

A class action lawsuit against a giant like Drive Time would most likely cost millions of dollars in cost alone, which you would have to pay, up front.

Only the uneducated spout "class action".

Avoid these places and you will have no problems. Buy a cheap used car for cash out of the newspaper or someone's front yard. Go to the GoodWill and buy a car.

If you cannot save up $500-$1000 to buy such a car, you cannot afford to be on the road anyway. Take the bus.

Sadly for us the only place for us to go to was Drive Time. We got a 2003 Chevy Malibu and we had to pay 200 every other week for this piece of junk, with some months it was up to 600 a month. After a few months our car started to fall apart. Wow this sounds familiar! We spent over 500 dollars fixing various problems with the car. After six months the car would shake when the air would go past the number 2 on the air dial, in Florida you need that air! The car would shake and sputter randomly.

In August of 2007 we were given my Grand Father's 1998 Ford Focus which ran much better then the 2003 Malibu, mothball smell and all! We used the Focus for a few months until a car accident rendered the car un-drivable. Boo!! So in March we had to start using the unreliable Chevy Malibu again. Month after month different things started to go wrong. The exhaust manifold had a crack, the back tail lights stopped working all together, the horn stopped honking, the hoses for the anti-freeze were cracking, and finally the head gasket needed to be replaced.

Not once did Drive Time try to help us out; even after numerous calls to the GM. We felt like we were drowning and had no way out of the situation. We are a young couple and there is no way we can afford to pay to get all those things fixed.

My brother happens to be a lawyer in a very high powered law firm down town and his wife happens to be a lawyer too. Guess who is considering a law suit against these jerks? I also happen to work for a very large media outlet. Hmmmm...

Contact me with your story and maybe we can get something going. It's unlawful to get cars that are lemons, paint over problems, fix things in order for the car to run for a little bit, and sell the car to people who already have money or credit problems. Drive Time banks on the fact that the Lemon Laws don't apply towards used cars.

It's time for this to stop.

Bad Service is ignored by Art Anderson when confronted he threatens you.

AUTHOR: Tony - (U.S.A.)

POSTED: Monday, July 28, 2008

I am an ex-General Manager. I was almost terminated many times for "rocking the boat" with service issues. On one hand the regionals put up a false front and tell you that DT is a company that wants to improve and give great customer service. Then I am told by my then Regional strategist that the service people were only doing what they were told to do. I was told to "keep my mouth shut and just concentrate on being a GM"

The latest trick by the corporate service GURU Lance and his trusty sidekick Art Anderson is to tell the dealerships that they have to check a car in when it comes to the lot and that they only have 24 hours to report any mechanical problems or they are stuck with any repair costs. You are not even allowed to have your lot porter check in the cars. Heck he/she might have some sense of mechanical ability like Jimmy at my lot did. You have to trust your sales people to do it male or female experienced or not. That is who is final checking in your vehicles.

Many of the GMs would argue constantly that the buyers had no idea what they were doing. We would get like $1200 for a trade in and then next week the same year make and model would show up on a lot for sale at like $12000. HMMMMMMMM!!!!! Want some very interesting reading?? Google the names of the two biggest people in the company. See what they have been up to in the past. WOW!!!! I had no idea until a Regional told me. All of a sudden I had phone call after phone call from other GMs and Sales managers as well a a call from two friends at corporate. Always wondered when an"on your side" camera crew would finally get smart and blow the lid off of it. Last time on got close there was a conference call from corp about it. Made em nervous I guess.

As your rebuttal states, the other companys that were in the news the people got lil to nothing back and the attorneys made all the money, BUT at least the company changed there ways off doing buisness in a good way, and if you look at the diffence in price of cable of $60.00 a month or so appossed to thousands of dallors per customer per year for there cars, the recap with be a great deal bigger for the customer. I know it is unjust the way things are handled, but the customer will recap and the company does change there way of doing buisness. So there is some sort of resulution in the end.

Gee, another class-action lawsuit?

AUTHOR: Friendly Help - (U.S.A.)

POSTED: Monday, July 21, 2008

I remember the results of the J.K.Harris class-action lawsuit as published in the paper here. The lawyers got millions, and the plaintiffs got enough money each for a tank of gas.

Then there is the cable service class-action lawsuit, where the victims got either $5, or one month of one free upgrade to their service- after which, I presume their service returned to what it was, or as I understand most cable & satellite contracts, the customer must then pay for the service upgrade for all succeeding months unless they cancel the service upgrade in writing including a note from their mommy.

