First of all anyone who has subprime credit knows how hard it is to get a lender to finance you. Secondly if you have filed bankruptcy on top of that then you know that your chances are slim to none. So here's my story.

I am new to phoenix and i do not know anyone who can tell me the best place to go to find a reputable company who can finance someone with my financial situation. So I look on the internet and find several who state that they can help no matter what your financial situation, that is lie #1.

So I travel out of my to Earnhardt dodge in tempe where I met justin who is the sales person to help into the vehicle that is within my 15,000 limit as stated by the trustee. This information was given to Justin a week prior to my arrival at this location and again 2 days prior to my arrival so we wouldn't waste each others time by looking for something that would not work.

I arrive and two salesmen bum rush me before I am out of the car.
I then told them as instructed to ask for the Mr. Ed. department
I then was led into a very hi-tech waiting room with plasma tv's and leather couches and was given water to cool me off, while this person went to call the department and have someone come over and walk me to the next department.

Ten minutes pass and out walks this nice clean cut gentlemen named justin. We walk over to the dodge building and I am again seated in the not so plush waiting area. When justin precedes to bring me some documents to fill out, I asked him what were the documents for? He told me that they needed to pull my credit report again. I then told him that he needed to get the information from avondale where I had been two days prior and was told that all the information would be transferred to this location because it was closer to where I live and they had a larger selection of autos.

Justin informed me that yes while I had been pre-approved for a sum of which he would not disclose he stated he needed to pull my report again to see what exactly was on it. I again referred him to the avondale store. He then told me that since they were the same store that I would not affect my credit score if they pulled it again. This should have sent up a red flag there.

I conceded after debating this issue back and forth about ten minutes. He then when to pull up the credit report which took about 20 min. He then came back and asked me again for all the information that I had given to avondale and was told that it would be transferred to tempe. I again went over the information just so that we could cut to the chase and get to the
vehicles.

He disappeared again with the paperwork for another 20min. He then returned with a list of vehicles that he stated would be in my price range of 15,000. He stated that he had large selection of what I was looking for or something close to it. I was looking for a Kia Sorento with low mileage or something along those lines. Justin showed me a 2005 sante fe and 2005 pt cruiser and he said that a ford escape would work.

I again reminded him of the 15000 dollar limit. He again assured me that these vehicles were within range. I test drove the sante fe. When I returned he asked if I like this vehicle and i told him i do but if it is not within range let us go and find a pt cruiser. He stated no that is okay this will work.

I was then directed to ryan chapman the finance manager who worked this deal. I asked very specifically if the bank denies this loan will i receive all my monies. " oh yes, but the only way this deal will not go through is if you left out information on your application." quote, unquote. I also stated this deal with not fly with the bankruptcy trustee because this loan is for 17678.45 and it specifically states that the max amount is 15,000. " oh it will work." I crossed all t's and dotted every I when i noticed that the alarm that was to come with the car the box was checked no decline alarm system.

I asked about this and was told that they could not work it into the finance part of the contract without the price going up. So I asked how much was it. Mr chapman preceded to work with his calculator and a 399.00 dollar alarm system soon turned into 755.45. I informed him this was a lot of money for this system, he then assured me that it was a top of the line system and that he has one. Since it was included in my insurance premimum prior to finance i told him i would pay for it separately and on a 30 day payment plan. He agreed. He then stated he needed to stop them from taking out the alarm before to late. I had already been there 2.5 hours and was just ready to get my vehicle and leave. He then returns to tell me that they already took it out and that they would try to work me in. I sat there for almost 2.5 hours more for them to work me in. Long story shortened I left on the 18aug06 at 5:15 p.m with my new sante fe
(yeah right)

On the 23rd from wade who then informed me that they needed the trustee's authorization, he told me that all the bank needed was some info on my monthly bankruptcy payments and schedule of payoff and and termination date. I was getting pretty frustrated because all of this had been gone over like ten times.
I gave the information again and I faxed all of the information needed to the trustee.