Remember, the courts do not want to put the defendants out of business. You may remember that oh-so-true story about the goose that lays the golden eggs?

Has anyone spoke with an attorney yet about this?

AUTHOR: Tonya - (U.S.A.)

POSTED: Monday, July 21, 2008

Hi, I have filed a claim on here almost 2 weeks ago and check on it daily, I dont see that anyone has spoken with an attorney yet, so I called one to see if this is something they want in on. I called the Class Action Litigation Group in Santa Monica California as they handled the Menu foods Class Act across the USA with a group of Attorneys and am waiting for a response after they look over all the reports on this page, Im in California.

If I hear from them I will let you know, I did try to settle with Drive Time as to the problem I havening on them over charging on the Interest, they promised a buy down offer when you first buy the car, and the more you put down the more the interest rate is suppost to drop but they didnt keep the insenitive promise of a lesser persent rate they still charged the whole 24.4 percent and When I thought I made my final payment instead of a title They told me that I owe another 1075.00 Dallors, I have been fighting this for months, then I went threw my paper work and noticed that they didnt add my down payment till later and charged interest on that too. Please contact me if anything is happening with this. Tee (TONYA) in Buena Park, California.

did anybody take their cars to get it inspected

AUTHOR: Lambmit - (U.S.A.)

POSTED: Friday, July 18, 2008

After reading a bunch of post on this thread, I need to ask if anybody took their car to get inspected before buying it. Any good dealer will allow you to get the car inspected by an indepent mechanic. The mechanic will charge you about $100.00 but that is a small price to pay to avoid the headach of a junky car, high payments and such. If people would just buy a car for cash they would not have to have car payments.

Lets make ppl aware of this and get this class act in action.

AUTHOR: Tonya - (U.S.A.)

POSTED: Friday, July 18, 2008

If more ppl were aware of this web site then the number of complaints would go over the top and we would have a State wide class act suit, but a lot of ppl don't know that this site exists, and can not afford a computer and internet with the high price of there vehicle and insurance not to mention the repairs on the car. I to bought a car from them in 04 and I had an injury at work 3 years into the payments, I paid to have a payment due date change, and sent my payment in by mail, I didn't notice at the time and no one informed me, but they were posting the payments 2 weeks after I made the payments and charging me late charges and interest on the late charges, then when I thought I made my final payment a few months ago, I was expecting the title and got a bill for over a thousand bucks, I kept getting calls from a different person everyday saying pay, when I asked what these charges are for they said the past 2 years of being late and read your contract, I kept calling the service dept then the regional manager and every time they would send me to a new person and I would have to explain the whole thing over and over and still they would just say pay, when I asked for an Itemized bill for the charges, they sent me a sarcastic letter in Bold type saying.
"YOU OWE 1073.00 DUE NOW" Smart A's, so I started checking my payment history and found they didn't deduct my down payment from the original price till 3 months after I had been paying the car so they were charging me interest on money I paid before I bought the car and also a lot of my payments weren't recorded, and with the buy down offer they gave me at the begging, the more you put down on a car the lest interest you are suppose to pay, with no down the interest would be 24.4 and with the 800. down it should have dropped to 21.4, so now I am mad as all on here, I have contacted everyone on here that is local to see if they have any news on a class act and tried to give them my E-Mail to contact me with any infor, It is my name at the bottom of page at yahoo if you hear anything let me know, I have 4 more pages on here to go threw to contact everyone who is local , Please keep in touch... P.S also a woman on here from Georgia stated that she finally got rid of them off her credit reports by going to Lexington Law out of Utah, they cleaned it off for her and 2 other ppl on here said they stopped the harassments from them and there calls by filing a report at WWW.FTC.Gov, to stop the calls to work family and references on your app. Try these both and Lets do this thing. Are we all together? I'm contacting a couple of Class Act attorneys to see if they want a piece of this, once attorneys get involved in this they will notify everyone who has bought a car from them and ask if they would like to join in the suit and we can put them out of business and If you want me to keep you informed send me a message at my E-Mail, Thanks for all the reports on here, its good to know I'm not alone, I have had every single problem you have, but it would take to long to type them all in a report or this rebuttal. Thanks again....teeteetime4940

I bought 2 cars from Drive time in the past 7 years, this second car was hard for me to payoff, I was injured at work and had to go into Drive Time to sign a Modification agreement on my pay date change for disablity and my due date. I paid them $35.00 to do this 2 1/2 years ago. I paid my car off and so I thought, I made a call to them asking how much to bring my account current, thinking this would pay it off and I would recieve my title. They told me $586.00 so I made what I thought to be my final payment. Then I started recieving call's 2 times a day for $1001.00 still due, I asked what these charges were and I was told they were $135.00 late charges and $866.00 on the interest on late charges. I argued with them, but to no avail. Every day they had a different rep calling me to collect thinking I would get tired of exsplaining and just pay it. I was told if I didnt pay this amount in 10 days it would go as a charge off and I would not get my title, and they would take my car. I finally got to speak with a regonal Manager who laughed at me because of my work injury and hardship, and said all I want from you to resolve this is for you to pay $1001.00 I exsplained I had paid $35.00 2 1/2 years ago to avoid late charges and was not informed of any late charges that were accuring interest. He said read your contract, we dont have to inform you. I asked for documentation or a break down of these charges and he refussed and just said pay or eles. I told him I was told it was late charges with interest on the late charges. and the late charges were on the interest, which when broken down is interest on top of interest on top of interest and that is compounded and is illegal, He said it was interest on the car loan and changed the story, I asked for something in writting a bill or anything. he refussed. I was never notified of any late charges and since my injury I have been stuck home in bed and have made may payments by phone and when I call in a payment I ask to pay what ever the balance is to bring me current (Which in any form includding late charges) I would pay the amount they quoted me and never was there ever a mention of any late charges, so they delibratly hid them so they would accure interest at the end of my payment. In hopes that I wouldnt check this out and just pay, they demanded payment in 10 days. I started to check my payment canelled check...ect and noticed that for the past 2 1/2 years my payments werent posted till 7-10 days after they were sent, causing them to look as tho they were late. I tryed to call the dealer ship I bought the car from and they were closed I also tryed to call another dealer ship were they had moved to, also were I did my pay date and due date modification and they were closed, I asked one of the collection rep's why they were closed and he said we were having problems with some of the employees there. So I spoke with 9 different people from the corparate office and never recieved any bill or documentation of the monies they say I owe. And I was treated as if I was using my injury as a hardship to get out of paying all of this money that they wont document. I was treated like a flake and taked to like a child and disrespected by the regonal Manager. All he said was read your contract. and pay me!

Drive Time Victims

AUTHOR: Tbald1977 - (U.S.A.)

POSTED: Wednesday, June 25, 2008

After doing some research, I've come to the conclusion that we are 100% responsible for the choices we make especially when buying a vehicle. We are all Drive Time victims because we signed the contract rather than saying no and walking out. We felt that we were all obligated to them because we were in a tight situation and needed transportation. But after signing that contract, does this mean we are stuck and there is nothing we can do? No absolutely not. If we all get together we could easily put a stop to their scams once and for all. They need to stop getting away with taking advantage of everyone.

My name is Patrick,my girlfriend and I purchased a car at drivetime. Everything was fine for about 3months and then we started having problems with the car we contacted them and they referred us to their drivetime repair number and we got no help from there either. They sent us to a mechanic shop off of florida ave {which is not there any more} and they said the repair was going to be 500.00.

Drivetime would not cover it,or honor the warranty the gave us.Our vehicle was at this repair facility for two weeks and drivetime claims they have no kind of record of this at all. Our payments were 191.00 every two weeks. I made every payment on time and actually paid more 200.00 everytime. In the end we had to do a voluntary reposession, my credit went from a 683 to a 425. this is not right and not fair at all. After a little research we discoverd that we are not the only one with the same problem, there are hundreds more.We dont know what to do. If anyone could help us that would be great. Thank you , Patrick.

I think the one of the things this company is best at is rude customer service. There have been times that I have been hung up on multiple times in a row, all because I didn't have my payment in when they wanted it in. The payment was days late and I called them to tell them it was late and that it would be in the next morning at the latest. They hung on me 3 times just telling me to bring the car back in if I couldn't handle the payments. That is the only time I didn't have a payment paid a week in advance. And I overpay on everypayment with them. I notice that when you in during busy time to talk to them they are real quick to respond. I regret buying a car from them because I paid way to much for a car because I was stuck between a rock and a hard spot. Now that life is better for me, they say they don't refinance there own cars. There should be some type of law aginst doing business they way the do. I mean now that I look back, what was I thinking. Paying 3 times the worth of the car, plus the interest. I am willing to joing anything to make things change.