On the 24th I recieved a call from wade asking for the information. I then told him that I had not heard from the trustee but that I would call and see. I then called the trustee's office and the lady who does the loans informed me that she had declined the loan due to the vehicle being worth more than the loan. I then called wade back and told him what she had told me. Wade then told me to stay where I was and he would talk to the bank and see what they were willing to do.

After about an hour he calls back to say that the bank would reduce the loan to 15,000 that was asked. I then told wade to put it in writing and fax it to me. He Informed me that he could not do that. I then told him to tell the trustee this and he agreed and i gave him her telephone #.

The trustee then calls me to say that the bank had agreed to drop the loan to the allocated 15,000 and that she had agreed to approve the loan. I waited until the 25th to check my account to see if they had taken the monies for the downpayment and the alarm and sure enough they had. So i figured that the deal was solid and that I had nothing else to worry about. (NOT!!!)

Corey another employee of earnhardt dodge called me on the 28th to inform me that he had spoken with the trustee and the bank and the trustee would not redo a letter increasing the maximum allowed and that the loan wasn't approved so I would need to bring the vehicle back. I asked him why she would need to redo the paper work? He told me to make the loan work. He then told me i could stay in the vehicle if I would come up with a larger downpayment in amount of 3000 more down or a co-signer.

I then asked him why this was not part of the criteria before i left the dealership before leaving with the car and signing the paper work. I asked him why was this now almost two weeks later considered when the bank and the dealershp have both looked at my financial situation took me through all that i went through and now you want a co-signer or a larger downpayment amount (mind you I have already put down 3800 which includes that expensive alarm) so I asked him how much more was the bank asking for. He then started fumbling around for an answer " oh well I haven't talked to a bank yet, then I dug a little deeper and found out he was just phising for a way out of the mess that they had created. I told him to get back to me when he had talked with a bank on a reasonable downpayment and promptly hung up.

I then called the trustee's office and asked if anyone from the dealership had called and talked to her about this loan. She informed me that she had not spoken to anyone in that office since wade who had informed her that the deal had been dropped to the requested amount.

Corey then calls me back about 7;15P.M that evening to tell me what the lender is willing to do. He then precedes to tell me that the trustee and the lender needed me to pay the down payment on the bankruptcy and they would then place me in a 2006 vehicle with no money down. I then asked how long had he been doing business and he told me ten years and i then asked him then how is it you do not know what the bankruptcy laws are and what the lenders will and will not accept.

He then told me that the lenders do things on a case by case basis. I then told him that bankruptcy stipulations are the same as well as the lenders who deal with them no exceptions or case by case situations. I then preceded to tell him about how i spoke with the trustee and found out he was lying. I then told him that I would like my monies refunded in either cash or cashiers check, then preceded to tell me that it would be in an earnhardts check. I told him no, i do not want to wait around 5-10 business days for my check.

I then told him no deal if you've cashed my checks and have my money then the deal is done and I have my truck otherwise as i stated earlier my money in cash or cashiers check and promptly hung up.

The very next day justin calls; trying as nicely as he could to tell me the very same thing as corey but in a nicer way to see if maybe I would be lulled into submission. Justin started by saying that the trustee and the bank agreed, that's when I stopped him and told him that I had already spoken with the trustee and she told me she had not spoken with anyone from the dealership since the 18th. He then went on to say that the bank would like me to place the downpayment on the bankruptcy even though this loan has been approved (corey stated that it had not been approved.) and that I could get placed in a 2006 vehicle with no down payment. I then asked justin if this loan has already gone through why are you all harrasing me to bring the vehicle back and get another one. He states " Because it is too expensive" He then told me that I needed to bring it back before the end of the month cause that is when the bank does its billing.