Drive Time ripoff and no gap insurance! Car crooks!

AUTHOR: Tbald1977 - (U.S.A.)

POSTED: Sunday, September 30, 2007

Here is my story on how Drive Time screwed me. Read on:

I went to Drive Time to buy a vehicle on April 25 2007 since I needed a car. I didn't have a way to get to the dealership so Russell Gremillion who is the Sales Associate offered to drive down to my house and pick me up since I had no other way of getting there. The reason why I trusted him is because I had tried to get a vehicle from Don Jackson Mitsubishi in Union City, GA and was approved for a loan.

But Ronnie Hamilton, who is the Sales Associate there sent me to Drive Time and he knows Russell well. They sold me a 2002 Ford Focus ZTS and they overcharged me $6,359.00 more than the car was worth and with an interest rate of 21.5% the total sales price was $21,364.93!

Being that my credit is poor and I really needed transportation to get back and forth to work, I figured I would pay it off in a few years. So I drove the vehicle home since I felt obligated because I was picked up and brought there.

Then on July 21, 2007 I got into an accident and totaled the vehicle. I was insured with First Acceptance and after they had told me my car was totaled, they only paid what the car was worth minus the $500.00 deductible. That was when I found out that Drive Time does not offer Gap Insurance and that they screwed me.

Now at this point I have no other choice but to go back to Drive Time and have them put me into another vehicle. If I go somewhere else to buy a car the remainder of the loan will be tacked on to a new car loan. My roommate talked to Russell Gremillion and he said that he was going to write off the rest of the loan and then put me into another car.

But I will get overcharged a second time and put into the same exact car that I had. The 2002 Ford Focus ZTS is only worth $7,940.00 in the Kelley Blue Book and Drive Time charged me $14,299.00 which is almost double. I want to know if they can get away with doing that. Because I really know for a fact that they took advantage of me.

My concern is that they may fall back on their word and try to tack the $7,000 on to the new loan making my car payments $700/month. I do not trust Drive Time and feel that I shouldn't have to be obligated to go back to a place that took advantage of me. What they charged me for that car I could have bought two cars for that price because even a brand new Focus isn't worth that much in the Kelley Blue Book.

I know that part of this is my fault because I never researched on the car and signed the contract being that I was stuck there and had no way of getting home. But even if Drive Time could get away with overcharging their customers double what the cars are worth, they need to get real and get gap insurance.

Also another thing they told me after I bought the car is that I had 30 days to come up with more funds to reduce the interest rate and lower my bi-weekly payments, which were $197.83 every other week. But they never told me about the APR rate.

My roommate figured out that $700 more down would have only brought my payments down $7.00! If I had let them trick me like that, I would have put myself even more in debt than I already was.

This is why I feel very uncomfortable to have to go back to Drive Time. I feel that if they took advantage of me, then I should have the right to go somewhere else and buy a used car without getting ripped off the way I did. I had no idea that Drive Time used to be the Ugly Duckling.
My question is this: is it now too late to open my mouth when I go back to Drive Time? Can I let them know that they overcharged me and that I shouldn't have to pay double what the car is worth? If anyone has advice for me it would greatly be appreciated!

Waste of money

AUTHOR: Patricia - (U.S.A.)

POSTED: Thursday, November 03, 2005

I would really like it if you would contact me about this class action lawsuit. I purchased my car a little over a year ago and I have had nothing but mechanical problems with it. When I had first bought the car I had absolutely no brake lights.Only to find out that it wasn't just the bulb that had to be replaced it was the entire light mechanism itself which just for one costs $65 plus labor. Not only were the brake lights not working but my transmission was slipping as well. I took it to the dealership and they told me that one of Drivetime's mchanics (lord knows we love them) changed the transmission seal and never put back the fluid that came out. So, needless to say not only have I been paying to keep my car running I am also paying an outrageous car payment each month. I am paying $20,000 for a car that blue books at $4,000.

Thank you,

The car I brought was two thousand dollars over price and I did not have a credit problem. My daughter saw a car she just really loved, so we brought the car. Not knowning that this company had a rep. like this. When I got the car home there was something wrong with the front end. I took the car back to the place and they would not take the car back. They told me they would fix the problems. I droped the car off to thier repair shop they had. They kept the car for two days when I got the car back the car had the same problems nothing was fix. That's when I looked on the BBB.com site and found all this info about this companies bad practices. I had no idea.

I bought a vehicle from drivetime in ocala a year ago and was only late on a payment once. But let me tell ya they called me the day after the due date. Well not only did I find out that the vehicle I bought was involved in a front end crash before I bought it but it was over priced by 7k. Well I paid the vehicle off early and I guess drivetime didnt like that too much because I mistakenly over paid them by 299 and to top it all off, its been a month and a half since I over paid and paid the truck off but I still have not recieved my money. When I call them I get the run around and they told me that the check is in the mail. Well like I said I was never late but once by two days on my payment to them but yet they have had almost two months to pay my my money and I am yet to see it.

Gap Insurance

AUTHOR: Diana - (U.S.A.)

POSTED: Sunday, July 24, 2005

I understand how you must feel; cheated by a big company. In my case I bought a piece of junk in 2001 and they charged me 3 times the value of the vehicle plus 29% interest. I had a not at fault accident 4 months later and after the insurance company paid them the value of the car, they wanted to come after me for the difference. They never offered me Gap insurance and I didn't know about it either. That is still in my credit and keeps me from buying anything. There's no law to protect us from a bad deal, but I hope in your case, you win.

Guess who brings car buyers to the "Scene of the Slime" so they can get Ripped Off?

AUTHOR: Stick - Auto Advocate - (U.S.A.)

POSTED: Tuesday, May 17, 2005

BeckyinVentura I hope you read and understand what I am saying. A car dealer Rip Off starts long before a car buyer gets to the dealer of his or her choice. A car dealer Rip Off starts with the advertisement and the form of media that gets the advertisement in front of the consumer.

Most car buyers can't read the supper small disclaimers in the TV advertisements because they are to f***ing small and they only have the supper small print up for maybe 2 seconds. It is a shame that our country's AG's don't bust car dealers for deceptive and misleading advertisements. I guess money from car dealers goes to a special place come election time.

We then have to chat about radio station advertisements. Ever notice in most if not all car dealer radio advertisements they have some fast talking clown read of the disclaimers real fast.

My question is where do the radio stations find these speed readers? Is there a speed reader talent agency that finds these clowns jobs?

Ever notice when flipping through the stations on your radio, just about every radio station has a fast talking clown running off a bunch of jibber Jabber that is so confusing. They do it to twist up your thinking before you arrive at the scene of the slime.

We now have to chat about newspaper advertisements. Have any of you in Rip Off Report land ever really look real close to a car dealer's newspaper advertisement? Ever read the disclaimers more then once?

Disclaimers in my mind tell you that you are not going to get the promise. Take a close look at the word "DIS-CLAIMER" There is no claim as to what you are going to get. because it is a DIS-claimer.

TV stations, newspapers and Talk radio stations all benefit just like the car dealer after you get Ripped OFF. You ask how I bet. They all get a piece of your money. Car dealer gets some of your money after the Rip Off and the media gets some before the Rip Off.

TV stations, Newspapers and radio stations that bring you deceptive advertisements also should be mentioned in your Rip Off Report as well as the car dealer who Ripped you OFF. Keep in mind who brought you to the scene of the slime?

Who was it that brought you car buyers to the Rip Off? TV station, Newspapers and radio stations are the ones that lead car buyers to the Rip Off car dealers. If that is the case why not mention the names of the media that lead you to the Rip Off?

If TV stations Newspapers and Radio Stations see they are mentioned in the car dealer Rip Off Reports, maybe they will take a closer look at what they are doing to their readers and listeners. Maybe they will turn down some of that misleading cash they all get from the Rip Off car dealers.

Blame the media for misleading you to a deceptive car dealer. If you are a car buyer that feels you have been Ripped Off by a car dealer post the name of the TV station, Newspaper or Radio Station that helped bring you to the Rip Off Car dealer.

One last note. If you see fine print in any car dealer advertisement, remember this little short saying.

If there is "Small Print" car buyer "Will Get BENT" Over!

Post their names. Post their web sites. Post the Radio stations phone and fax numbers. Never let the media off of the hook. Never forget they lead you to the Rip Off!