I then reminded him that he said the vehicle had been approved.
He then states " Yeah we made it work with the 15000 and the bank approved it, but the bank would much rather you put your downpayment on your bankruptcy to bring down the amount so that we could put you in a 2006 with no money down. I told him that none of this made any sense if this loan is approved then I see no reason other than you all made a boo-boo and you want me to help you fix it without losing your commission. I then told him I would like my monies in either a cashier's check or cash so that i could go somewhere else or no deal, he then told me that I would have to talk to corey tomorrow.

Long story short I have been called everyday two to three times a day on every phone that I own asking me to come in and pick another vehicle. i have told them over and over that I want all my money the 3800 owed to me in either a cashiers check or cash so that we can part ways never to meet again and i hold out hope that there are reputable companies out there who can help people in our financial situation and not try to eat us little lost sheep who have been caught unawares by the wolves in sheep clothing.

Gwendolyn,

Honestly, you have subprime credit, you are in the midst of a Banruptcy, the LAST thing you need to be doing is buying a car at these prices.

You would be much better off buying a reliable, ugly beater that is in sound mechanical condition. The money you will save on the car payment and insurance alone would not only help you resolve your debt situation in a quicker fashion but you could save a substantial down payment for a new car and get a better deal.

Before you deal - Educate yourself. These guys saw you coming and all the delays for the finance manager, pulling the credit file, etc. were simply stalling tactics so a less experienced salesman could consult with one more experienced (i.e. finance manager) to allow them to pad the deal to make more money from you. There are a myriad of books and websites that will educate you on purchasing a car before you hit the dealer. A dealer who realizes you are an informed consumer will quickly back away from the sleight of hand they use to inflate the prices and the financing options.

Gwendolyn...RULE #1 when dealing with a car dealer..

Gwendolyn,

The first thing you have to realize is that ALL large car dealerships are scum and the salesman are TRAINED on about 6 different ways to rip you off as bad as possible. Only an EDUCATED buyer can shop at a large dealership. Do not attempt to do this on your own, as you WILL get royally screwed.

RULE #1. NEVER take possession of a vehicle until you have the actual financing paperwork IN YOUR HAND fully completed and signed and clearly showing the name of the bank, the total purchase price, monthly payment, and interest rate. There should be no blanks on it and there needs to be a bank representative signature. Only at this point your deal is done, regardless of what these lowlife tell you. Verbal agreements do not ever supercede what is in writing.

If you do not have this, DO NOT give them any money or your trade, or leave with the new car. As soon as you do, the bait and switch game begins. This is an all too common scam. You have to be right up front and clearly ask them:

1: Is this deal done with financing approved?

2: If the answer above was no, or was any sort of double talk, you simply tell them to give back your trade and money down and call me when the deal is approved.

3: If the answer was yes, make it very clear that you have recorded the conversation and that any further contact asking for more money of the return of the vehicle will be met with criminal charges and civil lawsuit. Do we understand each other? The deal is done, right? Yes or No are the only acceptable responses here.

Car salesman hate buyers like me. I have had major confrontation with idiots like this. But then I went to the "GM" and got the fool fired, and got the deal I wanted.

I had one idiot try to withhold my keys to my trade. he outright refused to give me access to my trade when I cancelled our negotiations. The deal was not done. I walked outside and called the police on my cell phone and had the sales manager arrested for auto theft. Its amazing how fast I got my keys and my trade after that. I DID press charges on this fool.

You have to be in control at every point of the deal. As soon as you give them control, you just got screwed royally. Guaranteed.

I don't know where to begin or how to even explain it. "I have subpar credit with a bankruptcy on top of that". After reading your prose, that doesn't surprise me. The only reason you didn't get taken by these scumbag crooks is because the bankruptcy trustees wouldn't allow it. What's that old saying? A fool and his money are soon parted. You can buy a brand new basic pt cruiser for around $13k. There are better vehicles in that price range. There was a post from someone who was interested in a pt cruiser a short while ago. I started watching who were driving them. Hard to believe.