UGLYDUCKLING/DRIVETIME should do us all a favor and STOP DOING CORRUPT BUSINESS PRACTICES and advertise the TRUTH.

AUTHOR: Becky - (U.S.A.)

POSTED: Sunday, May 15, 2005

In 2000 I went to Ugly Duckling in Oxnard California and purchased a 1996 kia sephia. I paid $341.58 per month for over 24 months.

In November 2002 I was contacted by Ugly Duckling/drivetime regarding their V.I.P. program. I told the gentlemen I was not interested and so for the next 2 months I was harranged by phone calls regarding the V.I.P. program. I was told since I was such a LOYAL customer I could bring in $1,000 and I would be put into a NEW car with LOWER monthly payments than what I had been making for the past 2 years.

So finally with the allure of a new car I took my $1,000 in and to make a very long story short. I sat there all day long while they wheeled and dealed me and then they found a 2001 ford escort ( NOT a NEW car) that I could have if only I had MORE money to put down. I replied that I had 285 left at home but that was my grocery money. Basically for another hour and a half "LUCY" ( who 2 years ago was unfortunately, for me, not available anymore because she quit) cajoled me into taking the ford escort for a drive...TO MY HOME TO GET THE 285 dollars. So after all the dealing I was left with my grand total to be paid monthly ...$485.00 per month!!!!!! I WAS ASTOUNDED ..DID SHE SAY $485.00 ????!!!! OH YES SHE DID...I was flabbergasted, astonished and SCARED....but i felt i had no choice they had my money ,contracts and my old car...and where is my V.I.P. DEAL???? Its smoke in the clouds..

I am a disabled woman. I work for 14.5 hours a week at 6.75 per hour. I have been late several times. I had to pay almost 700 dollars last month to try and catch up. AND NOW AFTER 2 1/2 years of borrowing, begging, saving, scrimping and doing without I am going to lose this car ....because I cannot keep up with these ridiculously HIGH payments .

I was told by the corporate office that I made a "BAD" business deal. Yes, I replied with a Bad Business.

Yes, I think UGLYDUCKLING/DRIVETIME should do us all a favor and STOP DOING CORRUPT BUSINESS PRACTICES and advertise the TRUTH.

IF YOU HAVE BAD CREDIT OR GOOD CREDIT THEY WILL NOT HELP YOU BUT THEY WILL MAKE SURE THAT THEY GET PAID IN FULL AND 100 PERCENT OVER-PAID.

THESE PAST 2 1/2 YEARS HAVE BEEN THE HARDEST OF MY LIFE and now they are threatening me everyday with repossesion. It is tragic.

Thank you,

Ripped off, but got my money back

AUTHOR: Amy - (U.S.A.)

POSTED: Thursday, May 05, 2005

I bought a 1998 Nissan Altima from the Ugly Duckling in Mesa, Arizona at a 29.9% interest rate in 2002.

After having the car for only 3 weeks, I started having problems with it. I took it to a mechanic that I knew in California and he said it looked like the car had flood damage.

He suggested that I get a report from Car Fax to see what the history of the car was. When I ran the report it showed that the odomoter had been rolled back over 60,000 miles.

I called the Mesa store and told them that I had a car fax report that showed the miles had been rolled back. They asked me to come down and show them the report.

After 2 weeks, I got a check from them with all of my money returned that I had paid, plus a re-imbursement for the rental car that I had for the 2 weeks, and they even paid for the car radio that I had put in the car.

I can say, I would never buy another car from them again because of the outrageous interest rates that they charge, but I am glad that they did right by me by giving me a refund for a lemon of a car that they sold me.

I purchased a 1998 4 door Saturn SL from then Ugly Duckling in Petersburg, VA.

Less than a week my rear lights did not work. When I contacted salesman he said they "just sell the cars, not repair them."

I was in the "get your down payment back if you don't pay late program". I made all my payments on time and paid off the vehicle TEN months early. I talked to the salesman, the finance manager, and had the customer service rep look over my contract 30 (thirty) days in advance to avoid any problems. They all said there "wasn't a problem." My contract states "no penalty for early payoff" on TWO different pages. One month after paying off the vehicle IN CASH I recieved a letter from the Corporate office stating I was "disqualified" because I paid the loan off too early. Also Ripped Off

AUTHOR: Naomi - (U.S.A.)

POSTED: Wednesday, December 08, 2004

My husband has also been ripped off by Ugle Duck/Drive Time. He purchased a 96 Blazer. We didn't start having troubles with the car untill 6 months after we purchased it. In less than a year, we have put so much in repairs that we could have purchased a new car and on top of that, it caught on fire. After the fire, we contacted them and asked if we can do a trade in. We let them know that we couldn't keep paying the monthly payment and pay for the repairs also. They informed us that we have not paid long enough on the car.

By that point in time, I told them to come pick up the car. I refused to put any more money it to it and not have it reliable. My husband almost lost his job because of the car always breaking down. The car has sat in my front yard for 2 months now. They refuse to pick the car up but they have no problems calling his refences and letting them know our problems. They also have a problem with calling me and leaving nasty messages on my cell phone, telling that I need to make my husband call them or else. Number one, I am not listed on his loan, we were not married at the time he purchased the car and I was not a referrence.

We have filed for bankrupcy and when they called the last time, my husband informed them of this. They let him know that there was nothing that they can do with that and then they hung up on him. I would love information on a class action against them. They are nothing but rude and rip offs. I have even gone as far as to tell some one off the street who had just purchased a car from them to have a mechanic look at the car. We also went to carfacts.com and found 7 reports against the car. Please let me know if there is anything we can do to join or help.

Well i got the car and within the frist week it started to over heat, and i just could not take it to the shop and be with out a car. so i stuck with it and tryed me best with this lemon! well i moved back to Caliifornia and left it with my ex-girlfriend. To make a long story short it got repoed! I need help to try to get that off my record!! If the would have told me what was wrong with the car in the first place i would have not gotten that car and i would not be where i am at now! If someone could give me some help or show me where i could go get some help that would be great! Please, post your info below! please.

Stopping me from getting a home

AUTHOR: Stephanie - (U.S.A.)

Around 99-00 I purchased a car from Ugly Duckling at the time and I drove it for two weeks and it's motor seized up and it sat in the driveway and I was unable to get to work.

I asked them to come get there car and they wouldn't and I refused to pay for a car that didn't run so after not getting there money for awhile they finally came with a tow truck in the middle of the night and picked it up.

It is now on my credit report for 6,000 and I never recieved a letter stating that they sold it or it went to auction or so on. And now my husband and I have this on both of our credit reports and were trying to get a mortgage and my broker said this car is really hurting us and that we need to find out if they sold it or what.

I would like to know if you all have any information on who I contact to help you all because I would speak up for all of us and for my family they are scam artists and they need to be put out of business. Thank you

From Good to BAD int he Blink of an Eye.

In 2000, My wife had just given birth to our first baby Girl, and the car that we were driving took an unexpected dump on us. We were frantic to find another means of transportation so that we could get our new baby back and forth to her Pediatrician appointments. So we called, you guessed it, Ugly Duckling In San Antonio, TX. The guy that we spoke to was very professional and friendly(and had just started working there in the Sales Dept.) He drove from San Antonio to Kerrville and picked up myself, my wife, and our newborn so that he could take us to S.A. and get a car. Pretty nice of him , huh?

After we got all the paperwork filed, signed, and sent through, we got in our new USED car and left the car lot.

12 o'clock, noon. Rush-hour traffic, new car right? GAH! 10 minutes away from the lot, the car starts to overheat, and we are in a hellified sauna of reflected summer sunlight, dripping humidity, and hot exhaust fumes boiling through the open windows from the caravan of cars all around us. My newborn starts screaming because she is too hot, and then starts coughing because she cannot breathe very well because she is breathing in all the fumes from the cars all around us. I have no way to turn around and get back to the dealership because I'm hemmed in.

Traffic finally lets up a little and we are able to get moving again, and finally the temp. needle starts to go down.

We make it home and i call the dealership and ask if we can bring the car back and get something different because this one has already overheated. They said " No. The paperwork is already signed and processed, and the payments have been made. But, if you want you can bring the car back to the dealership and we will put you in a loaner until yours is fixed"

On and on like this for the next three months: Alternator, Temperature sending unit, throttle position sensor, brakes, etc. I call them with everything that goes wrong and they harrass me about my payments. So I am paying repairs and payments. Finally, I have had enough and I call them to come and get the car because I cant afford it anymore.

" Ok Mr. Couch. We will have someone out to collect it in the next couple of days"

2 weeks later i get a call, " Mr. Couch, what we are going to do is abandon the car and sue you for the remainder of the lein."

I told them that they could d**n well try to sue me for that PoS, but no matter how hard they kicked, they weren't gonna get any blood out of a turnip. This was 2 years ago. I havent heard anything else from them, but My credit has a HUGE ding in it from the abandonment and I am forced to keep taking the car with me everywhere I go so that I dont have to pay anything else on it. Even when I have washed my hands of them, they are constantly reminding me, through this complete piece of crap, that are NOT what they claim to be and do not have the capacity for honesty or integrity in business.

Ripped Off Too. This company should not be in business.

AUTHOR: Natasha - (U.S.A.)

Please file your Rip-off Report so we can get a class action lawsuit going. I live in Georgia and was ripped off at the Ugly Duckling/Drivetime dealership in Riverdale Georgia. I took my car to the Chevrolet dealership because I did not trust Ugly Duckling/Drivetime to tell me everything that was wrong with it. The Chevrolet Cavalier was a lemon and needed $2000.00 worth of work. The CHEVROLET MECHANIC told me if I was you I would take this car back because it was too dangerous to drive. Which is exactly what I did. This happened to me back in November 99' but I still check back to see if people are still having the same problems. Looks like they are.

Now I have a repo on my credit report, they're killing my credit!!

AUTHOR: Marie - (U.S.A.)

POSTED: Wednesday, January 28, 2004

I have already posted a complaint earlier and would love to be contacted in regards to a lawsuit. I made one car pymt and then my car was repo'd. It wasn't drivable after 30 days. They wouldn't even tow it for me and I live an hour and a half away from the company.

My alternator went out, my starter went out and then the whole car (90' Cavalier) went out. This was back in 1998. It was the first car I ever had and boy what a mistake.

Now I have a repo on my credit report and a balance of over $4000 for a car that didn't last one month. When I went car shopping last year the car dealer was familiar with Ugly Duckling's scams and ignored the whole repo.

These people need to be closed down.

AUTHOR: Judy - (U.S.A.)

POSTED: Monday, January 26, 2004

I posted my own rip-off report on these clowns. I would like to be a part of your class-action suit.

I, too, am tired of dishing out money to fix this 2001 Kia (haven't even had it a year)and get harassed for making payments on a piece of junk that needs to be in the shop every other week. It's waiting to be towed right now, as a matter of fact.

These people need to be closed down. They are not "user-friendly" and they are very unreasonable.

Hot Deal ..too HOT to handle!!

AUTHOR: Catie - (U.S.A.)

POSTED: Sunday, January 11, 2004

My boyfriend also bought a car from Ugly Duckling before it changed names. Amazingly so, it also caught on fire. When he tried to deal with them re: the situation, it took days of threats and harrassment. Finally we went to the corporate people. Even though they came and towed the car after it caught on fire beyond repair, they continued to harrass him about making payments. Can you believe that!?! The car, aka the Torch, was in their possession but they expected payment! If it will help, I even have pictures of the car before it was towed away.

THIS IS TRULY A RIPOFF

AUTHOR: Kisha - (U.S.A.)

POSTED: Monday, January 05, 2004

I had a car with Ugly Duckling before they were Drivetime. My interest rate was older than me and my payments were ridiculous! Within the first couple of months I replaced at least 300-500 dollars worth of parts. In fact I had the car for less than one week before I needed to replace the breaks! I enventually had the car voluntarily taken because I couldn't make payments and fix the car at the same time. And in the end this is how bad it was. At that point I was so tired of their unprofessional collection personnel and unprofessional tactics that I told them to come and pick the car up. But make sure to bring a tow truck as it doesn't run and hadn't been for awhile. I can speak calmly about this now because they took the car over a year ago but when it first happened I was PISSED! I tried to file a lemon lawsuit here in CA but it was hard. If you can help, PLEASE CONTACT ME. And good luck to all. Best to also file your own Rip-off Report so the people at this site can get a lawsuit going.

Manditory Arbitration

AUTHOR: Catherine - (U.S.A.)

POSTED: Friday, December 12, 2003

I dealt with this company in Texas. I don't know if all of their locations use the same contract or if if has been ammended lately, but mine had a manditory arbitration clause. Did yours? And if so, are you sure there is a way around it? If it turns out that I HAVEN'T signed my legal rights away, I'd love to help you out.
